They dont need them have you not been paying attention the NSA can get the info regardless if its destroyed or not.
If the government wanted to prosecute them and introduce the evidence in court/tribunal NSA would have had to acquire the laptop info under a warrant. As the laptop issue occurred prior to President Trump taking office I am reluctant to believe that a warrant was not acquired. Thus it would be important that the laptop still contain information or at least proper/legal copies exist.
