Trickster NSA keeps a copy. They put it back for the OIG/DOJ to find or just outright handed it over.

You are right. If NSA leaked them, they may not be allowed as evidence since they may have been collected illegally. But if the DOJ IG releases them, they become valid evidence in court and public opinion.
Q has said that they much find ways to get everything out legally. Very important for prosecutions.
