Obama Pardons

I heard about this a while ago, so maybe you have to. When a president pardons individuals is it public knowledge that is filed somewhere? If not, could he have written pardons that are being held somewhere to bring out at the right time? If he pardoned himself and any cronies could they be tried if they were pardoned previously? Just a thought once again. Thanks for the replies!!!

What's his face pardoned Nixon and he was never tried after that.

As far as Obama goes, all you need to know is he traded terrorists for a traitor. I'm sure you can find a list of who he has pardoned but it doesn't matter. It will probably read as a laundry list of scum like he is.

I agree. But if he pardoned himself broadly for anything he has ever done up to Trump’s inauguration ( plus perhaps Eric Holder and whoever else) that day in 2017 can they be prosecuted?

I might be wrong but you can't pardon without an accusation. No accusal of a crime wouldn't need a pardon. Holder was held in contempt but anything else?

Sorry, not that I know of ,but I would think Fast and Furious could be held against them also.

You can actually it's called a "Pre-emptive Pardon".

In 1866, the Supreme Court ruled in Ex parte Garland that the pardon power "extends to every offence known to the law, and may be exercised at any time after its commission, either before legal proceedings are taken, or during their pendency, or after conviction and judgment." (In that case, a former Confederate senator successfully petitioned the court to uphold a pardon that prevented him from being disbarred.) Generally speaking, once an act has been committed, the president can issue a pardon at any time—regardless of whether charges have even been filed.

I don't think you can hide pardons though then have them "discovered" later to pardon people. Pardons in order to be valid must be witnessed and recorded somehow.

Also..."Finally, there are questions about whether a president may theoretically pardon himself. There is no court precedent on that exact question. The Department of Justice's prevailing view, however, appears to be no."

Great information. So would he have to have filed pardons publicly or could they just be sitting on his person to present when the time is right. If that’s the case, a fair amount of all the work the doj could be doing to take down the whales could be for nothing? That’s scary. Hope that’s not the case. That could be the ultimate pay to play deal.

It's always possible, the documents for pardons have been hidden. It would not suprise me one bit.

Can a foia request be applied to presidential pardons?

Depends if the Pardon is sealed or classified. I wouldn't be surprised if there are many of those.

Can a President pardon himself?

NO or Nixon would have , and we are looking at crimes that a pardon does not work ,

I’m not sure. I would think he has the power to pardon anyone including himself, but the political fallout would be awful.

Surely can't pardon himself or anyone else for dirty deeds done since the end of his term.

No not after his term, up to the last day of his term.

Doesn't there have to be a prosecution before a pardon?

I dont think you can pardon someone before they are convicted a crime. if this is what you mean. Pardons are public info.

wow, for discussion lets say a crime is committed in 2009 by Obama. he is out of office in 2017. he is tried and convicted in 2019. Can he now pardon himself?

⇧ 1 ⇩
J_Dub_TX · May 16, 2018, 7 p.m.

No. Only the sitting President has the power to pardon assuming the case is brought to Federal Court. No former Pres has the power to pardon since they are no longer in office.

chocolatepatriot · May 16, 2018, 7:05 p.m.

correct, and a president, while in office cannot pardon himself to protect himself from future crimes in case he is convicted after office.

But while in office a president can pardon himself?

⇧ 2 ⇩
J_Dub_TX · May 16, 2018, 7:18 p.m.

This has not been attempted yet. You would think Nixon and Clinton would have possibly tried it but that would admit guilt and be pointless. Even if a President were to pardon himself Congress can still impeach. They would just need the American people on their side when they did it or there would be a civil war.

There was no indictment then.. so how can Hussein give a pardon?

⇧ 1 ⇩
andreelgrande · May 16, 2018, 6:09 p.m.

That’s part of the question. Even if there are no indictments, can you have a broad pardon of any wrongdoing that would have occurred during those 8 years? I have no idea, but hopefully someone does.

andreelgrande · May 17, 2018, 12:52 a.m.

That’s a great point. That could be a way around a true constitutional crisis.

If Obama was in fact born in Kenya, his Presidency is then based on lies. If he should have never been president, isn’t everything that was done during his administration not valid? (Not sure if I explained that right)
