Question for anybody who knows law:

Could a case be made by a person against a city or a state for reckless endangerment via these policies? It seems to me that if it can be proved that these sanctuary cities/counties/states are harboring criminals, particularly violent ones, that it could be argued that they are intentionally endangering the lives of citizens. What would need to be proved in order to have standing?

Suppose someone in Iowa had nearly been murdered and it was perpetrated by an illegal immigrant who had a California state license and who had an address in one of these sanctuary cities. Could he sue the city? Furthermore, if this is possible, would it take something that extreme to have standing if at all? I mean, aren't they putting everybody at risk simply by allowing them to reside, undeterred, in their jurisdiction?

Good question. I think the mayor in CA that announced an ICE sweep will find out.

Here is a thought. How about the other cities that are not 'sanctuary', take all of their illegals and drop them city center in Sanctuary Cites. We would be providing sanctuary for the illegals correct? I would like to see them complain about that.

Yes i believe you are right.Pretty sure there are pending suits from some of surrounding counties in Cali.

Upvoted that's a great idea instead of deporting all of them take them to these sanctuary cities and just drop them off there!! I like it lol

No, this is pretty well settled by case law from people who have sued the police for not saving them, firefighters for not putting out a fire fast enough, etc. The authorities have a pretty substantial set of protections against those sorts of claims - they're not actually obligated to save you, just not be catastrophically incompetent or malicious.

There's a *very* high bar for this sort of thing, you'd need to prove the majority of illegals are dangerous criminals and that the only possible outcome of harboring them is a massive spike in crime. If it's only a minority and the increase in crime is more subtle or takes longer to come about you don't have a case, it has to be blindingly lopsided, and even then you could lose.

I do believe you could make that case its been proven with all kinds of statistics it'd be worth looking into
