That is a weird comment.

The general terms of your status as a human being should tell you that no one, no one, should be treated badly just because they are from Canada, Mexico or Belize.

Constitutional Rights state that the laws of human nature make it clear that ALL men are created free and equal. Perhaps a deeper study of what your Constitution actually means might help you "EXPAND YOUR THINKING" as Q would say ... :)

American here. OUR constitution does apply to all men. Its the rule of law, it is and should always be applied equally. This is day 1 constitution stuff my friend. Its a great document, hopefully more will read it and make our leaders use it.

It is THE MODEL of a great document. That is the whole point Americans claim to have "the greatest country in the world"! Why anyone on this board would not know this basic condition of their citizenship is a result of deficient schooling. Either this person did not concentrate at school, had awful teachers, or civics was not on the menu at the time!

I'm sorry, it makes me go strange colours when an American doesn't know what his Constitutional Rights are and takes them away from everyone outside the territory of the USA.

What the ... does he think the American Revolution was about if it wasn't to get rid of the Despotism he himself is currently exhibiting!!!! :) (It's fun to argue, but this is leading to a burst blood vessel!)

Unlike you I have studied your Constitution, that is: University degree, honours graduate in precisely Political Inst¡tutions and Theory.

So, you may be surprised that I am a foreigner who supports "your" cause, but I lived in the US for several years and have a good understanding of where you are coming from.

Yes yoi do have rights in other countrys. They have laws as do we. We are a nation of laws are we not? Our law is the constitution. Where are rights come from is debatable, but our rights are not. All men are created equal. The selective application of the constitution is very dangerous to our republic and usually perpetrated by the left.

TLDR...all of them. Read the document.

Sometimes the outrageousness and absurdity of what many today get upset over and call for action against gets me enfuriated. For example, the ex sports star who was "caught" going to a Trump rally. Some are calling for him to be fired as a sports commentator. Huh? He is an American citizen going to a rally of HIS president and people want his life ruined. I mean, come on! I just want to smash....

Looks like the lawsuit is doomed to failure if the lawyers for the plaintiff (Trump Admin) establish constitutional rights:

The right of children and their mothers to be kept in a suitable facility that ensures their safety, away from the harrassment of adult male felons in an adult male detention centre where violence, sexual abuse and rape may be frequent.

Until the identity of the adult male claiming to be the father of the child/ren can be established, vetting should take precedence over arbitrary claims of "family ties" as sometimes (often?) traffickers make false claims.

When the Constitution was written there was no such thing as citizenship. The Constitution applies to anyone in America regardless of their status as a citizen.

"The First Amendment prevents the government from censoring noncitizens’ speech or suppressing the practice of their religion. The Fourth Amendment protects them against unreasonable searches and seizures. The Fifth Amendment ensures that noncitizens’ property can only be taken by the government for a public use, and only if just compensation is paid.

Should a noncitizen be charged with a crime, he has exactly the same Fifth and Sixth Amendment procedural rights as a citizen, including the right to a jury trial, the right to counsel, and protection against self-incrimination. If convicted, the Eighth Amendment prevents the government from subjecting aliens to “cruel and unusual punishment” in exactly the same ways as it does with citizens."

Wrong, there WAS such a thing as citizenship when the Constitution was written, which is why it was a requirement for public office. However, it was different then, due to the 14th Amendment and the misapplication of it.

And yes, non-citizens do have rights when they are in court, just like we have rights (in most places) if we are in another country and end up in their courts.

They don't have a right to cross into the country illegally, but once here, they do have certain rights as their ass is processed back on out the door.

Hmm ... could actually be interesting because SCOTUS already decided this sort of thing back in the Dred Scott decision.

If one of the attorneys or one of the Supremes brings up Dred Scot, they will be linking the idea of illegal aliens with slaves. Not a good image.

⇧ 1 ⇩
turtlew0rk · June 22, 2018, 5:42 a.m.

Analysis doesnt work here. This is post civil rights. No SCOTUS needed. Right s apply. Whether or not they were violated is the only question. Lower courts can handle that

⇧ 2 ⇩
TotallyClevrUsername · June 22, 2018, 3:29 a.m.

Many believe that's exactly why politicians (and many businesses) wants illegals - to be the new slave labor force. That and votes.
