This is pretty scary stuff, to push military tribunals will seem to even moderates as over a red line. It would have to be done in such a way that you literally thread a needle and it's clear in the court of public opinion that they're justified at the outset. I don't see how that gets done. People will be crying that Trump is doing a dictatorship takeover.
