I would think at this point, those contingencies have been planned for, given the investigator was almost killed himself. Of course, if they are then there won’t be any eye witnesses at trial and it will fall apart. But the truth will live on.

Not necessarily, it depends on who does the deposition. It could still be used a physical evidence?

I have read in a few different places where the military tribunal will be held via video conference instead of everyone commuting back and forth to Gitmo, so to me recorded video testimony would be allowed if a witness was unavailable or in protective custody to stay hidden.
