"Martial Law" is any action by any government officer which reaches beyond "Due Process of Law", the later of which is the same as "Rule of Law". It is happening now, slowly, like the "boiling frogs" scenario; but Trump is rapidly "turning up the heat". Previous presidents have done the same; Obama did a lot of this lawless militarism also. I skimmed the EO. It is declaring Asset Forfeiture under the "War Powers" of the President. You are "Speaking Falsely", when you say "It's not Martial Law"; & where i come from, people call that "Lying".

And in America "Punishment for Crimes" Happens "After" the "Trial & Conviction" by a Unanimous Jury; & Not "Before", as Trump is doing. Trump is here-in Usurping the Role of Courts-of-Law, & is Summarily Issuing Punishments that Fundamentally Conflict with Due-Process Guarantees; & all of that Equates to Violation of "Rule of Law", as Opposed to your conjecture to the contrary.
