Andrew Mark Cuomo (/ˈkwoʊmoʊ/; Italian: [ˈkwɔːmo]; born December 6, 1957) is an American politician, author and lawyer serving as the 56th and current governor of New York since 2011. A member of the Democratic Party, he was elected to the same position his father, Mario Cuomo, held for three terms. He has served as Chair of the National Governors Association since August 2020.

 

Born in Queens, New York City, Cuomo is a graduate of Fordham University and Albany Law School of Union University, New York. He began his career working as the campaign manager for his father, then as an assistant district attorney in New York City before entering private law practice. As with most recall efforts, the recall of a governor often begins when an individual or group decides to take action because they are dissatisfied with a governor's job performance.

 

An application or another document must be filed with the appropriate state official to begin a recall effort. The state official determines the number of signatures needed to qualify for a recall election. Generally, the number of signatures to be obtained corresponds to a certain percentage of the votes cast during the last election for the office of governor.

 

Depending on when a recall effort begins, the time frame to obtain the needed signatures varies. Once the required signatures are obtained and submitted, the signatures must be verified. In some states, a certain percentage of signatures must be obtained from individuals who voted in the last election and now want to see the governor removed from office.

 

20 states allow for gubernatorial recall. Some states, such as Louisiana and Michigan, provide for the recall of any elected public officeholder, with the exception of judges of courts of record, in their state constitutions.[1] Some states only allow a recall vote to proceed for specific grounds. For instance, the Kansas Constitution allows the recall of local and state officials in an elected office, with the exception of judicial officers. However, the grounds for a recall are: conviction of a felony, misconduct in office or failure to perform duties as prescribed by law.[1]

New York State Assemblyman Ron Kim - who said Gov. Andrew cuomo threatened to ruin his career for speaking out against his mishandling of the nursing home crisis during the coronavirus pandemic - is now calling for cuomo to face impeachment.

 

"cuomo abused his powers to hide life and death information from the Department of Justice that prevented lawmakers from legislating - like fully repealing corporate immunity for nursing homes. That is an impeachable offense," Kim wrote on Twitter on Monday.

 

"The only way to protect the integrity of the co-equal branch of the state government, AKA the 'People's House,' is to start impeachment," he wrote in another tweet.

 

The New York State Assembly can vote to impeach a governor by a simple majority, sending the case to the State Senate for trial. Unlike the U.S. Constitution, New York's state Constitution does not include specific guardrails to define impeachable conduct, according to PIX11.

 

Kim, a Democrat who is also the chair of the state's Standing Committee on Aging, previously accused cuomo of "abusing his power" by trying to pressure lawmakers into backing admissions by his top aide that the administration purposely withheld data on nursing home deaths from Justice Department investigators.

How the Gates Foundation Seeded America’s COVID-19 Policy Catastrophes

 

New York Governor Andrew Cuomo is finally facing the heat for his botched and negligent coronavirus response policies, yet no one seems to be asking why Cuomo and select governors made the fateful decisions that led to the excess deaths — and the coverup campaigns — of tens of thousands of senior citizens in New York and elsewhere across the United States.

 

After being awarded an Emmy and writing a book on his supposedly heroic response to the pandemic, Cuomo is finally receiving the very necessary inquiries into his handling of the crisis. Cuomo is perhaps the most egregious example of abuse and neglect (given his refusal to use the Javits Center or a Navy hospital ship), he is far from the only governor who executed the “nursing home death warrants.” Governor Cuomo was accompanied by the governors of California, New Jersey, Pennsylvania, Michigan, and elsewhere.

 

The common thread seen in the United States is the delegation of state policy to prediction modeling forecasts from the Institute for Health Metrics and Evaluation (IHME), a Washington State-based institution that is wholly controlled and funded (to the tune of hundreds of millions of dollars) by The Bill and Melinda Gates Foundation.

 

In March and early April, politicians were informed by the modeling “experts” at Gates-funded IHME that their hospitals were about to be completely overrun by coronavirus patients. Modelers from IHME claimed this massive surge would cause hospitals to run out of lifesaving equipment in a matter of days, not weeks or months. Time was of the essence, and now was the time for rapid decision making, the modelers claimed.

On two separate April 1 and April 2 press conferences, Cuomo made clear that his policy decisions were based off of the IHME model.

 

“There is a group that is funded by the Gates Foundation. Thank you very much Bill Gates,” Cuomo said on April 1 in discussing ICU needs and how he was using Gates models to make other healthcare policy decisions.

“There’s only one model that we look at that has the number of projected deaths which is the IHME model which is funded by the Gates Foundation,” Cuomo said on April 2, adding, “and we thank the Gates Foundation for the national service that they’ve done.”

 

In an April 9 briefing, Michigan Governor Gretchen Whitmer referred to the IHME model in order to project deaths and the PPE resources needed for the supposed surge.

 

It was the same story with the government of Pennsylvania. The PA Health Department exclusively uses IHME models to forecast coronavirus outcomes.

 

Governor Phil Murphy, another nursing home death warrant participant, used IHME models to navigate the state’s policy response.

 

It wasn’t just state governors relying on this data, federal bureaucrats Dr. Anthony Fauci and Dr. Deborah Birx, both of whom have substantial ties to the Gates network, used the IHME COVID-19 forecasting models (which Birx endorsed specifically as the best prediction modeling outfit) to make policy recommendations to states. In her White House briefings, Birx, who simultaneously had a seat on the board of a Gates-funded institution, almost exclusively relied on IHME models to project outcomes.

Legal experts are warning that New York Gov. Andrew Cuomo’s alleged undercounting of nursing-home deaths amid the COVID-19 pandemic may rise to the level of a criminal offense.

 

Cuomo has found himself at the center of a federal investigation into whether his administration sought to hide the true toll of the pandemic.

 

The New York Post reported earlier this month that Melissa DeRosa, Cuomo’s top aide, told lawmakers the administration had withheld the numbers for fear of them being "used against us."

Gov. Andrew Cuomo’s top aide privately apologized to Democratic lawmakers for withholding the state’s nursing home death toll from COVID-19 — telling them “we froze” out of fear that the true numbers would “be used against us” by federal prosecutors, The Post has learned.

 

The stunning admission of a coverup was made by secretary to the governor Melissa DeRosa during a video conference call with state Democratic leaders in which she said the Cuomo administration had rebuffed a legislative request for the tally in August because “right around the same time, [then-President Donald Trump] turns this into a giant political football,” according to an audio recording of the two-hour-plus meeting.

 

“He starts tweeting that we killed everyone in nursing homes,” DeRosa said. “He starts going after [New Jersey Gov. Phil] Murphy, starts going after [California Gov. Gavin] Newsom, starts going after [Michigan Gov.] Gretchen Whitmer.”

 

In addition to attacking Cuomo’s fellow Democratic governors, DeRosa said, Trump “directs the Department of Justice to do an investigation into us.”

 

“And basically, we froze,” she told the lawmakers on the call.

 

“Because then we were in a position where we weren’t sure if what we were going to give to the Department of Justice, or what we give to you guys, what we start saying, was going to be used against us while we weren’t sure if there was going to be an investigation.”

 

DeRosa added: “That played a very large role into this.”

 

After dropping the bombshell, DeRosa asked for “a little bit of appreciation of the context” and offered what appears to be the Cuomo administration’s first apology for its handling of nursing homes amid the pandemic.

 

But instead of a mea culpa to the grieving family members of more than 13,000 dead seniors or the critics who say the Health Department spread COVID-19 in the care facilities with a March 25 state Health Department directive that nursing homes admit infected patients, DeRosa tried to make amends with the fellow Democrats for the political inconvenience it caused them.

 

“So we do apologize,” she said. “I do understand the position that you were put in. I know that it is not fair. It was not our intention to put you in that political position with the Republicans.”

 

Assembly Health Committee Chairman Richard Gottfried (D-Manhattan) immediately rejected DeRosa’s expression of remorse, according to the recording.

 

“I don’t have enough time today to explain all the reasons why I don’t give that any credit at all,” said Gottfried, one of the lawmakers who demanded the death-toll data in August.

 

State Senate Aging Committee Chairwoman Rachel May (D-Syracuse) — who was battered during her re-election bid last year over the issue of nursing home deaths — also ripped into DeRosa, saying her former opponent had launched another broadside earlier in the day.

 

“And the issue for me, the biggest issue of all is feeling like I needed to defend — or at least not attack — an administration that was appearing to be covering something up,” she said.

 

“And in a, in a pandemic, when you want the public to trust the public health officials, and there is this clear feeling that they’re not coming, being forthcoming with you, that is really hard and it remains difficult.”

Government memo crushes Cuomo’s defense in COVID nursing home scandal

 

Gov. Cuomo has repeatedly defended his administration’s directive for nursing homes to accept COVID-19 patients as the product of federal “guidance” — even though one of those government documents says only that infected seniors “can” be admitted to the facilities.

 

In contrast, the Health Department’s since-rescinded, March 25 memo left little wiggle room to prevent “medically stable” patients from being transferred out of hospitals to nursing homes.

 

“During this global health emergency, all NHs must comply with the expedited receipt of residents returning from hospitals to NHs,” the state directive said.

 

And if there was any doubt about what that meant, the following sentence was underlined: “No resident shall be denied re-admission or admission to the NH solely based on a confirmed or suspected diagnosis of COVID-19.”

 

But a March 13 memo from the US Center for Medicare and Medicaid Services — which the Health Department has cited as justification for its order — contains a Q&A on that very subject.

 

“When should a nursing home accept a resident who was diagnosed with COVID-19 from a hospital?” it says.

Cuomo takes gaslighting to shocking extremes

 

Somebody needs to tell Gov. Andrew Cuomo that when you are in a hole, it’s time to stop digging. Once again at his Emmy Award-winning press conference on Friday, Cuomo deflected and denied when faced with his mishandling of nursing homes and state data. He continued to blame something he calls a “void” in information. Friday there was even a picture of the void in his PowerPoint presentation. It looked like a black hole in space, and Cuomo looked like a shaken shell of a governor.

 

It’s almost sad how the mighty have fallen. The only void at work here is one of competent leadership. Cuomo refuses to answer straightforward questions about his own attorney general’s report showing he undercounted deaths. He also refuses to address an admission by his staff that the numbers were hidden on purpose. Cuomo may be living in a sci-fi fantasyland where he did nothing wrong and the Trump administration was out to get him, but increasingly other Democrats aren’t buying it.

New York Gov. Andrew Cuomo, under attack over allegations that his COVID-19 policy directly led to nursing home deaths his administration has been accused of covering up, is nearing the end of his political road, former Arkansas Republican Gov. Mike Huckabee said Friday.

 

"You know you’re in trouble when you’re Andrew Cuomo, a Democrat governor of New York, and you got AOC [Democratic Rep. Alexandria Ocasio-Cortez] and Alec Baldwin and members of your own party who smell the blood in the water and they’re coming after him," said Huckabee, according to Fox News.

Andrew Cuomo faces investigation into alleged sexual misconduct

 

 

New York Governor Andrew Cuomo is facing allegations that he was sexually inappropriate toward three women. Harassment allegations from two women, former aides to Cuomo, led New York Attorney General Letitia James to launch an investigation.

 

James said Monday she received a formal referral from Cuomo's office, granting her the ability to choose an investigator to look into the allegations.

 

"This is not a responsibility we take lightly as allegations of sexual harassment should always be taken seriously," James said in a statement, adding that the findings of the investigation would be made public after its completion.

 

"All members of the Governor's office will cooperate fully. We will have no further comment until the report is issued," said Beth Garvey, special counsel and senior advisor to Cuomo.

 

Late Monday, Anna Ruch accused the governor of putting his hand on her lower back, then placing his hands on her cheeks and asking if he could kiss her at a wedding reception in September 2019. Ruch detailed her allegations to the New York Times. Ruch is the third woman to accuse Cuomo of sexual misconduct, and is the only one to come forward who was not employed by the governor.

 

Charlotte Bennett, the second woman to accuse Cuomo of sexual harassment, said in a statement Monday that the governor has "refused to acknowledge or take responsibility for his predatory behavior." The 25-year-old former executive assistant to the governor claimed Cuomo asked if she was romantically involved, monogamous in her relationships and if she had ever had sex with older men.

 

Cuomo attempted to apologize in a statement Sunday.

 

"I now understand that my interactions may have been insensitive or too personal," he said. "Some of the things I have said have been misinterpreted as an unwanted flirtation. To the extent anyone felt that way, I am truly sorry."

 

New York City Mayor Bill de Blasio on Monday joined the growing number of voices supporting an independent investigation.

 

"He seemed to be saying, 'Oh I was just kidding around.' Sexual harassment isn't funny," de Blasio said.

 

The second accusation comes after another former aide, Lindsey Boylan, accused Cuomo in a blog post of sexually harassing her and creating a hostile work environment.

 

Alessandra Biaggi, a New York state senator who worked in the governor's office in 2017, called Cuomo's alleged actions "inappropriate" and "abusive."

 

"He's actually saying that he meant for those words to be playful. And there is no realm of playful. When a governor of a state asks a young staffer who is 25 years old if she has sex with older men or if she has sex outside of her relationship, that is not only inappropriate, it is abusive," she said.
