Wells Fargo Ex-CEO Settles SEC Claims, Former Community Bank Head Faces Fraud Case

Former Wells Fargo & Co. chief government John Stumpf agreed Friday to pay $2.5 million to settle civil claims over his role in the bank’s fake accounts scandal, whereas regulators sued one other former Wells government over fraud allegations.

Mr. Stumpf, who stepped down from his top post in 2016, neither admitted nor denied the Securities and Change Fee’s claims, which accused him of deceptive traders in regards to the success of Wells Fargo’s neighborhood banking enterprise. Mr. Stumpf was earlier barred from the banking industry and paid $17.5 million to settle claims from the Workplace of the Comptroller of the Foreign money.

Individually, the SEC sued former consumer-bank head Carrie L. Tolstedt, submitting a civil fraud case in opposition to her in San Francisco federal courtroom. The regulators mentioned Ms. Tolstedt publicly described and endorsed a key measure of Wells Fargo’s enterprise, the “cross-sell metric,” with out disclosing that it was inflated by unused and unauthorized accounts and companies.

The SEC’s lawsuit seeks a courtroom judgment ordering Ms. Tolstedt to pay fines and barring her from serving as an officer or director of a public firm. A lawyer for Mr. Stumpf declined to remark. An lawyer for Ms. Tolstedt wasn’t instantly accessible for remark. “If executives discuss a key efficiency metric to advertise their enterprise, they have to achieve this totally and precisely,” mentioned Stephanie Avakian, director of the SEC’s enforcement division. “The fee will proceed to carry accountable not solely the senior executives who make false and deceptive statements but in addition those that certify to the accuracy of deceptive statements regardless of warnings on the contrary.”

Wells Fargo agreed in February to pay $3 billion to settle civil and criminal investigations into its long-running pretend accounts scandal, closing the door on a significant portion of the authorized issues that for years have beset one of many nation’s largest banks.

Coronavirus cases in Japan hit new highs

A record 1,705 new coronavirus cases were reported in Japan on Friday, surpassing the previous high set on Thursday. The prime minister is calling for renewed vigilance. Experts say the country is experiencing a third wave of infections. In total, there have been more than 116,000 since the outbreak began. Nearly 1,900 people have died.

Tokyo remains the largest hot spot. New cases in the capital have surpassed 300 for three straight days. Medical workers are concerned about the rising number of patients. Doctors at a Tokyo hospital accepting the seriously ill say they're reaching capacity.

One said, "It may be necessary to increase the number of beds because they have been almost full since last week." The northernmost prefecture of Hokkaido is another hot spot. More than 200 new cases were reported on Friday. Multiple clusters have been detected in a nightlife district in Sapporo. Authorities are asking restaurants and bars in the area to shorten their business hours.

Hokkaido Governor Suzuki Naomichi said, "The situation is still very severe as we try to strike a balance between social and economic activities and preventing infections from spreading."

Also on Friday, officials said more than 130 people who made use of a domestic travel campaign launched by the central government had tested positive for the virus. The campaign aims to boost the tourism industry, which has been hit hard by the pandemic. But questions are being raised about whether it should continue. Prime Minister Suga Yoshihide said, "I acknowledge that experts also have the view that there is no need to declare a state of emergency or review the travel campaign at the moment."

Suga is urging people to take basic anti-infection measures, especially in risky situations, such as group meals.

S&P 500 ends at record as stocks rally amid vaccine hopes

DJIA +1.37% SPX +1.36% NAS +1.02%

Stocks scored gains Friday, with the S&P 500 closing at a record as investors cheered progress toward a COVID-19 vaccine, while seeming to look past a continued rise in new cases of the ilness. The Dow Jones Industrial Average DJIA, 1.37% rose around 399 points, or 1.4%, to close near 29,480, according to preliminary figures, while the S&P 500 SPX, 1.36% gained around 48 points, or 1.4%, to finish near 3,585, topping its previous record close of 29,551.42 from Sept. 2. The Nasdaq Composite rose around 120 points, or 1%, to finish near 11,829. Stocks were on the rise this week after Pfizer Inc. PFE, +2.87% and BioNTech SE BNTX, +4.30% on Monday announced their COVID-19 vaccine candidate was more than 90% effective in preventing the disease in a trial. The news sparked a rotation away from high-flying tech and internet shares that were seen as beneficiaries of the pandemic into cyclical and small-cap shares that were left behind by 2020's stock-market gains. The tech-heavy Nasdaq saw weekly fall of 0.6%, while the more cyclically oriented Dow rose 4.1%. The S&P 500 saw a gain of 2.2%. The Russell 2000, meanwhile, rose around 2.1%.

After a volatile trading week where the market was whipsawed between hopes and fears around the virus, Cisco Systems Inc CSCO.O provided the biggest boost to the S&P 500 after its quarterly report showed a work-from-home driven surge in demand. Walt Disney Co DIS.N also rose as its rapidly growing streaming video business, and a partial recovery at its theme parks tempered its quarterly loss. Positive data from Pfizer's PFE.N vaccine study earlier this week had prompted a rotation into the cyclical sectors, boosting the S&P 500 .SPX and Dow .DJI.

The tech-heavy Nasdaq .IXIC, however, underperformed as investors booked profits in technology stocks, which have benefited from a stay-at-home environment. Globalt's Martin also pointed to hopes for news of more coronavirus vaccine progress, after Moderna Inc MRNA.O said earlier this week that it had enough data for a first interim analysis of its late-stage trial. With third-quarter reports released from about 90% of S&P 500 companies Refinitiv IBES estimates now show profits falling 7.8% from last year compared with an Oct. 1 expectation for a 21.4% slump.

Pompeo congratulates a tiny Caribbean country on its election while refusing to recognize Biden as the winner in the world's oldest democracy

Secretary of State Mike Pompeo has been addressing election results in other countries, even as he refuses to recognize President-elect Joe Biden as the winner of the 2020 US presidential election.

Pompeo on Friday congratulated Prime Minister Ralph Gonsalves on his reelection in St. Vincent and the Grenadines.

"We commend the people of St. Vincent and the Grenadines for their free and fair elections, and we congratulate Prime Minister Ralph Gonsalves on his reelection. Looking forward to our continued work together to create a safer, more prosperous Caribbean region," Pompeo tweeted.

Though America's top diplomat has congratulated the small Caribbean country on its "free and fair elections," he's not extended the same praise to the US — what is technically the world's oldest democracy.

Meet the U.S. Air Force’s Commando Test Plane

The twin-engined Dornier 328–100 — nicknamed the “Cougar” — looks plain on the outside, but is full of sophisticated hardware on the inside.

It’s the Air Force’s special commando test aircraft, and it’s where engineers test sensors, weapons and other gear meant for gunships, spy planes and other aircraft.

The Cougar is set up to be modular, so almost anything can be inserted into various internal bays and fixed pods, or strapped onto the fuselage using various mounting points. In May 2015, U.S. Air Force Col. Eric Forsyth described the plane’s internal details at the Special Operations Forces Industry Conference in Tampa, Florida. Those details include:

  • Two external sponsons (750 lbs max)

  • Modular fuselage antenna bays (1 top / 2 bottom)

  • Ku-Band BLOS [beyond line of sight] satellite data link system

  • Nose available for antenna/sensor mount

  • Two reconfigurable operator workstations

With jacks for power, Ethernet, GPS and other linkages, engineers can easily install all sorts of gear. These systems would potentially be able to run long-range radars, powerful cameras, high-powered radios, laser range finders and more. The Cougar can carry all of these equipment up to an altitude of more than 30,000 feet. The plane itself can fly more than 1,000 miles at a speed of nearly 400 miles per hour. In 2014, the Air Force bought the plane from Nevada-based aerospace contractor Sierra Nevada Corporation. The ultra-secretive 645th Aerospace Systems Group — more commonly known by its nickname Big Safari — currently owns the Cougar.
