Judge denies California’s attempt to intervene in Activision Blizzard settlement
The consent decree and the $18 million victim fund will remain as is for now

Today in federal court, a judge said she will deny the state of California’s attempt to intervene in the $18 million settlement between Activision Blizzard and the EEOC, according to a report from Bloomberg.
The denial prevents the California Department of Fair Employment and Housing from joining the EEOC’s lawsuit against Activision Blizzard in order to oppose the consent decree that accompanies the creation of an $18 million settlement fund. The DFEH filed the objection in October, stating that the consent decree would harm the state’s case against Activision Blizzard, asserting the decree could, among other adverse outcomes, potentially allow for the destruction of evidence necessary to the state’s case or release the company from state claims.
The EEOC and the DFEH have been at odds over their respective cases against Activision Blizzard. In October, Activision Blizzard filed a stay against the DFEH lawsuit claiming some of the lawyers involved in the state’s case should be disqualified based on conflict of interest rules. Activision Blizzard filed this stay after the EEOC brought this conflict of interest information to its attention, which was notably after the DFEH objected to the EEOC’s consent decree and settlement. In Bloomberg’s report, the judge brought up this spat between the two public offices, calling it “unseemly.”

Though the DFEH will not be allowed to object to the consent decree, that doesn’t mean the judge will allow the $18 million price tag to remain. In a press conference last week, celebrity lawyer Lisa Bloom, on behalf of one of Activision Blizzard’s victims, said the settlement was “woefully inadequate” and asked for an increased fund of at least $100 million.
The EEOC and Activision Blizzard will submit clarifications on the consent decree to the court in January. The state of California will have the opportunity to submit comments, and a formal ruling on the decree should come soon after.

Billionaire investor and philanthropist George Soros has invested $45 million USD into Activision Blizzard.
Reclaim the Net (citing Fintel) reports that Soros has purchased 758,000 shares for $45 million USD. Fintel states this occurred on February 14th.
Soros has been accused by some of using his fortune to manipulate international politics and economics. Soros is the founder of Open Society Foundations, and has also funded many efforts and organizations some deem to be liberal, Marxist, politically left, or globalist ideals.
These include accusations of aiding migrant and refugee caravans from Africa and the Middle East, supporting the US Democratic party during the 2016 US Presidential election, supporting pro-European Union efforts during the United Kingdom’s Brexit debates and elections, and supporting internet censorship under the guise of fighting hate speech.
Soros has also been accused of organizing protesters- such as those against the US Supreme Court nomination of Brett Kavanaugh, and the extreme right-wing and white nationalist protesters during the Unite the Right rally.
These claims have been rejected by the mainstream media, claiming they are right-wing conspiracy theories- with some based around antisemitism. [1, 2, 3, 4, 5, 6, 7, 8]. None of the accusations levied at Soros have resulted in legal charges or prosecution.
While the accusations levied against Activision Blizzard are more solid, they are still damning. Subsidiary Blizzard Entertainment has had nothing but bad PR over the last few months.
In January 2020, Warcraft III: Reforged‘s launch was nothing short of a disaster. Complaints arose within 24 hours of the game’s launch, and fans (who had their original copies of Warcraft 3 forcibly upgraded) campaigned to make the game the lowest-rated on Metacritic.
In October 2019, Blizzard had been denounced by many gamers over their suspension of pro-Hearthstone player Blitzchung for his support of the Hong Kong protests, firing the casters, and their overall handing of the entire debacle. Even US Senators wrote to Activision Blizzard CEO Bobby Kotick, condemning the decision.
As Reclaim the Net points out however, the disasters have not had any ill effect on Activision Blizzard’s stock price. According to Market Watch, Activision Blizzard (ATVI) was worth $51.95 USD per share. As of this time of writing, it is worth $60.71 USD per share.

Activision Blizzard Is Sued by California Over Workplace Culture
The lawsuit says women at the gaming company were paid less and discriminated against, and it described a culture of sexual harassment.

A California state agency is suing Activision Blizzard, the video game maker that produces Call of Duty, over claims of sexual harassment and discrimination.
After a two-year investigation, the state’s Department of Fair Employment and Housing said in a lawsuit filed Tuesday in Los Angeles Superior Court that Activision fostered a “‘frat boy’ workplace culture.” Executives sexually harassed women, the agency said, and male employees openly joked about rape and drank alcohol while engaging in “inappropriate behavior” toward women at their cubicles during events known as “cube crawls.”
The lawsuit added that women were routinely paid less than men for similar work and were less likely to be promoted.
Activision’s workplace “is a breeding ground for harassment and discrimination against women,” the agency wrote. “Female employees are subjected to constant sexual harassment, including having to continually fend off unwanted sexual comments and advances by their male co-workers and supervisors and being groped at the ‘cube crawls’ and other company events.”
In one case, the lawsuit said, a female employee died by suicide during a business trip, as a result of her sexual relationship with her male supervisor. Before her death, male colleagues allegedly shared explicit photos of the woman, the lawsuit said.
The lawsuit, which was reported earlier by Bloomberg Law, said the company’s executives and human resources department failed to address misconduct when they were informed of it.
In a statement, Activision said the “picture D.F.E.H. paints is not the Blizzard workplace of today,” adding that the company tries to pay employees fairly and has worked to address its culture and improve diversity in recent years. Activision employees for years have undergone anti-harassment training, and the company said it had created a confidential reporting hotline and team that investigates employee concerns, among other changes.
“There is no place in our company or industry, or any industry, for sexual misconduct or harassment of any kind,” Activision wrote. “In cases related to misconduct, action was taken to address the issue.”
The company said California had failed to properly discuss the accusations with Activision before suing, and it chided the agency in particular for bringing up the employee suicide.
“It is this type of irresponsible behavior from unaccountable state bureaucrats that are driving many of the state’s best businesses out of California,” Activision wrote.
The state employment agency declined to comment. It said in the lawsuit that it wanted Activision to compensate employees for unpaid wages, provide further recompense and pay punitive damages.
Activision, which is based in Santa Monica, Calif., and is worth about $70 billion, has nearly 10,000 employees. The company has faced criticism from its workers over wage disparities, especially as shareholders narrowly approved a $155 million pay package for the chief executive, Bobby Kotick, in June, making him one of the country’s highest-paid top executives.
Accusations of sexual harassment and discrimination are far from uncommon in the gaming industry, where game studios’ work forces, especially at the executive level, remain predominantly white and male. Last summer, dozens of women spoke out against such behavior, accusing people at various companies of misconduct — including at Activision and the French publisher Ubisoft — and prompting more calls for reform. The fair employment agency has also pursued legal action against Riot Games, the League of Legends game maker, accusing it of sex discrimination and sexual harassment.
