FAA is authorized to make regulations and their opinion as to whether taking down a UAS carries a lot of weight with the courts, since courts don't routinely handle air traffic controller duties (which, if you think about it, is pretty darn vital to get right). Fed courts pay attention to stuff like that.

 

That law hasn't been tested in Federal courts yet, but most are left to the states to prosecute. Here's a very good listing of drone cases. The criminal cases are towards the bottom.

Judges make law every day. Why do you think we're trying to get some of them out?

 

And they darn sure DU interpret laws, that is exactly their job. They interpret everything from evidentiary rulings to arguments about civ/crim procedure to whether the death penalty applies. That's why appellate courts exist, to review whether they interpreted the law properly.

 

If judges just willy-nilly "if this, then that" applied the law, we might as well have computers on the bench. And since things frequently don't fit existing case law exactly, some judgment (i.e. JUDGE-MENT) has to be made.

Yeah, ok. I'm sure you'd feel the exact same way if you were in a criminal trial and a judge determined that exculpatory evidence would not be admissible under a hearsay exception that "arguably" might not apply....

 

But what the heck? It's just "refereeing" the case, not actually interpreting law...

 

I can show you about 1000 cases per year where judges are interpreting evidentiary laws alone, as well as procedural.

 

And, since you're probably not aware of this, juries have to be told what laws they are applying in what is called a jury charge. That is where they are given instructions on the applicable law. Who decides what instructions should/shouldn't be given?

Entirely no disagreement on getting rid of activist judges.

 

It is properly the judge's job to apply equity in extreme cases (which is to make a decision to do right and find a narrow exception to a law, when the application of that law is so unfair that it does injustice in itself).

 

That's the difference between law and equity. Equity should be VERY RARELY applied, though.

 

But when you give a person the power to make decisions over others, I have found very few situations in which the people with power will restrain themselves from playing favorites, unfortunately.

Sometimes it's the judge's best good faith effort to try and get it right. People are human and make mistakes.

 

Sometimes it's a question of highest bidder, but most judges avoid outright briberty.

 

Quite frequently, the issue is qui bono.

These don't look like USGI-quality UGS (Unmanned Ground Sensors) and they aren't particularly well camouflaged, so I question whether it's a recent install or a sign of pilfering.

 

However, I DID post a couple times lately before this last video drop from Rusty that it would be nice to see some evidence that our Froggish Frens from SOCOM had paid a visit to the place...

 

And this sorta looks like that kind of handiwork.
