Most anons might not remember this, but the reason the individual mandate was passed with Obamacare was because Congress doesn't have the power to force you to pay for insurance. The debate over the penalty was whether it was a fine or a tax. After days of this very specific question being asked very specifically of the Obamacare folks directly from John Robert's mouth, he quite literally explained to the proponents that if they were to change the wording to say tax instead of a penalty/fine, then it'd be a 100% legal thing to pass.
Roberts quite literally coached the group wanting Obamacare to pass by giving them the answer. On the last day of review, the group presented it as a tax, and Roberts reached for the gavel shortly after that.
