When will they ever learn? Ninth Circuit Judge Alex Kozinski declared months ago in a much-quoted opinion that there is “an epidemic of Brady violations abroad in the land.” And yet, prosecutors continue to deny there’s a problem. Indeed, the Department of Justice gets outright indignant at the suggestion, and so do many state court prosecutors. They bristle at the very mention of the possibility. But here’s another doozy: The People (of California) v. Efrain Velasco-Palacios. In this unpublished opinion from the Fifth Appellate District, the California Court of Appeal reveals that state prosecutors and California Attorney General Kamala Harris continue to be part of the problem. Kern County prosecutor Robert Murray committed “outrageous government misconduct.” Ms. Harris and her staff defended the indefensible—California State prosecutor Murray flat out falsified a transcript of a defendant’s confession. Kern County prosecutor Robert Murray added two lines of transcript to “evidence” that the defendant confessed to an even more egregious offense than that with which he had been charged—the already hideous offense of molesting a child. With the two sentences that state’s attorney Murray perjuriously added, Murray was able to threaten charges that carried a term of life in prison. Capitalizing to the maximum on his outright fabrication, state’s attorney Robert Murray committed his own crime against the defendant at the crucial time when defense counsel was consulting with the defendant on a possible plea.

 

Prosecutor Murray had ample time and opportunity to correct his lies and his falsification of the transcript, but instead, he let it go until defense counsel had encouraged his client to plead guilty based on this fabricated evidence. Not until after defense counsel requested the original tape recording from which the transcript was made did Mr. Murray admit that he had added the most incriminating statements to the transcript. When confronted with the defense’s motion to dismiss the indictment for outrageous prosecutorial misconduct, Mr. Murray claimed his own false alteration of the transcript was “in jest,” a “joke” between two lawyers, and harmless to the defendant. Mr. Murray lobbed in another little bombshell for good measure, swearing that defense counsel had said that the defendant’s defense was “not viable.” Mr. Murray’s actions caused the disqualification of defense counsel, and as one might expect, the defendant did not feel that he could trust his own attorney. Defense counsel had to testify at the hearing, the attorney-client privilege was affected, and new counsel had to be named. California Judge H.A. Staley got it right. He found that Mr. Murray’s fabrication of “evidence”—falsifying the transcript of a confession during discovery and plea negotiations—was “egregious, outrageous, and . . . shocked the conscience.” The trial judge saw no laughing matter—and neither should the rest of us. He dismissed the indictment completely, and in a scathing opinion, also quoted by the appellate court, wrote that the prosecutor’s actions “diluted the protections accompanying the right to counsel and ran the risk of fraudulently inducing defendant to enter a plea and forfeit his right to a jury trial.” The court refused to “tolerate such outrageous conduct that results in the depravation of basic fundamental constitutional rights that are designed to provide basic fairness.”

 

Undaunted by the criminal conduct of a state prosecutor, or the district court’s opinion, Ms. Harris appealed the decision dismissing the indictment. According to the California attorney general, only abject physical brutality would warrant a finding of prosecutorial misconduct and the dismissal of an indictment. Fortunately for all of us—and the Constitution—she lost again. This is Ms. Harris’ third strike in hardly as many months—and those are only the ones that have come to our attention.

Massive 20GB Leak From Intel Documents Backdoors In All Intel CPUs

 

Classified and confidential documents from U.S. chipmaker Intel, allegedly resulting from a breach, have been uploaded earlier today to a public file sharing service. The cache of secret information is 20GB large and comes from an unknown source. It was announced as the first part in a series of Intel leaks. According to Tillie Kottmann, a developer and reverse engineer who received the documents from an anonymous hacker, most of the information is supposed to be protected intellectual property. The developer was told that the information was stolen from Intel in a breach this year. "They were given to me by an Anonymous Source who breached them earlier this year, more details about this will be published soon," Kottmann says. “Most of the things here have NOT been published ANYWHERE before and are classified as confidential, under NDA or Intel Restricted Secret,” the developer added.

 

Those browsing firmware source code will find comments referring to backdoors, but that could mean anything and does not necessarily mean they can gain access to your computer: An Intel spokesperson replying to our request for comments pointed us to the company’s product security policy page, which states that "Intel product development policy and practices prohibit any intentional steps to allow undocumented device access (e.g., “backdoors”), exposure of sensitive device information, or a bypass of security features or restrictions of its products." Some of the files in the archive include technical specifications and relate to internal chipset design, including Kaby Lake platform and Intel Management Engine (ME).

Republican Drops Out Of Race For Congressional Seat The Day After His Arrest

 

A Republican running for Congress in Connecticut on Tuesday dropped out of the race after he was arrested for allegedly beating up a former girlfriend. Thomas Gilmer was arrested Monday night, according to the Hartford Courant. Gilmer was reportedly charged with first-degree unlawful restraint and second-degree strangulation. He was released after posting a $5,000 bond and then dropped out of the election.

 

The incident was reportedly a violent altercation with a former girlfriend that police had been investigating the incident since July 22. In a statement, Gilmer said: “I cannot in good conscience move forward in this campaign while I am simultaneously forced to clear my name. And clear my name I will,” The Hill reported. “While I must withdraw my name from the ballot at this time, I trust that our fight against Joe Courtney’s radical agenda will live on in each one of you,’’ Gilmer continued. “But ultimately, our movement — built on the tenets of good, old-fashioned Yankee conservatism — is too important to be sidetracked by the allegations facing me — allegations which I intend to fight.” Gilmer was running in the 2nd Congressional District, a solidly blue district that Democratic Rep. Joe Courtney has held since 2007.

Kamala Harris Isn’t African-American. She’s Ethnically Indian and Jamaican. That’s Not The Same Thing.

 

Joe Biden recently implied blacks in America are a monolith. Now, by calling his Vice Presidential pick Kamala Harris “African-American,” the media is endorsing his racist position that all blacks are the same.

 

While the media will continue to portray Harris as African-American, it’s important to note her mother was from India, and her father from Jamaica. That’s not typically what people think of when they say “African-American”. I’m Indian, for example, and I don’t go around pretending to be black. Political activist Ali Alexander — of half African extraction himself — noted the matter over a year ago, tweeting: “Kamala Harris is not an American Black. She is half Indian and half Jamaican. I’m so sick of people robbing American Blacks (like myself) of our history. It’s disgusting.” He was met with derision from white liberal reporters in the establishment media, who demanded there was no difference. The fact the Democrats would select an Indian-Jamaican candidate and bill them as African-American in year marred by Black Lives Matter riots would usually be unthinkable.

 

Then you remember they continuously call men who identify as women, “women,” and allow them to compete in women’s sports. Of course this short post is going to send the media into a tailspin as they attempt to defend Harris and steer Biden toward the White House. They’ll call this important distinction a “racial attack,” on Harris, as they have on the past. Even though the writer of this article shares an ethnic background with Harris: Indian. But don’t take my word for it. Kamala Harris’s own father has lashed out about her race-grifting, telling a Canadian magazine in 2019: My dear departed grandmothers, as well as my deceased parents, must be turning in their grave right now to see their family’s name, reputation and proud Jamaican identity being connected, in any way, jokingly or not with the fraudulent stereotype of a pot-smoking joy seeker and in the pursuit of identity politics. Speaking for myself and my immediate Jamaican family, we wish to categorically dissociate ourselves from this travesty.

 

And I suspect there will be a large number of African-Americans across the United States who aren’t happy with their ethnicity or race being co-opted to suit a political candidate who shares little with them. The same for the Native Americans who weren’t so hot on Elizabeth Warren prancing around pretending to be one of them, in order to further her career. The truth many are learning, and that many already knew, is that the left does in fact class all immigrants as one group, and they ruthlessly attack ethnic minorities who deviate from the liberal plantation. I should know, I’ve been one of them. Early on in my career I was told by a left-wing activist in the United Kingdom that I couldn’t be a conservative because I was brown. “You’re one of us,” he said. Or words to that effect. He later apologized, but the cat was out of the bag. Kamala Harris needs to clarify, or go down as a race-grifter. She can’t run as an “African-American.” And the Trump campaign should not let the Democrats get away with co-opting race in this shameful way.

Not so sure about that given her track record, she was responsible for the highest level of incarcerations in CA over her tenure and the African American population was not happy about that. Which is probably why her campaign failed so dismally in the first place.
