I am having to get an attorney just to get through the process and access money I paid into the system.

It is always sound to lower your interest rate. The rate of interest on a debt is equivelent on a 1yr loan as it is on a 100 year loan. It's up to YOU to pay it back in a certain amount of time, that's why dollars to cents, it's always more responsible to take the longest term mortgage given identical interest rates. You're essentially taking access, when needed, to a 2.3% loan (say you have a touch month and you're paying 300 dollars over the minimum required, you can "borrow" that 300 dollars at will by not paying over that month)

if you have any credit cards with a high rate, defer what you can to them before paying into your home. Once they are paid, then pay over on the mortgage.
Dropping the rate by 1% is worth it considering your loan balance won't be going up. Like I said, it's a 2.3% loan anytime you need access to it, so if you don't have credit card debt or a car note, by all means, pay it down asap.
The lower payment / Longer term has many benefits. Used to be the 15yr bond traded significantly lower than the 30yr, but since those days are behind us, just take the 30 and manage your money better. Lay out all your bills and see what is the highest rate of interest, pay that off fastest/first, then move to the next, next, next…
