CNN star legal analyst Jeffrey Toobin was suspended by one of his employers, The New Yorker, on Monday amid claims he was caught masturbating during a Zoom call with colleagues. While the prestigious magazine took action, another Toobin employer, CNN, instead issued a statement claiming he just wanted some time off.

 

"Jeff Toobin has asked for some time off while he deals with a personal issue, which we have granted,” a CNN spokesperson told multiple outlets after ignoring Fox News.

Vice initially reported on Monday that the magazine was investigating an incident where the legal pundit exposed himself to members of the New Yorker and WNYC radio staffs during a Zoom call last week.

 

"Jeffrey Toobin has been suspended while we investigate the matter,” a spokesperson for the New Yorker confirmed to Fox News.

 

Later in the day, Vice updated its story with the salacious detail that CNN’s top legal pundit was masturbating. But CNN’s story didn’t change. By 9 p.m. ET – hours after Vice changed its headline to, “New Yorker Suspends Jeffrey Toobin for Masturbating on Zoom Call,” CNN’s story had the same initial statement that the legal analyst simply needed to deal with a personal issue.

 

CNN did not immediately respond to a series of questions from Fox News, including if CNN will investigate now that the masturbating report is out there. CNN was also asked if Toobin will be allowed to participate in Election Night coverage if he’s finished tending to his personal issue by Nov. 3.

CNN’s website downplayed the story, chalking the whole thing up to an accident during a “pivotal moment” as the election looms.

 

“Jeffrey Toobin, CNN's chief legal analyst and a renowned reporter for The New Yorker, has been sidelined at a pivotal moment in the run-up to the presidential election,” CNN’s Brian Stelter and Oliver Darcy wrote. “The reason: He exposed himself during a Zoom call with colleagues in what he says was an accident.”

 

The incident happened during a Zoom meeting, which was described as an "election simulation," featured Toobin's New Yorker colleagues including Jane Mayer, Masha Gessen, Andrew Marantz, Jelani Cobb, Evan Osnos, Sue Halpern, and Dexter Filkins playing various roles in potential 2020 outcomes including President Trump, Joe Biden, "establishment Republicans," 'establishment Democrats," and "the military." Toobin was playing "the courts."

 

According to two sources, Toobin was seen masturbating in what was supposed to be a 10-minute "strategy session" along party lines, but that it "seemed like Toobin was on a second video call."

 

The allegations against Toobin are the type of thing that would often result in an outside, independent investigation. It’s unclear if CNN will enlist an outside firm to probe the claims against Toobin.

 

Prior to the reported masturbation, Toobin, one of CNN's biggest stars, offered an apology for his "embarrassingly stupid mistake" and attempted to explain what led to the incident.

 

“I made an embarrassingly stupid mistake, believing I was off-camera. I apologize to my wife, family, friends and co-workers," Toobin said in a statement to Motherboard. “I believed I was not visible on Zoom. I thought no one on the Zoom call could see me. I thought I had muted the Zoom video."

Author-commentator Jeffrey Toobin has been suspended by the New Yorker and is temporarily stepping away from his job as CNN's senior legal analyst pending what the cable network is calling a "personal matter." Vice reported earlier Monday that Toobin had exposed himself during a Zoom meeting with staffers of the New Yorker and WNYC radio.

In a statement Monday afternoon, the New Yorker said Toobin had been "suspended while we investigate the matter." It declined further comment. A CNN spokesperson said in a statement that "Jeff Toobin has asked for some time off while he deals with a personal issue, which we have granted."

Toobin told Vice that he "made an embarrassingly stupid mistake, believing I was off-camera," adding, "I apologize to my wife, family, friends and co-workers."

The 60-year-old has been a New Yorker writer for more than 20 years and joined CNN in 2002. He is the author of several books, most recently "True Crimes and Misdemeanors: The Investigation of Donald Trump," published in August. His other works include "The Run of His Life: The People v. O. J. Simpson" and "The Nine: Inside the Secret World of the Supreme Court."

LOS ANGELES (CBSLA) — Jeff Bridges announced Monday evening he has been diagnosed with lymphoma and is starting treatment.

 

The beloved actor took to Twitter saying, “As the Dude would say.. New S**T has come to light. I have been diagnosed with Lymphoma. Although it is a serious disease, I feel fortunate that I have a great team of doctors and the prognosis is good. I’m starting treatment and will keep you posted on my recovery.”

The Supreme Court Monday night allowed Pennsylvania election officials to count mail-in ballots received up to three days after Election Day, refusing a Republican request to stop a pandemic-related procedure approved by the state’s supreme court.

The court was tied, but that means a request to put the state’s court ruling on hold failed. The court’s four most conservative justices — Clarence Thomas, Samuel A. Alito Jr., Neil M. Gorsuch and Brett M. Kavanaugh — said they would have granted the stay.

 

But it takes five votes to issue a stay, and that means Chief Justice John G. Roberts Jr. sided with liberal Justices Stephen G. Breyer, Sonia Sotomayor and Elena Kagan.

 

Neither side explained the vote, which often is the case in emergency requests.

 

The order was the latest is a string of election procedure battles waged in the states between Democrats and Republicans. Previously the court sided with South Carolina Republicans and said most mail-in ballots there must contain a witness’s signature, something federal courts had said should be waived because of the coronavirus pandemic.

 

The litigation is often over seemingly arcane details, but ones that could make a difference in close races.

 

Pennsylvania has particular significance because it is crucial to President Trump’s reelection fortunes. He defeated Hillary Clinton there in 2016 by 44,000 votes, or less than 1 percent.

 

The Pennsylvania Supreme Court ruled in Democrats’ favor last month on a number of mail-voting rules: permitting voters to turn in ballots via drop box in addition to using the U.S. Postal Service; allowing ballots to be returned up to three days after Election Day; and blocking a Republican effort to allow partisan poll watchers to be stationed in counties where they do not live.

 

Pennsylvania’s Republican legislators and the state GOP asked the U.S. Supreme Court to weigh in only on the ruling pushing back the deadline for mail ballots to arrive. The state court said such ballots must be counted if they are postmarked by Nov. 3 — and even if no postmark is discernible “unless a preponderance of the evidence” shows that the ballots were mailed after Election Day.

 

“In a year where there is a very real possibility that the final presidential election result hinges on Pennsylvania, the new rules imposed by the decision of the Supreme Court of Pennsylvania (a body elected in partisan elections) could destroy the American public’s confidence in the electoral system as a whole,” said the stay request filed by the Republican leaders.

 

The state supreme court decision was based on a clause in the commonwealth’s constitution mandating that “all aspects of the electoral process in Pennsylvania be open and unrestricted so as not to disenfranchise Pennsylvania voters,” the state’s Democratic Attorney General Josh Shapiro said in defending the state court decision.

 

“The Pennsylvania Supreme Court’s decision protected that right and brought much needed clarity to the exigent circumstances surrounding a global pandemic,” Shapiro wrote. “In doing so, that court ensured that Pennsylvanians would not be forced to choose between exercising their right to vote and protecting their health.”

 

He rejected the claim of Republicans that the decision essentially extended the election beyond Election Day, and said it was a key aspect of federalism that states decide how to run their elections.

 

Pennsylvania lawmakers said the decision of its state court extends Election Day beyond what is called for in the Constitution and takes away the power of legislatures to set election rules. The changes are tied to challenges of the pandemic, they said, but “the Supreme Court of Pennsylvania’s own special master found that COVID-19 is not likely to disrupt the November General Election ballot receipt deadline.”

 

The cases are Scarnati v. Boockvar and Republican Party v. Boockvar.
