Alex Nitzberg reported yesterday, "Michigan Department of State spokesperson Jake Rollow in a statement said that an audit could only come after certification of results."

I found that odd and went to look for the actual legislation through Michigan Election Law, so far I found anything that specifically talks about 'audit' except for this section, 'Act 116 of 1954' that talks about 'recount'. "The final report on the results of any recount shall be open to public inspection immediately following its certification by the board of canvassers." I doubt 'public inspection' is the actual audit this spokes person referred to.

 

Another section in 'recount' that caught my eye, although I haven't found 'misconduct' described anywhere else in the Election Law, this section clearly states "…wilfully commit any act which shall interfere with a fair and impartial recount of the votes cast for a contested office, amendment or proposition shall be deemed guilty of a felony and subject to penalties thereof."

I will keep looking to find anything about an audit, if any anons out there are bored and want to go look, I would appreciate the help. It's a really big document in the first link.

There is this section dealing with counting and recounting being open to public access: "shall be public and the doors to the polling places and at least 1 door in the building housing the polling places and giving ready access to them shall not be locked during such canvass."

On the contrary,. Michigan Election Law clearly states in 168.803, 1(c) "Marks other than crosses or check marks used to designate the intention of the voter shall not be counted."

If I remember correctly witnesses reported that they were told to fill in the circles completely?
