Canada police conduct under microscope in witness testimony for Huawei CFO's U.S. extradition case

VANCOUVER (Reuters) - Witness testimony in Huawei Chief Financial Officer Meng Wanzhou's extradition case this week will be largely focused on the behind-the-scenes conduct of Canadian police in the lead-up to Meng's arrest two years ago on a warrant from the United States, moving away from her treatment by border agents.

Meng, 48, is accused of misleading the bank HSBC on Huawei Technologies Co Ltd's business affairs in Iran, allegedly causing the bank to break U.S. sanctions. If Canadian prosecutors are successful in extraditing her, Meng will face trial for wire fraud, bank fraud, and conspiracy to commit these crimes in the Eastern District of New York.

She denies the charges and is fighting them from under house arrest in Vancouver. Her lawyers have argued the arrest is the product of political interference.

Meng's lawyers have submitted that border officials invented parts of their witness accounts after the fact to cover up illegal cooperation with the Royal Canadian Mounted Police (RCMP) and the U.S. Federal Bureau of Investigation (FBI).

They are fighting to get Meng's extradition dismissed on the basis of alleged abuses of process, arguing they constitute violations of her civil rights laid out in Canada's Charter of Rights and Freedoms.

Witnesses for the Canada Border Services Agency (CBSA) and the RCMP have denied these allegations in affidavits and under cross examination.

Officers with the CBSA testified last week that their questioning of Meng, daughter of Huawei founder Ren Zhengfei, followed standard procedures and was separate from any action by law enforcement.

Beginning Monday a series of police witnesses will speak to their role in Meng's arrest at the Vancouver International Airport in December 2018. When RCMP Constable Gurvinder Dhaliwal was called to the witness stand late Friday, he said he "didn't have a clue" what Huawei was and had never heard the name Meng Wanzhou before December 2018.

Diplomatic relations between Ottawa and Beijing have degraded in the wake of Meng's arrest. China arrested Canadian citizens Michael Spavor and Michael Kovrig on espionage charges days later.

Prime Minister Justin Trudeau has resisted calls to release Meng, and last week he reiterated that Canada "followed its laws" and "lived up to a longstanding extradition treaty with our closest ally."

The Kraken Cray XT5 supercomputer at the National Institute for Computational Sciences (NICS) has recently been upgraded to become the first academic computer in the world to exceed one petaflop of calculation power. The acronym FLOPS stands for FLoating point Operations Per Second, and the Kraken is now able to perform about a thousand trillion mathematical calculations per second. The upgrade also places it within the top five supercomputers in the entire world, alongside petaflop-scale giants such as IBM's Roadrunner and the Cray XT5 Jaguar.

“At over a petaflop of peak computing power, and the ability to routinely run full machine jobs, Kraken will dominate large-scale NSF computing in the near future. Its unprecedented computational capability and total available memory will allow academic users to treat problems that were previously inaccessible,” Phil Andrews, the project director at the NICS, says of the improvements. The Institute keeps its computers at the Oak Ridge National Laboratory (ORNL), which is the most powerful supercomputer complex in the world to date. NICS is funded by the US National Science Foundation (NSF), and is managed by the University of Tennessee.

The new and improved Kraken features 16,000 six-core 2.6-GHz AMD Istanbul processors, for a grand total of nearly 100,000 cores. When it was brought online on October 5, it recorded a peak computational power of 1.03 petaflops, its managers said. It now features 129 terabytes of memory, or the equivalent of 13,000 movies on DVD, which means that it can run some of the most sophisticated, 3D, scientific computing applications ever developed. It will be used for materials science studies, as well as for modeling global warming and the events inside stars and supernovas.

“While reaching the petascale is a remarkable achievement in itself, the real strides will be made in the new science that petascale computing will enable. Kraken is a game changer for research,” NICS principal investigator Thomas Zacharia adds. He is also a professor in electrical and computer engineering at the University of Tennessee, and the Oak Ridge National Laboratory deputy director for science and technology. The improvements to the supercomputer were made possible through an NSF Track 2 award to the University of Tennessee, in excess of $65 million.

A man who deliberately breathed heavily on two protesters outside of President Donald Trump's golf course in Virginia has been charged with assault, the local sheriff's office said.

Loudoun County Sheriff's Office said on Sunday that Raymond Deskins, 61, was charged with misdemeanor-level assault.

Video shared on social media showed a woman, who can't be seen in the video, asking Deskins to move away from her on Saturday near the Trump National Golf Club, Washington DC.

At the same time another woman, also out of frame, pointed out that he wasn't wearing a mask.

Deskins, wearing a Trump t-shirt and an inflatable with the shape of Trump on the front, then breathed in and heavily breathed out.

One of the woman then said "that's assault," and he said "I breathed on you."

Trump was golfing there at the time, and reportedly skipped a G20 meeting with other world leaders about the coronavirus pandemic to do so.

The Sheriff's Office said that it was "aware" of the video, but said that "the incident was not witnessed by law enforcement and the video did not capture the entire interaction."

It said that an "investigation was conducted on scene and both parties were advised they could go to a Loudoun County Magistrate and seek a citizen-obtained warrant."

It said it received a warrant over the incident on Sunday.

Deskins was released on summons, the sheriff's office said, meaning he wasn't kept in custody.

NBC affiliate News4 Washington identified one of the women as Kathy Beynette.

She told the outlet that she and the other woman were protesting Trump, and that "quite out of nowhere, the guy came over from across the street, came charging across the street."

After the women told him to move away, she said, Deskins "proceeded to assault us by taking a deep breath and doing a very powerful exhalation on both of us."

She said that she and the other woman, who has not been named, are worried about their health.

"We're both senior citizens both close to 70 years old, which puts us in a high-risk category," she said.

"Because of this guy, my family has had to cancel the small Thanksgiving that we had planned with just a few people because I said I might've been exposed."

With the exception of a couple of organizations, the Defense Department has completed most of its third annual comprehensive financial statement audit covering the entire enterprise, worth about $2.9 trillion, a DOD official said, adding that there have been improvements resulting from the audit that will directly benefit the warfighter.

As of Nov. 12, DOD had cleared more than 530 findings, which are 16.3% of the discrepancies from the prior year’s audit, Thomas W. Harker, who is performing the duties of the under secretary of defense (comptroller)/chief financial officer, said at a Pentagon press briefing.

Several hundred more discrepancies should be cleared by next month when auditors complete their work. None of the discrepancies were related to fraud, he noted.

The cost of this year's audit was approximately $203 million, he said, with about $700 million in savings identified.

The ultimate goal is to get a clean financial statement audit opinion across the entire department, Harker said, but the lack of a positive opinion should not be regarded as a failure.

"We've been clear that this is a journey that will require a sustained effort over several years. And we remain committed to this goal and continue to make significant progress," Harker said.

The DOD audit is actually 24 separate audits of the military services, as well as defense agencies.

Harker provided some examples:

The Navy eliminated three material weaknesses, two on their general fund and one on their working capital fund; the Marine Corps eliminated one material weakness, he said.

The Defense Information Systems Agency has improved its business processes and controls, resulting in decreased time required to deliver property to customers, improved accuracy of property records and improved accuracy of financial statements.

Among the organizations expected to receive a clean audit, besides DISA, are: the U.S. Army Corps of Engineers — Civil Works; the Military Retirement Fund; the Defense Health Agency — Contract Resource Management; the Defense Contract Audit Agency; the Defense Finance and Accounting Service; the Defense Commissary Agency; and the DOD's Office of the Inspector General.
