civil or criminal

period

this is why the civil case was dismissed - judge correctly ruled the defense was available in that case and would not permit a "collateral attack" on the criminal case

no - a defendant has no control over it and cannot even waive the absence of jurisdiction

were talking about subject matter jurisdiction (there are other kinds)

the court either has it or it doesnt

its all by specific statutes/laws and spelled out for each type of court

 

if it doesnt and the court finds out case over

usually as here a party will raise it

in criminal cases that is always the defendant
