They passed a law to give their electoral votes to the candidate who wins the NATIONAL popular vote, PROVIDED states totaling 270 electoral votes have passed similar laws. This is a national initiative. They have not reached 270 yet. This is constitutional because each state decides how its electors are selected. In theory they could even be appointed by the governor. It has been according the state's popular vote just by tradition.
