A recent study in the journal Science, Public Health Policy, and the Law published by the Institute for Pure and Applied Knowledge/Public Health Initiative raises intriguing questions. The study, β€œCOVID-19 Data Collection, Comorbidity & the Law,” concludes that the Centers for Disease Control and Prevention (CDC) unilaterally altered the 17-year-old process by which it calculated disease-caused fatalities, creating a special procedure for tabulating COVID-19 deaths. This, the study says, enabled the CDC to produce inaccurate data which were widely disseminated by the media and served to justify a host of coercive measures to stem the spread of the disease.

β€œAs a result of these changes, we allege the CDC compromised the quality, objectivity, and integrity of all COVID-19 data collected to date,” the authors write.

 

The 25-page peer-reviewed study claims the CDC willfully violated several federal statutes, including the Data Quality Act, Paperwork Reduction Act, and the Administrative Procedures Act.

Specifically, in a March 24, 2020 NVSS COVID-19 Alert, the CDC instructed coroners, medical examiners, and physicians to de-emphasize underlying causes of death, also referred to as preexisting conditions or comorbidities, by recording them in Part II rather than Part I of death certificates, the study explains.

 

β€œIt’s worth noting that Part I of a death certificate is the immediate cause of death listed in sequential order from the official cause on line item (a) to the underlying causes that contributed to death in descending order of importance on line item (d), while Part II is/are the significant conditions NOT relating to the underlying cause(s) in Part I,” the study points out.

CDC’s action constituted a major rule change on reporting deaths from the agency’s 2003 Coroners’ Handbook on Death Registration and Fetal Death Reporting and Physicians’ Handbook on Medical Certification of Death, which had instructed medical professionals nationwide to list underlying conditions of death in Part I for the previous 17 years.

North Korea appears to be preparing to launch a new submarine capable of firing nuclear-capable ballistic missiles, with US and South Korean intelligence β€œthoroughly monitoring” developments at the North’s Sinpo shipyard.

 

New satellite images of the shipyard, on the east coast of the peninsula, show that a floating dry dock has been positioned alongside the launch quay for the vast construction hall where the submarine is being completed.

 

Analysis of the images by experts from The Stimson Center think tank and posted on the 38 North web site suggest the new vessel β€œmay be nearing completion or is ready to be rolled out and launched in the near future”.

 

The news came as European members of the Security Council requested an urgent meeting on Tuesday to discuss the North’s recent ballistic missile launches, which are in contravention of previous Security Council resolutions, with the possibility of additional sanctions on Pyongyang.

 

Recent events suggest that Pyongyang is returning to the β€œfire-and-fury” diplomatic strategies of the past.

 

Last week, North Korea launched two short-range ballistic missiles from its east coast, the first such launches in nearly a year and widely interpreted as Pyongyang’s first challenge to the new administration of US President Joe Biden.

 

Under the terms of United Nations resolutions, North Korea is banned from firing ballistic missiles.

 

On Monday, North Korea accused the United Nations Security Council of β€œdouble standards” for criticism of its recent missile launches.

 

In a statement issued through the North’s KCNA news agency, a senior foreign ministry official defended the launches, saying, β€œMany other countries across the globe are firing all kinds of projectiles."

 

Work to refurbish the Shinpo construction hall was completed in late 2016 and it is believed that assembly of the submarine began shortly afterwards.

 

There are additional signs that the vessel may be ready to launch, the analysts said, including an official visit to the site in July 2019 by Kim Jong-un, the North Korean leader, during which images of the submarine were released by state media.

 

Storage areas at the site that were as recently as last summer full of components for the craft are also now empty.

 

β€œWe are thoroughly monitoring the situation, with close coordination between the South Korean and US intelligence authorities,” a spokesman for the South Korean Defence Ministry told a press conference on Monday.

 

The North has already conducted a series of tests, from submerged barges, to simulate the firing of a submarine-launched ballistic missile.

 

The 2,720-tonne vessel that it is constructing is believed to be designed to carry three ballistic missiles and would theoretically be capable of sailing into the Pacific to threaten US military facilities in Hawaii or even the mainland of the continental US.

 

The US military has warned that the North deploying such a weapons system would be a significant increase in its offensive capabilities and a new cause for concern, but analysts have told The Telegraph that the threat is more limited as US and Japanese underwater monitoring technology will allow the submarine to be closely tracked.

Industry standards are big business for telecommunications firms. They vie to have their patented technology considered essential to the standard, which can boost a company’s bottom line by billions of dollars.

 

The Commerce Department placed Huawei on its β€œentity list” last May, restricting sales of U.S. goods and technology to the company and raising questions about how U.S. firms could participate in organizations that establish industry standards.

 

After nearly a year of uncertainty, the department has drafted a new rule to address the issue, two sources told Reuters. The rule, which could still change, essentially allows U.S. companies to participate in standards bodies where Huawei is also a member, the sources said.

 

The draft is under final review at the Commerce Department and, if cleared, would go to other agencies for approval, the people said. It is unclear how long the full process will take or if another agency will object.

As the trial of former police officer Derek Chauvin starts in Minneapolis, much of the trial will focus on the role of fentanyl in the body of George Floyd as the possible cause for his death. Notably, a new study in the last week reinforces prior research showing an alarming increase in the abuse of this powerful drug and deaths associated from it. In some counties, there was an almost 75% increase in the first half of 2020 in fatal drug overdoses with fentanyl as the main culprit.

 

While Floyd denied using drugs, he later said he was β€œhooping,” or taking drugs. That was confirmed in the autopsy which found that Floyd died from β€œcardiopulmonary arrest while being restrained by law enforcement officer(s).” The state’s criminal complaint against Chauvin said the autopsy β€œrevealed no physical findings that support a diagnosis of traumatic asphyxia or strangulation. Mr. Floyd had underlying health conditions including coronary artery disease and hypertensive heart disease.” He also was COVID-19 positive.

 

Andrew Baker, Hennepin County’s chief medical examiner, strongly suggested that the primary cause was a huge amount of fentanyl in Floyd’s system: β€œFentanyl at 11 ng/ml β€” this is higher than (a) chronic pain patient. If he were found dead at home alone & no other apparent causes, this could be acceptable to call an OD (overdose). Deaths have been certified w/levels of 3.” Baker also told investigators that the autopsy revealed no physical evidence suggesting Floyd died of asphyxiation. Plaintiff Judicial Watch, Inc. brings this action against Defendant U.S. Department of Defense to compel compliance with the Freedom of Information Act, 5 U.S.C. Β§ 552 (β€œFOIA”). As grounds therefor, Plaintiff alleges as follows:

STATEMENT OF FACTS

  1. On January 11, 2021, Plaintiff submitted a FOIA request to the Office of the Secretary of Defense/Joint Staff (β€œOSD/JS”), via the OSD/JS FOIA Requester Service Center’s online FOIA portal, seeking access to the following public records:

  2. Any and all records regarding, concerning, or related to the telephone call between House Speaker Nancy Pelosi and General Mark Milley on or about January 8, 2021. This request includes, but is not limited to, any and all transcripts, recordings, and/or summaries of the call, as well as any other records produced in preparation for, during, and/or pursuant to the call.

  3. Any and all additional records of communication between Gen. Milley and House Speaker Nancy Pelosi between November 1, 2020 and the present.

  4. OSD/JS confirmed receipt of Plaintiff’s request by email later that same day, January 11, 2021, and advised Plaintiff that the request had been assigned tracking number #21- F-0417.

  5. As of the date of this Complaint, Defendant has failed to: (i) produce the requested records or demonstrate that the records are lawfully exempt from disclosure; (ii) notify Plaintiff of the scope of any responsive records Defendant intends to produce or withhold and the reasons for any withholdings; or (iii) inform Plaintiff that it may appeal any adequately specific, adverse determination.

required to make a final determination on Plaintiff’s request by February 9, 2021. Because Defendant failed to make a final determination on Plaintiff’s request within the time limits set by FOIA, Plaintiff is deemed to have exhausted its administrative appeal remedies.

WHEREFORE, Plaintiff respectfully requests that the Court: (1) order Defendant to search for any and all records responsive to Plaintiff’s FOIA request and demonstrate that it employed search methods reasonably calculated to uncover all records responsive to the request; (2) order Defendant to produce, by a date certain, any and all non-exempt records responsive to Plaintiff’s FOIA request and a Vaughn index of any responsive records withheld under claim of exemption; (3) enjoin Defendant from continuing to withhold any and all non-exempt records responsive to Plaintiff’s FOIA request; (4) grant Plaintiff an award of attorney’s fees and other litigation costs reasonably incurred in this action pursuant to 5 U.S.C.
