this anon has been saying for years big tech can be sued for 1st amendment violations under this theory and has been mocked. I feel vindicated right now!
I use different words to explain it and mine are much easier to understand.
The Government and Big Tech formed an "Agency" relationship and that is what makes Big Tech liable for 1st amendment violations as a "so called " private company.
Big Tech took direction and supervision from members of the Government.
Although compensation is not a requirement of establishing an "Agency" relationship, it too is there.
Big Tech has had their financial assets (proffits) untouchable and allowed to grow exponancially. Enriching top execs as long as they work as a silent arm of Government officials.
Private companies can in fact be held liable for constitutional violations if they act in place of the Government. That has been happening for years!
A side note: I am disappointed to not see PayPal, MC, Visa and others not also named. Maybe that comes next for the very same reasons this suit is being filed.
