For military and federal - I am actually getting somewhere with this letter in my agency. I have not been granted my request yet but I have been told that it was elevated to agency level and possibly formal inquiry to the white house. For military the deadline has passed. My letter through official channels is civilian and directly related to the EO. Here it is:
Hi boss,
I am formally requesting an extension for myself of the Nov 22 deadline to be fully vaccinated.
In reading the Aug 23 approval letter for the approved vaccine Comirnaty, https://www.fda.gov/media/151710/download - in the licensing section, BioNTech has been authorized to manufacture the product with the Comirnaty label. In the FDA Lot release section, it says they cannot distribute the lots until a notification of release is received from the Director of CBER of the FDA. In the FDA frequently asked questions page, in the response titled "Is Comirnaty Vaccine interchangeable with other covid-19 vaccines?" It says the Pfizer BioNTech vaccine has the same formulation, but is legally distinct. The Pfizer BioNTech vaccine is legally distinct because it is still under EUA. My option for refusal under 21 USCS Section 360bbb-3 still applies. I have called around to make an appointment and when I found a place that had Pfizer in stock I asked if it was labeled Comirnaty. It was not. If distribution of the vaccine with the Comirnaty label is not available to me yet I may not be able to comply by the Nov 22 date, or the earliest date if first dose Oct 8th. I request delay of the deadline until Comirnaty is available.
