Biden canceling Chicago trip as his legislative agenda hangs in the balance

President Joe Biden is canceling plans to travel to Chicago on Wednesday in order to continue leading crucial negotiations in Washington over his legislative agenda, a White House official told CNN.

Biden scrapped his travel plans following meetings Tuesday with Democratic Sens. Joe Manchin of West Virginia and Kyrsten Sinema of Arizona aimed at bridging the gap between the moderate senators and progressive lawmakers over the $3.5 trillion budget reconciliation legislation and the fate of the $1.2 trillion bipartisan infrastructure deal.

"In meetings and calls over the weekend and through today, President Biden has been engaging with members of Congress on the path forward for the Build Back Better Act and the Bipartisan Infrastructure Deal. He will now remain at the White House tomorrow to continue working on advancing these two pieces of legislation to create jobs, grow the economy, and make investments in families, rather than failed giveaways to the rich and big corporations," a White House official said.

The decision to stay in Washington is a sign of how critical the next two days will be in determining the fate of the centerpieces of Biden's legislative agenda and the central role the President is playing in stewarding those negotiations.

Key progressive legislators in the House warned Tuesday they will vote against the infrastructure bill when it comes up for a vote in the House on Thursday barring an agreement on budget reconciliation, the $3.5 trillion package that Manchin and Sinema have said is too costly.

"There is a strong feeling that progress is being made," a source familiar with the discussions said. "Our big gun is staying here."

Biden stayed behind closed doors on Tuesday in meetings with Manchin and Sinema, while also speaking on the phone with progressive lawmakers, House Speaker Nancy Pelosi and Senate Majority Leader Chuck Schumer.

"You know me. I'm a born optimist," Biden said Monday about the prospects of a deal between the warring factions of his party. "I think things are going to go well. I think we're going to get it done, and – but I have meetings tonight, tomorrow, and for the next little bit, so…"

Biden was scheduled to travel to Chicago on Wednesday to highlight the effectiveness of Covid-19 vaccine requirements. A White House official said the trip would be rescheduled.

"There will be more to come on his engagement over the next couple of days, and the trip to Chicago to discuss the ongoing importance of getting people vaccinated will be rescheduled," the White House official said.

Six Members of Nine Trey Gangster Bloods Gang Plead Guilty to RICO Conspiracy

Last week, six members of the Nine Trey Gangsters (NTG) national criminal organization pleaded guilty to Racketeer Influenced and Corruption Organization (RICO) conspiracy charges.

According to court documents, the NTG is a national gang that started in the prisons of New York as a subset of the United Bloods Nation and has since spread throughout the East Coast and Southeast. The NTG is a criminal organization whose members and associates engage in acts of crime and violence including murder, assault, robbery, firearms possession, witness tampering, obstruction of justice, drug trafficking and extortion among other criminal activity.

“The Department will continue to bring to justice the leaders and most violent members of dangerous criminal enterprises like the Nine Trey Gangsters,” said Assistant Attorney General Kenneth A. Polite Jr. of the Justice Department’s Criminal Division. “Removing those most responsible for the violence and drug dealing perpetrated by members and associates of violent street gangs like the Nine Trey Gangsters makes our neighborhoods and communities safer.”

“Members of the Nine Trey Gangsters showed a shocking indifference to human life, both in carrying out planned acts of violence, and in distributing drugs, including methamphetamine, throughout Georgia,” said Acting U.S. Attorney Kurt Erskine for the Northern District of Georgia. “While the gang offered members a sense of belonging and the opportunity to make money through illicit drug sales, it was those same members who were most often the targets of violence from the gang based solely on the whims of the gang’s leaders.”

“Members of Nine Trey Gangsters have plagued our streets with violence and drug trafficking for far too long,” said Special Agent in Charge Chris Hacker of the FBI’s Atlanta Field Office. “These pleas are an example of our commitment to dismantle organized, violent criminal enterprises. The community can rest assured these six defendants won’t be on our streets for a very long time, thanks to the efforts of the FBI-led Safe Streets Gang Task Force and its state and local partners.”

“As part of our commitment of ridding our facilities of criminal activity, we maintain a robust plan for identifying and managing those participating in gang activity from behind prison walls,” said Commissioner Timothy C. Ward of the Georgia Department of Corrections. “We appreciate the support and assistance of our law enforcement partners on every level, in our efforts to see that justice is being served on those who pose a threat to the safety of the public and the safe operations of our facilities.”

“These Bloods members terrorized communities by committing murders and robberies with no regard for human life,” said Assistant Director Calvin Shivers of the FBI Criminal Investigative Division. “Today’s convictions provide a measure of justice, and the FBI will continue to dismantle these criminal enterprises and protect communities from gang violence.”

The NTG have a hierarchical structure in which members throughout the country are subdivided into separate groups or “lines.” Each NTG member has a specific rank within the gang or a specific line, and this rank comes with specific duties and responsibilities. Each of the six defendants who pleaded guilty were part of the gang’s “fire” line.

The following NTG gang members, all of Georgia, pleaded guilty to count 1 of the second superseding indictment charging them and four others with RICO conspiracy:

 

Tyrone Clark, aka “Tight Eye”; Joseph Riley, III, aka “Joe Blow”; Gary Sartor aka “G-Stacks”; and Patrick Caple, aka “Zoe,” all held the rank of “Fifth Floor” in the gang’s hierarchy, one of the highest ranks an individual can hold within a line of the gang. In those roles they were responsible for overseeing all the members below them and reporting up to the gang’s national leadership.

Brandon Asberry, aka “B5,” held the rank of “Second Floor” in the gang’s hierarchy. In this role, Asberry was responsible for collecting dues form the gang’s members and overseeing the gang’s meetings or “nines.”

Michael Jackson, aka “MJ,” held the rank of “Third Floor” in the gang’s hierarchy. He was responsible for planning “wars” or conflicts with rival gangs and providing weapons to other NTG members.

Final Defendants Sentenced in Federal Dog Fighting Case

Twelve Co-Defendants Sentenced to Serve a Total of 272 Months in Prison

The last four of 12 defendants convicted on federal dog fighting charges were sentenced today in Albany, Georgia, by the U.S. District Court for the Middle District of Georgia. Collectively, the court sentenced the defendants to a total of 272 months in prison.

On June 22, a federal jury convicted defendant Kizzy Solomon, 44, of Camilla, Georgia, of 15 counts of aiding and abetting the possession and training of dogs for purposes of an animal fighting venture. Eleven other defendants previously pleaded guilty to various offenses related to their participation in a dog fighting ring.

“The injuries that dogs suffer in fights are horrible enough, but this case shows how the cruelty of the dog fighting industry goes far beyond the fighting pit,” said Assistant Attorney General Todd Kim of the Justice Department’s Environment and Natural Resources Division. “We will continue to vigorously prosecute those who engage in these crimes.”

“Dog-fighting is vicious and illegal; it is also a breeding ground for other dangerous criminal activity that undermines the safety of our communities,” said Acting U.S. Attorney Peter D. Leary for the Middle District of Georgia. “Our office will not tolerate dog-fighting; we will continue to work with our law enforcement partners to hold offenders accountable with federal prosecution.”

“The cruelty exhibited by these individuals has left a stain on the human psyche of our civilization” said Special Agent in Charge Jason Williams of the U.S. Department of Agriculture-Office of Inspector General (USDA-OIG). “This collaborative effort with our local and federal partners demonstrates that wherever you are, you will be held accountable to the fullest extent of the law.”

The individual prison sentences imposed by the court are:

Kevin Charles, also known as “Trinidad,” 45, of Jackson, Georgia – 18 months in prison to be followed by two years of supervised release

Terry Driggers, 71, of Hoboken, Georgia – time served (a period of approximately 17 months)

Kentre Gibson, 40, of Douglas, Georgia – 21 months

Maurice Glover, 48, of Douglas, Georgia – 12 months

Orlando Johnson, 35, of Americus, Georgia –30 months in prison to be followed by two years of supervised release

Shadon Johnson, 37, of Fitzgerald, Georgia – 2 years of probation

Alonza Jordan, 48, of Americus, Georgia – 7 months

Leslie Meyers, also known as Les Meyers, 44, of Tallahassee, Florida – 123 months in prison to be followed by two years of supervised release (upward departure to statutory maximum of 60 months on each of 4 dog fighting charges, to run concurrent to one another and consecutive to 63 months sentence on firearm)

Starlin Morgan, 39, of Plains, Georgia – 11 months

Concrete Contractor Pleads Guilty to Rigging Bids for Public Contracts in Minnesota

A Minnesota concrete contractor pleaded guilty to rigging bids on public concrete repair and construction contracts in the state of Minnesota.

According to court documents filed in the U.S. District Court in Minneapolis, Clarence Olson and his co-conspirators conspired to rig bids on concrete repair and construction contracts submitted to at least four municipalities in the state of Minnesota, which included local governments and school districts in the Minneapolis-St. Paul area. Olson participated in the long-running conspiracy from at least as early as September 2012 and continuing through at least as late as July 2017.

“This resolution demonstrates the Antitrust Division’s commitment to ensuring the integrity of government procurement at all levels of government,” said Acting Assistant Attorney General Richard A. Powers of the Justice Department’s Antitrust Division. “Bid-rigging schemes that target local government contracts harm taxpayers, and people who take part in these conspiracies will be held accountable for their actions.”

“The defendant in this case rigged bids on contracts that were intended to benefit local governments and school districts in Minnesota,” said Assistant Director Calvin Shivers of the FBI’s Criminal Investigative Division. “The FBI and our law enforcement partners are committed to investigating those who attempt to exploit government programs and the American taxpayer.”

Olson pleaded guilty to a violation of Section 1 of the Sherman Act. He faces a maximum penalty of 10 years in prison and a $1 million criminal fine. The maximum fine may be increased to twice the gain derived from the crime or twice the loss suffered by the victims of the crime if either amount is greater than the statutory maximum fine. A federal district court judge will determine any sentence after considering the U.S. Sentencing Guidelines and other statutory factors.

The Antitrust Division’s Chicago Office is prosecuting the case, which was investigated with the assistance of the FBI’s Minneapolis Field Office.

Man Sentenced for Role in International Human Smuggling Conspiracy

A Bangladeshi national was sentenced today to 46 months in prison for his role in a scheme to smuggle undocumented individuals from Mexico into the United States.

According to court documents, between March 2017 and June 2019, Mohamad Milon Hossain, 41, a Bangladeshi national formerly residing in Tapachula, Mexico, conspired with and assisted human smugglers operating out of Bangladesh, South and Central America, and Mexico to bring numerous undocumented individuals to the U.S. border in exchange for payment. Hossain operated out of Tapachula where he maintained a hotel that housed the individuals on their way to the United States. Hossain provided plane tickets and other assistance for the individuals to travel from Tapachula to Monterrey, Mexico, where co-conspirator Moktar Hossain assisted their illegal crossing into the United States.

“This human smuggling conspiracy operated on a global scale and endangered the lives of Bangladeshi migrants,” said Assistant Attorney General Kenneth A. Polite Jr. of the Justice Department’s Criminal Division. “The Justice Department will continue working with our law enforcement partners here and abroad to bring human smugglers like Hossain to justice and to disrupt these criminal networks that unlawfully bring migrants from across the world into the United States.”

“This criminal placed profit before life,” said Acting Assistant U.S. Attorney Jennifer B. Lowery of the Southern District of Texas (SDTX). “Human smugglers like Hossain often put migrants in dangerous situations, many leading to serious injury and even death. The SDTX is no stranger to this issue and will fervently pursue the battle, holding accountable not only the transporters, but any individuals who provided assistance along the way.”

“Today’s sentencing is a great example of how Homeland Security Investigations (HSI) uses its worldwide resources and interagency partnerships to bring international criminals like Mohamad Milon Hossain to justice in the United States,” said Special Agent in Charge Shane Folden of HSI San Antonio. “Hossain was a key facilitator and smuggler of Bangladeshi nationals and his actions put our national security at risk. HSI is committed to working with its domestic and international partners to combat this type of crime throughout the globe.”

This case was investigated by HSI Laredo, with assistance from the HSI Human Smuggling Unit, HSI Mexico City, HSI Houston, HSI Calexico, HSI Monterrey, U.S. Customs and Border Protection (CBP) Office of Field Operations, CBP Border Patrol and the U.S. Marshals Service. This investigation was conducted under the Extraterritorial Criminal Travel Strike Force (ECT) program, a joint partnership between the Justice Department’s Criminal Division and HSI. The ECT program focuses on human smuggling networks that may present particular national security or public safety risks, or present grave humanitarian concerns. ECT has dedicated investigative, intelligence and prosecutorial resources. ECT coordinates and receives assistance from other U.S. government agencies and foreign law enforcement authorities.

Seven Arizonan Republican legislators face calls to ban them from the House and Senate

Arizona’s legislative leadership are hearing calls that seven of their Republican colleagues be banned from the House and Senate. The incoming legislators in question back “Stop The Steal.” They are Republican Representatives Mark Finchem, David Cook, and Walt Blackman along with Republican Senators Wendy Rogers, Kelly Townsend, Sonny Borrelli, and David Livingston.

The “Stop The Steal” movement claims that President Donald Trump won Arizona and the nation in the November 3 election. Both claims are completely false and have been rejected in at least 60 federal and local court actions nationwide, including several in Arizona. Wednesday, the false beliefs and a call for action by President Trump, caused his supporters to riot and temporarily seize the U.S. Capitol Building. As they stormed the halls, Congress's joint session certifying the electoral vote was forced into hiding. The vote was finally certified at 4 a.m Thursday.

"We have substantial evidence that this election was a fraud in six states," Representative-Elect Mark Finchem, (R-LD 11) told to ABC15 Arizona, while walking the streets of Washington DC the morning of the riot. "If there’s violence, it will be at the hands of Antifa."

Finchem, who represents Oro Valley, traveled to Washington to take part in the protests. He posted pictures on Twitter from outside the Capitol with one reading, "What happens when the People feel they have been ignored, and Congress refuses to acknowledge rampant fraud," showing a picture of the protest.

Newly elected Arizona state Senator Wendy Rogers echoed the statement, also on Twitter.

"I condemn the radical Antifa mobs for attacking the Capitol and I condemn the Democrats for wanting to defund the very police who protected them," tweeted Rogers on Wednesday.

Blaming Antifa is a factually incorrect talking point from far-right Republican Party members. In September, FBI Director Christopher Wray said although Antifa is real, it is viewed more as an ideology and not a group.
