Born in Canada. Father was Cuban, green card Holder, and I think he was a draft dodger. Kind of fits the MO, IMO.

 

Mother a US citizen, but rumors during the 2016 campaign arose that said she had taken on Canadian citizenship. I don't think that's true, going by the time frame involved, but there may have been laws in place in Canada at that time that benefitted draft dodgers. All is iffy, basically. I think he's a US citizen, though.

 

Even if mother had taken Canadian citizenship she would have had to denounce US citizenship. Canada can tell Canadians that if they want US citizenship they have to give up their Canadian citizenship, but they can't tell US citizens the same because Canada can't create US citizenship law. US has no policy wrt to dual citizenship.

 

Regardless of what the mother did, if Cruz took US citizenship from his mother, he had it until 18, in most cases. 17 in some special cases, I think, Parents can't change it. Cruz could decide himself starting at 18. Don't remember if there is a window, or for how long.

 

That's US citizenship. NBC is another can of worms. Constitution says both parents US citizens and a US soil birth for NBC, IIRC. Logically, a situation where there is no other possible citizenship available. If some immigration law change, at any point in US history, was needed to determine your citizenship, you weren't a NBC is the way I think of it.

 

Mothers couldn't transfer citizenship to foreign soil birth kids until the changes that were made in US citizenship law at around 1920, or so. No way, then, the founders would have considered Cruz a NBC. Don't know if that is relevant or not, nowadays, just giving an example of a law creating a citizen that would not have been one at the country's founding.

 

If Obama was born outside of US jurisdiction, he wouldn't have even been a US citizen. US immigration law at the time said mother had to have been in the US 5 years after her 14th birthday. She was 18, if generally accepted Obama birth details are real. That's why the Hawaiian BC is a BFD.

After Obama, everyone figures they can just blow off the NBC question and dare the court. Just get a rough consensus of where the justices stand and go for it. Since when has ethics or adherence to black letter law been a deterrent, lately?

 

Question with Cruz is if the democrats would have called him on it. Hypocritical behavior doesn't bother them in the least., nor does influencing justices, IMO.

 

Biggest question now is Heels. She should prompt an SC case. Never has been one. It has to be ruled on. My fear is that the Obama gang knows it will be ruled that NBC & citizen are one and the same.
