because it's one sweet scam they got going on
whether r or d, they can just argue back and forth all day long and lobby for laws the are contrary to the constitution and collect paychecks which shouldn't even be allowed to begin with
a major part on why they rely on using all their influence and their parrots in all entertainment/media to push their anti-constitutional messages together in lock step to sway public opinion in their favor
everything has been usurped re: the constitution from the military policing the world without being attacked and war declared by congress rather than protecting the borders of the homeland to the average joe having his speech taken away regardless what the message is, and i've seen it on both left and right with the "free speech doesn't mean there isn't consequences for that speech" when it should be actions that take precedent over words, to putting that fancy "felony" word on someone to keep them from the means to protect themselves no matter the insignificance of that felony charge - dangerous freedom over peaceful slavery.
but yes, the constitution should be the law of the land, however it's not currently at the moment
and it sure isn't the same now as it was written then about the supreme court, that costs money which most of the time the average person cannot afford to pay to fight
