Text message makes case ‘materially’ worse for Clinton lawyer Michael Sussmann

On a Sunday night just weeks before the 2016 presidential election, top Democratic lawyer Michael Sussmann allegedly texted his old friend, the FBI’s then-general counsel James Baker, to say that he urgently needed to convey “sensitive” information to the Bureau — “not on behalf of a client or company,” but just because he was a good citizen who wanted to help the government.

The information, it turns out, was sculpted to portray Donald Trump, then the Republican nominee for president, as if he were in cahoots with the Kremlin. I say “sculpted” advisedly. In reality, according to the false-statements indictment against him, Sussmann was actually representing two clients: Rodney Joffe, an information technology expert, and the Democratic campaign of Trump’s opponent, Hillary Clinton.

Joffe, to whom the Sussmann indictment refers as “Tech Executive-1” and describes as angling for a job in the anticipated Clinton administration, was then working with a team of IT pros to curate records of internet communications. His objective, according to the indictment, was to project the appearance of a communications back-channel between Trump Tower in New York City and Alfa Bank, an important Russian financial institution with ties to Vladimir Putin’s regime. The Clinton campaign reportedly wanted to depict the allegation as so serious that the FBI was investigating it. Sussmann, the Washington insider who was billing his time on the Trump/Russia matter to the Clinton campaign, was the perfect messenger to get the FBI’s attention.

The existence of the critical text message was revealed on Monday by prosecutor John Durham, the Justice Department special counsel who is investigating the origins of “Russiagate” — as the FBI’s probe of former President Trump’s supposed collusion with Russia is popularly known. Russiagate appears to have been ignited by bogus opposition research manufactured by the Clinton campaign, whose operatives hyped it to media outlets and government officials.

Last September, Durham indicted Sussmann, alleging that he made false statements to investigators. Specifically, Sussmann — who has denied the charge and pleaded not guilty — is alleged to have claimed that he was not acting on behalf of any client when he delivered to the FBI computer data files and an analytical “white paper,” which were said to implicate Trump.

The first observation to make about the startling text message revelation we’re just learning about is that it also must have been unknown to prosecutors until recently. There is no mention in the indictment of Sussmann’s texting Baker on Sept. 18, 2016, to set up the meeting, which occurred at the FBI’s Washington headquarters the following day. That would seem unfathomable if Durham had access to the text when drafting the charges.

According to prosecutors, the text, sent at 7:24 p.m., states: “Jim — it’s Michael Sussmann. I have something time-sensitive (and sensitive) I need to discuss. Do you have availability for a short meeting tomorrow? I’m coming on my own — not on behalf of a client or company — want to help the Bureau. Thanks.”

A Palmetto man was arrested by deputies after they said he sexually battered a five-year-old girl during a birthday party on Sunday.

The Manatee County Sheriff’s Office said the victim’s parents called them to report the incident. Investigators identified the suspect as 44-year-old Christopher Thompson.

Hillary lawyer Sussmann won’t try to prove tie between Trump and Russia

Hillary Clinton campaign lawyer Michael Sussmann won’t try to prove the explosive claims ​he passed to the FBI that alleged former President Donald Trump had a secret back channel to a Russian bank, according to a court filing Monday.

Sussman’s defense lawyer “stated that he will not seek to affirmatively prove the existence of a link between Alfa Bank and the Trump campaign,” Washington DC federal Judge Christopher Cooper wrote in a six-page ruling.

The defense move, announced during a pretrial hearing Thursday, came after Special Counsel John Durham said he wouldn’t seek to disprove the data Sussmann gave the FBI if he agreed to “concede or decline to dispute the fact that no secret channel of communications actually existed,” according to court papers.

Based on the defense decision, “the Court will hold the government to its word, and will not allow it to put on extensive evidence about the accuracy of the data Mr. Sussmann provided to the FBI unless Mr. Sussmann does so first,” Cooper wrote.

But the judge said he “will permit the government to put on evidence reflecting the FBI’s ultimate conclusions —- which the Court understands to be that the Alfa Bank allegations were unsubstantiated —- as well as the ‘particular investigative and analytical steps’ the FBI took to reach them.”

“Such evidence is relevant to the government’s theory of materiality: that Mr. Sussmann’s alleged statement that he was not representing a client caused the FBI to handle the subsequent investigation differently than it otherwise would have,” Cooper wrote.

To accomplish the scheme, Adler and Goldstein communicated using coded language. Goldstein would refer to cash as “challah,” the source of the cash as “the baker,” and would invite co-conspirators to “wrap tefillin” when he proposed meeting to receive checks or deliver cash. For example, on Thursday, January 7, 2016, Goldstein texted Adler, “Good morning I got the challah[.] What time?” That same day, Adler replied via text message, “Monday morning 8am at shul or today before 12pm if you can come to my office.” Goldstein then replied, “Monday @8 is fine.” On Monday, January 11, 2016, Goldstein deposited a check from Adler for $30,000 payable to Chabad of Poway.

On or about December 29, 2017, Goldstein deposited two sequentially numbered checks from Adler, one for $180,000 and the other for $980,000. On Friday, January 5, 2018, Goldstein sent Adler a coded text message proposing that they “get together and wrap teffilin.” A few days later, on January 10, 2018, Goldstein wired approximately $1million to a wholesale and retail jeweler to purchase 246 Suisse Fortuna 1 oz. rectangular gold ingots, 246 Canadian Maple Leaf 1 oz. gold coins, and 246 American Eagle 1 oz. gold coins. On January 17, 2018, Goldstein sent another coded message to Adler asking him, “[w]hen can you come [i]n for a teffilin wrap? I’m ready for you.” Goldstein delivered the gold to Adler the next day. Adler nonetheless claimed on his 2017 tax returns that he had donated over $1 million to charity, fraudulently reducing his 2017 tax liability by approximately $447,000.

Adler and Goldstein took additional steps to conceal their scheme from authorities. On or about October 18, 2018, Goldstein told Adler that he was under investigation by the IRS and that he had been the subject of an undercover operation relating to tax evasion. Goldstein asked for Adler’s help to prove, falsely, that Goldstein, and not Adler, was in possession of the gold coins purchased with Adler’s purported donation. In the early hours of October 19, 2018, Adler arrived at Goldstein’s residence and returned the gold coins.

'Highly contagious' disease kills dozens of horses at Colorado facility

67 wild horses have died since Saturday at a BLM facility in Cañon City.

CAÑON CITY, Colo. — An "unknown yet highly contagious and sometimes fatal disease" has killed dozens of horses at a wild horse facility in Cañon City.

The Bureau of Land Management (BLM) said 67 wild horses have died since the outbreak began Saturday. Ten horses died on Monday.

The wild horse facility in Cañon City, about 115 miles south of Denver, has been voluntarily quarantined while local, state and federal officials determine the exact cause of death of the horses.

“It’s upsetting to BLM and to employees," said BLM spokesperson Steven Hall. "It’s taking a great toll on them. This isn’t where anybody wants to be in terms of managing wild horses.”

Carol Walker, a wild horse advocate, was concerned to hear about the deaths of dozens of horses. She adopted a young horse named Helios from the facility last fall.

"I know and care about those horses, and I don’t want to see them die," Walker said."

Walker cares for three wild horses on her property in Longmont. She adopted them after they were removed during wild horse roundups like the one the BLM conducted last fall in the Sand Wash Basin.

“[Wild horses] shouldn’t be pushed off of our public lands because of ranching interests," Walker said. "They should be allowed to live out their lives wild and free.”

Hall acknowledged there will always be debate and discussion about gathering and removing wild horses from public lands.

"I think right now our focus is in trying to determine what is going on with the horses in Canon City, find a way to prevent it from happening again and do what we can to keep as many horses healthy as we can," Hall said.

Hall told 9NEWS that a private veterinarian, federal veterinarian and experts from Colorado State University and the University of California, Davis were helping investigate and manage the outbreak at the Cañon City facility.

“We definitely can understand the disappointment, the sadness and in some cases the anger from people out there over having an outbreak like this at a wild horse facility," Hall said.

The Cañon City wild horse facility is designed to hold 2,950 wild horses, Hall said. There are currently 2,550 horses at the facility.

“Most of the horses in the facility are horses that were gathered in Colorado, and the horses that are being most directly affected by this outbreak are from an area called West Douglas, and they were part of a gather last fall," Hall said.

Horses at the facility have been separated based on their symptoms.

“We’re doing everything that we can from a veterinary standpoint," Hall said. [We're doing] what we can to isolate the horses and we’ve voluntarily quarantined the entire facility.”
