Attorney General Merrick Garland Unveils New “Office of Environmental Justice” to Advance Biden’s Climate Agenda

 

US Attorney General Merrick Garland on Thursday unveiled a new “Office of Environmental Justice” to advance Joe Biden’s climate agenda.

 

“The new office will be headed by Cynthia Ferguson, an attorney working in the DOJ’s Environmental Enforcement Section of its Environment and Natural Resources Division.” – CNN reported.

 

Garland said the Office of Environmental Justice “will serve as the central hub for our efforts to advance our comprehensive environmental justice enforcement strategy,” with the office working alongside a number of other intradepartmental agencies, including the Civil Rights Division and United States Attorneys’ offices, to “prioritize meaningful and constructive engagement with the communities most affected by environmental crime and injustice.”

 

“In our environmental enforcement efforts, we will prioritize the cases that will have the greatest impact on the communities most overburdened by environmental harm,” he said, noting that “communities of color, indigenous communities, and low-income communities often bear the brunt of the harm caused by environmental crime, pollution and climate change.”

Iowa will recognize abortion rights if SCOTUS reverses Roe v. Wade

 

The Iowa Supreme Court has not yet ruled on the case.

 

At this point, Iowans won’t see an immediate impact if Roe v Wade is overturned, an Iowa attorney general spokesman says.

 

The Iowa Supreme Court has recognized a right to abortion in the state’s constitution, Office of the Attorney General Chief of Staff Lynn Hicks told The Center Square in an emailed statement Wednesday.

 

Iowa legislators and Gov. Kim Reynolds asked the court to overturn that ruling in a case regarding the 24-hour waiting period law passed in 2020, Hicks said.

 

In August 2021, 60 legislators asked the Iowa Supreme Court in an amicus brief filed by Alliance Defending Freedom and The FAMiLY Leader to reverse its 2018 decision on Planned Parenthood of the Heartland. v Reynolds. In that case, the court recognized a right to abortion in the Iowa Constitution in its 2018 opinion in Reynolds v Planned Parenthood. It concluded the law violates the due process and equal protection clauses of the Iowa Constitution because its restrictions on women are not narrowly tailored to serve a compelling interest of the State, Justice Mark Cady said in the majority’s ruling.

 

Since the 2018 decision, Gov. Kim Reynolds has appointed justices Dana Oxley, Matthew McDermott, Christopher McDonald, and Susan Christensen, who replaced the late Cady as chief justice.

 

“If that 2018 state ruling still stands when Roe is overturned, Iowans will watch state after state around us protect life, while we cannot,” The FAMiLY Leader said in a statement Tuesday. “Rather, Iowa would likely become an abortion destination state, where thousands of women travel to seek abortions.”

 

The Iowa Supreme Court has not yet ruled on the case.

 

The institute supports a Protect Life Amendment that Iowa legislators passed in May 2021 to amend the Iowa Constitution to declare the Constitution “does not recognize, grant, or secure a right to abortion or require the public funding of abortion.” The proposed amendment needs to be passed again in the fall legislative session before voters see it as an electoral ballot question.

 

Under a bill that is lingering in the House, SF2381, Iowa would spend $1 million expanding options statewide for maternal support programs through nonprofit organizations that promote helping pregnant women choose adoption or parenting. The Senate passed it April 5 in a 32-16 vote.

FDA restricts J&J’s COVID-19 vaccine due to blood clot risk

 

Today, the U.S. Food and Drug Administration has limited the authorized use of the Janssen COVID-19 Vaccine to individuals 18 years of age and older for whom other authorized or approved COVID-19 vaccines are not accessible or clinically appropriate, and to individuals 18 years of age and older who elect to receive the Janssen COVID-19 Vaccine because they would otherwise not receive a COVID-19 vaccine.

 

After conducting an updated analysis, evaluation and investigation of reported cases, the FDA has determined that the risk of thrombosis with thrombocytopenia syndrome (TTS), a syndrome of rare and potentially life-threatening blood clots in combination with low levels of blood platelets with onset of symptoms approximately one to two weeks following administration of the Janssen COVID-19 Vaccine, warrants limiting the authorized use of the vaccine.

 

The FDA has determined that the known and potential benefits of the vaccine for the prevention of COVID-19 outweigh the known and potential risks for individuals 18 years of age and older for whom other authorized or approved COVID-19 vaccines are not accessible or clinically appropriate, and for individuals 18 years of age and older who elect to receive the Janssen COVID-19 Vaccine because they would otherwise not receive a COVID-19 vaccine.

 

“We recognize that the Janssen COVID-19 Vaccine still has a role in the current pandemic response in the United States and across the global community. Our action reflects our updated analysis of the risk of TTS following administration of this vaccine and limits the use of the vaccine to certain individuals,” said Peter Marks, M.D., Ph.D., director of the FDA’s Center for Biologics Evaluation and Research. “Today’s action demonstrates the robustness of our safety surveillance systems and our commitment to ensuring that science and data guide our decisions. We’ve been closely monitoring the Janssen COVID-19 Vaccine and occurrence of TTS following its administration and have used updated information from our safety surveillance systems to revise the EUA. The agency will continue to monitor the safety of the Janssen COVID-19 Vaccine and all other vaccines, and as has been the case throughout the pandemic, will thoroughly evaluate new safety information.”

Pentagon denies sharing intel with Ukraine to ‘kill’ Russian generals

 

However, it provides “battlefield intelligence” to help Kiev “defend” the country

 

The Pentagon has denied media reports suggesting it had shared intelligence with Ukraine to specifically target high-ranking Russian military officials.

 

“The United States provides battlefield intelligence to help Ukraine defend their country,” Pentagon press secretary John Kirby said during a media briefing on Thursday.

 

We do not provide intelligence on the location of senior military leaders on the battlefield or participate in targeting decisions of the Ukrainian military.

 

At the same time, Kirby admitted that Kiev “combines” intelligence it gets from multiple unspecified sources to take its “own decisions,” apparently shifting the blame for reported killings of Russian generals onto Ukraine itself.

 

“Ukraine combines information that we and other partners provide with the intelligence that they themselves are gathering, and then they make their own decisions and they take their own actions,” he said.

 

Kirby’s remarks echoed the statements made by the National Security Council spokeswoman Adrienne Watson, who also insisted that US intelligence wasn’t provided to the Ukrainian forces “with the intent to kill Russian generals.”

 

The now-denied US assistance in targeting high-Ranking Russian officials was first reported by the New York Times. The newspaper said Washington provided Kiev with information on Russia’s mobile military headquarters, citing anonymous American officials. Ukraine then combined the data with its own intelligence, carrying out strikes that purportedly killed an unspecified number of Russian commanding officers.

 

Russia attacked the neighboring state following Ukraine’s failure to implement the terms of the Minsk agreements, signed in 2014, and Moscow’s eventual recognition of the Donbass republics of Donetsk and Lugansk. The German- and French-brokered Minsk Protocol was designed to give the breakaway regions special status within the Ukrainian state.

 

The Kremlin has since demanded that Ukraine officially declare itself a neutral country that will never join NATO. Kiev insists the Russian offensive was completely unprovoked and has denied claims it was planning to retake the two republics by force.

EU calls for confiscation of frozen Russian assets

 

Sanctioned assets should be used to rebuild Ukraine, the European Council president says

 

Russian assets that have been frozen in the EU as part of sanctions against Moscow over the conflict with Kiev should be seized and allocated for the reconstruction of Ukraine, European Council President Charles Michel said on Thursday.

 

“I’m absolutely convinced that this is extremely important not only to freeze assets, but also to make it possible to confiscate them, to make them available for rebuilding the country. I’m personally convinced,” Michel insisted in an interview with Interfax-Ukraine news agency.

 

He revealed that he had already told the Council’s legal service to come up with “some possible ideas in order to find a legal solution in line with the principles of the rule of law, that would facilitate and make possible the confiscation of the assets of the people who are sanctioned by the EU or by other countries in the world.”

 

Acting in such a manner should be “a question of fairness, a question of justice” for Brussels, he added.

 

However, Michel acknowledged that implementing his plan on a “legal level is not so simple.”

 

“There are 27 legal systems across the EU and, in many EU member states, this needs a decision taken by a court in order to make it possible. It takes time, it’s a difficult and long process,” he explained.

 

The European Council president’s ideas echoed those previously voiced by Washington. In late April, the White House presented a set of “comprehensive proposals” aimed at supposedly holding Russian “oligarchs” accountable for the events in Ukraine. The proposals included “establishing a streamlined administrative authority” that would be able to confiscate sanctioned assets and transfer them to Kiev to “remediate harms of the Russian aggression.”

 

Moscow decried those American plans as “nothing but simple expropriation of private property that [the US] seeks to falsely justify.”

 

Kremlin spokesman Dmitry Peskov said it would become “a very dangerous precedent,” showing “just how fragile all the universally accepted foundations have become” in the field of private property rights, economics and politics.
