That's a good question. It's not a subject that's been studied. At all. But I'd go with void ab initio. Void from inception. Statutory law that's declared so unconstitutional that it's void ab initio is treated as though it never existed. I'd expect something like an executive action to be treated the same way butโ€ฆthat isn't something commonly (ever) discussed in law school or practice.

All that is required for a pardon to be legitimate is the crime itself. Known and unknown. On the other hand, if Obama is illegitimate, then it doesn't make shit bit of a difference. All of his pardons would be considered illegal as he was an illegitimate president.
