Dissent In WI Ballot Drop Box Victory Highlights Much Bigger Issue: Our Top Jurists Don’t Care About Election Integrity

 

The Wisconsin Supreme Court on Friday held that state election officials’ use of some 500-plus drop boxes during the 2020 general election violated Wisconsin law.

 

While the court’s decision represents a (partial, as we will soon see) victory for election integrity, the split 4-3 decision and the substance of the dissent reveal that having a fair electoral process no longer “transcends any individual partisan interest” — something less than two decades ago Jimmy Carter touted as a universal truth in the bipartisan Commission on Election Reform report “Building Confidence in U.S. Elections.”

 

In Teigen v. Wisconsin Elections Commission, the court declared that the Wisconsin Elections Commission, or “WEC,” had illegally authorized election officials to use ballot drop boxes. The high court further held the WEC exceeded its statutory authority when it declared that voters could hand off their ballots to third parties rather than personally deliver their own ballots to election officials. The WEC had authorized ballot drop boxes and third-party ballot delivery in two documents issued in 2020, one in the spring before the primary election and the second before the November 2020 general election.

 

In the first memo, the WEC stated, “[Ballot] drop boxes can be used for voters to return ballots but clerks should ensure they are secure, can be monitored for security purposes, and should be regularly emptied.” That memo also noted that “[a] family member or another person may … return the [absentee] ballot on behalf of a voter.”

 

Several months later, in the summer of 2020, the WEC issued a second document that encouraged “creative solutions” to allow for the use of ballot drop boxes. The second memo expressly provided that municipal clerks could allow drop boxes to remain “unstaffed,” and indicated that “[a]t a minimum, you should have a drop box at your primary municipal building, such as the village hall.” Based on the WEC’s guidance, election officials used some 528 drop boxes during the fall 2020 election. By the spring of 2021, some 570 drop boxes dotted the midwestern state.

 

Two voters filed suit challenging the WEC’s guidance, arguing the rules violated the Wisconsin election code. The voters prevailed at the trial court level and the WEC appealed, with the voters asking the Wisconsin Supreme Court to take the case immediately, bypassing the intermediate appellate court. The high court agreed and heard oral arguments in April 2022 and affirmed the lower court’s decision in favor of the voters on Friday.

 

The Wisconsin Supreme Court’s opinion methodically marched through the various legal issues, beginning with the question of whether the voters had standing to sue to challenge the WEC’s guidance. The court in Teigen concluded that the plaintiffs had standing to sue because they sufficiently alleged they had “suffered an injury in fact to their right to vote.”

Arkansas Sheriff’s Home Firebombed After Department Employee Found Dead In Her Driveway: Officials

 

RANDOLPH COUNTY, Ark. – The Randolph County Sheriff’s Department has requested the Arkansas State Police investigate a series of events that occurred early today that began when a Biggers community resident attempted to firebomb the local sheriff’s residence.

 

The incident comes two days after a 57-year-old local county sheriff’s department employee was found fatally shot at her home.

 

Sheriff Kevin Bell was alerted about 1:30 AM that Bryan Rogers, 40, was outside the sheriff’s home just prior to Rogers reportedly throwing what was described as a crude explosive device toward the house. Rogers, who was free on bond after being arrested recently on numerous felony charges, fled from the property while Sheriff Bell extinguished the fire.

 

About 1:40 AM, sheriff’s deputies from the Randolph County and Lawrence County sheriff’s departments encountered Rogers driving west on U.S. Highway 62 toward Pocahontas and attempted to stop the suspect who fled from the deputies, then began firing a gun at deputies who returned fire.

 

The pursuit covered approximately 15 miles and Rogers was apprehended at 1:57 AM near Blacksferry Lane west of Pocahontas when deputies used a precision intervention technique to stop the vehicle.

 

No law enforcement officer, nor Rogers was injured.

 

Rogers is being held at the Lawrence County Jail while state police special agents continue their investigation.

 

On Saturday, Sheriff’s Department employee Kristy Marie Taylor was found dead in the driveway of her home at 3012 Farmwood Road southwest of Salem just before 6 PM. It is not known if Rogers is a suspect in the death of Taylor.

NSW Premier Dominic Perrottet’s crime family, which includes brothers Jean-Claude and money launderer Charles, exposed

 

NSW Premier Dominic Perrottet’s brothers Charles and Jean-Claude, who operate behind the scenes in the Liberal Party trying to turn a dollar, were accused of further crimes such as branch stacking and taking bribes on last Monday’s Four Corners (4/7/22) show but the old media have gone into cover-up mode.

 

A quick internet search shows this is not the first time they have been accused of crimes with Charles being accused in 2014 at the NSW ICAC of money laundering donations for the Liberal Party and Jean-Claude being acquitted of rape by a jury in the NSW District Court in 2017.

A New South Wales Liberal MP has denied putting a property developer in touch with the alleged Liberal party slush fund at the centre of a corruption inquiry.

 

In a brief but colourful appearance at the Independent Commission Against Corruption (ICAC), upper house MP Marie Ficarra referred to her miniature schnauzer’s medical problems, a trip to the Cumberland state forest to buy a particular plant and, eventually, the matters at hand. Ficarra insisted she told property developer Tony Merhi in a March 2011 meeting that as a property developer, he was banned from donating to the party.

 

She directed one of his non-prohibited friends to give money to the Young Liberals instead, she said. “He had plenty of friends who wanted to see the Liberal party win… It wasn’t anything sinister at all,” Ficarra said.

 

Ficarra told the commission the meeting was held at a cafe in the Cumberland state forest because there was a garden nursery nearby. “I had to buy westringias,” she said.

 

Earlier, Merhi had told the inquiry he had spoken to Ficarra about potential amendments to planning laws that could affect his business. He said Ficarra had told him he might need a lobbyist, and mentioned a company called Eightbyfive.

 

Shortly after, a man called with the bank details for Eightbyfive, Merhi said. Records show a $5,000 donation was made by Merhi to the company in the following days.

 

The commission is investigating allegations that Eightbyfive was a slush fund set up by a former Chris Hartcher staffer, Tim Koelma, to funnel illegal donations to the Liberal party. Donations from property developers have been banned in NSW since 2009.

 

Ficarra stepped down from the party earlier this month after the corruption claims emerged.

Australian Covid Data Biases and Manipulation – If This “Vaccine” Is So Great, Why Do You Need To “Fix” The Data?

 

Well, roll on a few months and pretty much the whole adult population of NSW is “vaccinated.” The official stats are that as of today, according to their own data, 95% of NSW people aged over 15 have received 2 doses of a “covid vaccine” – mostly mRNA therapies.

 

There was just one problem. The hospitalisation data are confounded by a diagnostic bias. The same bias was seen in the UKHSA data which preceded NSW health’s data by a few months because Australia was relatively late to the vaccine party. The bias means that when somebody arrives in hospital (with any condition) who is unvaccinated they are more likely to be tested for Covid-19 than if they were vaccinated. This arose out of a false belief (later ditched) that the vaccine prevented infection, so obviously the higher quality “clean” patients didn’t need testing (for the reference to clean vs unclean please see my friend Filipe Rafaeli’s excellent article on the Warsaw Ghetto).

 

There was another bias in that data which also related to the fraudulent miscategorisation of recently vaccinated people as “partially vaccinated” or “unvaccinated” for weeks after their vaccine and so the hospitalisation figures for this category took a while to catch up – but catch up they did. In fact, it got so bad that by November the vaccine surveillance reports had to push the figures by vaccination status all the way to the end of the report (just like the UKHSA did), and despite it being a relatively quiet time for Covid-19 infections, the proportion of cases who had received any vaccination had jumped to 63% of the total cases (of those whose status was known).

Condoleezza Rice joins ownership group of the Denver Broncos

 

Former Secretary of State Condoleezza Rice announced on Monday that she was joining the ownership group of the Denver Broncos professional football team.

 

Rice tweeted a statement about the ownership deal.

 

"It is an honor to be part of this ownership group. Football has been an integral part of my life since the moment it was introduced to me, and I am thrilled to be a part of the Broncos organization today," Rice wrote.

 

"I spent much of my younger years in Denver, so to be able to combine my love of the game with my love for this great city and team is an adventure of a lifetime and a great opportunity," she concluded.

 

Rob Walton, the billionaire heir to the Walmart fortune, also released a statement on behalf of the Walton-Penner family ownership group.

 

"We're pleased to welcome former Secretary of State Condoleezza Rice to our ownership group. A highly respected public servant, accomplished academic and corporate leader, Secretary Rice is well known as a passionate and knowledgeable football fan who has worked to make the sport stronger and better," read the statement.

 

Walton went on to relate the many ties Rice has to Denver, Colorado. She moved to Denver with her family when she was 12 years old and later graduated from the University of Denver.

 

"Her unique experience and extraordinary judgment will be a great benefit to our group and the Broncos organization," Walton concluded.

 

Rice served as secretary of state in the George W. Bush administration from 2005 to 2009.

 

Rice made headlines in 2021 when she argued eloquently and logically against critical race theory while appearing as a guest on "The View," despite the rhetorical abuse some on the left heaped on her.

Cooperation with Mexico results in Treasury sanctions of arms trafficker tied to major drug cartel following HSI Nogales, multiagency investigation

 

CJNG member operating along US-Mexico border moves high-caliber firearms, ammunition southbound into Mexico

 

NOGALES, Ariz. – The U.S. Department of the Treasury’s Office of Foreign Assets Control (OFAC) designated an individual engaged in the trafficking of high-caliber firearms from the United States to one of Mexico’s most powerful drug organizations as a result of a Homeland Security Investigation (HSI) and multiagency probe. This action would not have been possible without the cooperation and support of the Government of Mexico (GoM) and the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF). Today’s action is the result of ongoing efforts by U.S. agencies and the GoM to disrupt Mexican drug trafficking organizations’ procurement of weapons, including those sourced in the United States.

 

OFAC designated Obed Christian Sepulveda Portillo (Obed Sepulveda), pursuant to Executive Order (E.O.) 14059 for acting for or on behalf of the Cartel de Jalisco Nueva Generacion (CJNG), a violent drug trafficking organization based in Mexico responsible for a significant proportion of fentanyl and other deadly drugs trafficked into the United States.

“Cartels exist for one reason and one reason only – to generate a profit. The CJNG is no exception and has demonstrated they will go through great lengths, costing lives, in efforts to further their control,” said Scott Brown, special agent in charge, for HSI Phoenix. “As a border state, we see first-hand how these criminal organizations continue their attempts to smuggling narcotics and contraband through our shared border. With the coordination of our partnered agencies, HSI is committed to end the plague that is CJNG.”

 

Portillo, a Mexican national, was designated for, being directed by, or acting or purporting to act for or on behalf of, directly or indirectly, CJNG. Portillo coordinated the daily procurement of firearms and bulk ammunition from the U.S. southwest border into Mexico through a network of individuals working directly with CJNG.

 

“CJNG’s power and violence are only possible because of its ability to obtain high-powered weapons, which are used to protect drug trafficking routes, territory, and other illicit assets,” said Under Secretary of the Treasury for Terrorism and Financial Intelligence Brian E. Nelson. “Treasury is actively targeting those who support and supply drug trafficking and criminal organizations, especially those engaged in the production and distribution of synthetic opioids that claim the lives of tens of thousands of Americans each year.”

Previous Actions Against CJNG

 

On April 8, 2015, OFAC designated CJNG and its leader, Oseguera Cervantes, pursuant to the Foreign Narcotics Kingpin Designation Act (Kingpin Act) for playing a significant role in international narcotics trafficking. On Dec. 15, 2021, OFAC also designated CJNG and Oseguera Cervantes pursuant to E.O. 14059. OFAC has also designated a wide range of businesses and individuals that play critical roles in CJNG’s drug trafficking activities.

Sanctions Implications

 

As a result of today’s action, all property, and interests in property of this designated individual that are in the United States or in the possession or control of U.S. persons must be blocked and reported to OFAC. OFAC’s regulations generally prohibit all transactions by U.S. persons or persons within (or transiting) the United States that involve any property or interests in property of designated or otherwise blocked persons. As with any provision of goods or services, including firearms, unlicensed transactions, or dealings by U.S. persons for the direct or indirect benefit of any designated drug trafficking organization are prohibited. U.S. persons may face civil or criminal penalties for violations of these sanctions.

 

These actions are part of a whole-of-government effort to counter the global threat posed by the trafficking of illicit drugs into the United States that is causing the deaths of tens of thousands of Americans annually, as well as countless more non-fatal overdoses. OFAC, in coordination with its U.S. government partners and foreign counterparts, will continue to target and pursue accountability for foreign illicit drug actors.

 

U.S. sanctions need not be permanent; sanctions are intended to bring about a positive change of behavior. Consistent with the findings of Treasury’s 2021 Sanctions Review, the removal of sanctions is available for persons designated under counter narcotics authorities who demonstrate a change in behavior and no longer engage in activities linked to international illicit drug trafficking or other sanctionable activity.
