Dissent In WI Ballot Drop Box Victory Highlights Much Bigger Issue: Our Top Jurists Don’t Care About Election Integrity

The Wisconsin Supreme Court on Friday held that state election officials’ use of some 500-plus drop boxes during the 2020 general election violated Wisconsin law.

While the court’s decision represents a (partial, as we will soon see) victory for election integrity, the split 4-3 decision and the substance of the dissent reveal that having a fair electoral process no longer “transcends any individual partisan interest” — something less than two decades ago Jimmy Carter touted as a universal truth in the bipartisan Commission on Election Reform report “Building Confidence in U.S. Elections.”

In Teigen v. Wisconsin Elections Commission, the court declared that the Wisconsin Elections Commission, or “WEC,” had illegally authorized election officials to use ballot drop boxes. The high court further held the WEC exceeded its statutory authority when it declared that voters could hand off their ballots to third parties rather than personally deliver their own ballots to election officials. The WEC had authorized ballot drop boxes and third-party ballot delivery in two documents issued in 2020, one in the spring before the primary election and the second before the November 2020 general election.

In the first memo, the WEC stated, “[Ballot] drop boxes can be used for voters to return ballots but clerks should ensure they are secure, can be monitored for security purposes, and should be regularly emptied.” That memo also noted that “[a] family member or another person may … return the [absentee] ballot on behalf of a voter.”

Several months later, in the summer of 2020, the WEC issued a second document that encouraged “creative solutions” to allow for the use of ballot drop boxes. The second memo expressly provided that municipal clerks could allow drop boxes to remain “unstaffed,” and indicated that “[a]t a minimum, you should have a drop box at your primary municipal building, such as the village hall.” Based on the WEC’s guidance, election officials used some 528 drop boxes during the fall 2020 election. By the spring of 2021, some 570 drop boxes dotted the midwestern state.

Two voters filed suit challenging the WEC’s guidance, arguing the rules violated the Wisconsin election code. The voters prevailed at the trial court level and the WEC appealed, with the voters asking the Wisconsin Supreme Court to take the case immediately, bypassing the intermediate appellate court. The high court agreed and heard oral arguments in April 2022 and affirmed the lower court’s decision in favor of the voters on Friday.

The Wisconsin Supreme Court’s opinion methodically marched through the various legal issues, beginning with the question of whether the voters had standing to sue to challenge the WEC’s guidance. The court in Teigen concluded that the plaintiffs had standing to sue because they sufficiently alleged they had “suffered an injury in fact to their right to vote.”

Arkansas Sheriff’s Home Firebombed After Department Employee Found Dead In Her Driveway: Officials

RANDOLPH COUNTY, Ark. – The Randolph County Sheriff’s Department has requested the Arkansas State Police investigate a series of events that occurred early today that began when a Biggers community resident attempted to firebomb the local sheriff’s residence.

The incident comes two days after a 57-year-old local county sheriff’s department employee was found fatally shot at her home.

Sheriff Kevin Bell was alerted about 1:30 AM that Bryan Rogers, 40, was outside the sheriff’s home just prior to Rogers reportedly throwing what was described as a crude explosive device toward the house. Rogers, who was free on bond after being arrested recently on numerous felony charges, fled from the property while Sheriff Bell extinguished the fire.

About 1:40 AM, sheriff’s deputies from the Randolph County and Lawrence County sheriff’s departments encountered Rogers driving west on U.S. Highway 62 toward Pocahontas and attempted to stop the suspect who fled from the deputies, then began firing a gun at deputies who returned fire.

The pursuit covered approximately 15 miles and Rogers was apprehended at 1:57 AM near Blacksferry Lane west of Pocahontas when deputies used a precision intervention technique to stop the vehicle.

No law enforcement officer, nor Rogers was injured.

Rogers is being held at the Lawrence County Jail while state police special agents continue their investigation.

On Saturday, Sheriff’s Department employee Kristy Marie Taylor was found dead in the driveway of her home at 3012 Farmwood Road southwest of Salem just before 6 PM. It is not known if Rogers is a suspect in the death of Taylor.

The Biden admin appears to be seeking to influence state election laws.

It is imperative for a free society governed by democratically elected officials to ensure that its elections are secure and that they accurately reflect the will of the people. After all, voting fraud is the great destroyer of public trust. Therefore, any government worthy of the people’s trust will do everything in its power to prevent election fraud, quickly investigate any instance of potential impropriety, and prosecute without any prejudice those charged with having engaged in a crime.

The Biden administration does not run that kind of government.

Those who deny the existence of election fraud or even downplay such criminal activity as insignificant are either ignorant or sinisterly justifying it. Too often the argument has been along the lines of, If the fraud didn’t turn enough votes to change the outcome of an election, then it really isn’t a major problem worth addressing. Unfortunately, this laissez-faire attitude not only encourages the problem but serves as a fundamental misunderstanding of the human behavior of which our nation’s Founding Fathers were all too wary.

Humanity is not, as so many ignorantly assert, mostly good. The reality of life tells the exact opposite story. Humanity, if permitted, is downright evil. Take a look at the daily news headlines if you need convincing. Therefore, the claim that concerns over potential election shenanigans are unfounded or overblown is either ignorance or a calculated denial for the express purpose of preventing any effective policing of elections.

It’s one thing if it is a non-politically affiliated individual making allegations largely out of ignorance. But it’s another thing entirely when it is politicians making dubious assertions. Thus, when a political party goes to bat for the sake of “expanding” voting rights while at the same time denying the existence of fraud, that should be a big red flag.

But that’s just the game the Biden administration has been playing. On the one hand, it’s suggesting that anyone questioning the outcome of the 2020 election is promoting a wild fact-free conspiracy. On the other hand, it’s ridiculously claiming that states which have recently passed election integrity laws are “threatening democracy.” Of course, the most absurd objection raised by Joe Biden and Democrat lawmakers is their opposition to voter ID rules. This objection more than any other gives away their real motive: They simply don’t want a secure election in which the American public can be assured that fraud has been eliminated to the greatest extent possible.

Biden may wax not-so-eloquent about “protecting” voting rights, but his administration’s efforts belie this claim. Thanks to information obtained via Freedom of Information Act requests, it has recently been reported that the Biden administration has been working with a leftist group — Democracy Fund — to establish connections across the federal government and state governments to promote the establishment of dubious and unsecure voting practices such as bulk-mail balloting.

To put it simply, the Biden administration is engaged in what appears to be a thinly veiled form of electioneering with the obvious goal being to tip the scales in favor of Democrat candidates.

The federal government being so engaged in state election protocols is a violation of Article I, Section 4 of the U.S. Constitution, which grants control and administration of elections to each state government. Ergo, the Biden administration injecting itself into these processes is yet further evidence that no matter how much Biden claims to be seeking to protect democracy, he’s doing the exact opposite. And, evidently, his administration is not above using electioneering to get it done.

Biden’s Bid to Take Over Our Elections

Federal power grabs can and should be deterred by the states

Since when is it the prerogative of the president to get out the vote? Yet this is exactly what President Joe Biden has been fighting for. In March 2021, he signed an executive order spurring 600 federal agencies to come up with plans on how to fuel voter registration and voter turnout.

These plans were to be submitted nine month ago to Susan Rice, head of the White House’s Domestic Policy Council. Rice was President Barack Obama’s national security advisor and had her hand in every scandal of that administration including Benghazi, spying on Donald Trump, and the disgraceful swap of jihadis for deserter Bowe Bergdahl. Needless to say, she is heavily partisan in her political views and is not above lying for political ends. The public, despite concerted efforts and invoking the Freedom of Information Act, has been blocked or unanswered in their requests to see the proposed plans.

Mollie Hemingway of The Federalist accurately states: “It’s unethical to tie federal benefits to election activity. It’s unconstitutional to have the federal government take authority that belongs to the states and which Congress has not granted. And, given that all 50 states have different laws and processes governing election administration, it’s a recipe for chaos, confusion, and fraud at a time when election security concerns are particularly fraught.”

Good government watchdog organizations — ones like the Center for Renewing America and the Foundation for Government Accountability — are calling on state governments to fight this federal overreach.

Two representatives from these organizations said, “Order [state officials] not to implement that guidance [from the federal agencies] because it is illegal at worst and unethical and partisan at best.”

Another aspect of this secret get-out-the-vote operation that can’t be hushed is the Department of Justice and Biden’s immediate pouncing on states that seek to improve their voter integrity laws. Take Georgia — the pushback from the Democrats was so extreme that they called its new voter integrity law “Job Crow 2.0” and got Major League Baseball’s All-Star Game moved from Atlanta in protest. Biden also lumped Texas and its voter integrity law in with the canard of “Jim Crow 2.0.” It felt like some kind of divine justice that the World Series was played by the Atlanta Braves (who won) and Houston Astros. Now Arizona is currently fighting the DOJ because it has a voter law that demands voters actually be U.S. citizens.

It follows the overall pattern that we have been subject to. When leftists can, they grab as much federal power as humanly possible. That’s also why they were deeply angry when the Supreme Court overturned Roe v. Wade and returned the power back to the states. Ultimately, any loss of federal power is egregious to them.

President Biden and his administration are playing a devious and underhanded game involving the upcoming elections. With a country already suspicious that there were unscrupulous dealings and cheating involved in the 2020 election, this continued ominous silence from the feds is not an encouraging sign.

A ranking FBI cyber official said during testimony on Tuesday that he has no idea where Hunter Biden’s laptop the bureau reportedly confiscated in 2019 is currently located.

“So where is it? The Laptop?” Rep. Matt Gaetz (R-Fla.) asked Assistant Director of FBI Cyber Division, Bryan A. Vorndran, who responded that he did not have “any information” on its whereabouts.

He went on to testify that he didn’t know where the laptop is, nor does he even know who should know the whereabouts of the laptop, according to PJ Media.

Gaetz at one point held up a copy of a receipt showing that in December 2019 the laptop was turned over to FBI agents by a computer repair shop in Delaware.

The Florida Republican then mentioned information regarding “international business deals, kickbacks, and shakedowns” that could potentially harm the Biden family including President Joe Biden.

“Has anyone at FBI Cyber been asked to make assessments whether or not the laptop creates a point of vulnerability?” Gaetz asked, but Vorndran did not directly respond to the question.

That led to a chuckle from Gaetz, who then continued: “Have you assessed whether or not the first family is compromised as a result of the Hunter Biden laptop?”

But the FBI official again sidestepped the question.

“So you don’t have it, you don’t know who has it, you don’t know where it is, you’re the assistant director. You know, earlier you talked about whether or not you were the Grant Hill or the Christian Laettner; it sounds you’re the Chris Webber, trying to call a time out when you don’t have one,” Gaetz chastized, referring to a pair of legendary college basketball games.

“Sir, again, we can do this back and forth for the next couple of minutes,” Vorndran stammered. “I don’t have any information on the Hunter laptop.”

“Do you know who we should put in that chair to ask these questions to?” Gaetz pressed, but the FBI official did not have an answer.

“Can you find out?” the Florida lawmaker asked.

“I will be happy to take your request back to FBI headquarters,” Vorndran said.

At that, Gaetz held up a thumb drive and said, “Mr. Chairman, I seek unanimous consent to enter into the record of this committee, the contents of Hunter Biden’s laptop, which I am in possession of.”

But the chair, Rep. Jerrold Nadler (D-N.Y.), refused, telling Gaetz, “I’m not .… I will object pending further investigation.”

A New South Wales Liberal MP has denied putting a property developer in touch with the alleged Liberal party slush fund at the centre of a corruption inquiry.

In a brief but colourful appearance at the Independent Commission Against Corruption (ICAC), upper house MP Marie Ficarra referred to her miniature schnauzer’s medical problems, a trip to the Cumberland state forest to buy a particular plant and, eventually, the matters at hand. Ficarra insisted she told property developer Tony Merhi in a March 2011 meeting that as a property developer, he was banned from donating to the party.

She directed one of his non-prohibited friends to give money to the Young Liberals instead, she said. “He had plenty of friends who wanted to see the Liberal party win… It wasn’t anything sinister at all,” Ficarra said.

Ficarra told the commission the meeting was held at a cafe in the Cumberland state forest because there was a garden nursery nearby. “I had to buy westringias,” she said.

Earlier, Merhi had told the inquiry he had spoken to Ficarra about potential amendments to planning laws that could affect his business. He said Ficarra had told him he might need a lobbyist, and mentioned a company called Eightbyfive.

Shortly after, a man called with the bank details for Eightbyfive, Merhi said. Records show a $5,000 donation was made by Merhi to the company in the following days.

The commission is investigating allegations that Eightbyfive was a slush fund set up by a former Chris Hartcher staffer, Tim Koelma, to funnel illegal donations to the Liberal party. Donations from property developers have been banned in NSW since 2009.

Ficarra stepped down from the party earlier this month after the corruption claims emerged.
