Doctor who treated child rape victim sues Indiana attorney general

Dr. Caitlin Bernard, an Indiana doctor who treated a 10-year-old Ohio rape victim, sent Indiana Attorney General Todd Rokita notice of her intent to sue him.

 

Bernard previously warned Rokita to "cease and desist," arguing the attorney general's claims that she did not report performing an abortion on the 10-year-old Ohio victim were defamatory. She has insisted that she adequately reported the abortion in compliance with state law.

 

"Statements that Dr. Bernard has a 'history of failing to report,' which Mr. Rokita indicated would constitute a crime, made in the absence of reasonable investigation, serve no legitimate law enforcement purpose," Bernard's tort claim notice argued. "Mr. Rokita’s comments were intended to heighten public condemnation of Dr. Bernard."

 

The notice lays the groundwork for a lawsuit and allows for a 90-day period for the state to investigate or settle the claim, and then a lawsuit "alleging a tort against the state" can be brought forth, according to the notice. The total dollar amount of damages "is not ascertainable at this time, as the harm is ongoing," the notice further explains.

 

Bernard contends that Rokita's public statements have harmed her reputation and could mislead her patients about her work.

 

“And then we have this abortion activist acting as a doctor with a history of failing to report,” Rokita told Fox News's Jesse Watters. “We’re gathering the evidence as we speak, and we’re going to fight this to the end, including looking at her licensure. If she failed to report it in Indiana, it’s a crime for — to not report, to intentionally not report.”

 

Bernard also underscored that Rokita falsely claimed she has a "history of failing to report," pointing out that he could have checked her license history.

 

"Mr. Rokita either knew the statements were false or acted with reckless disregard of the truth or falsity of the statements. Mr. Rokita recklessly and/or negligently failed to ascertain whether the statements about Dr. Bernard’s license were true or false before making them," the notice continued.

 

The 10-year-old Ohio victim became subject to a media firestorm amid the intensified national debate over abortion. About a week after the Supreme Court overturned precedents guaranteeing a national right to abortion access first established in Roe v. Wade, the 10-year-old girl crossed into neighboring Indiana to receive an abortion, according to reports referenced by President Joe Biden and others.

 

An Ohio law permitted to go into effect after the Supreme Court ruling prohibits abortion after fetal heartbeats are detected, which can take place as early as six weeks of gestation. The 10-year-old girl was six weeks and three days pregnant at the time, the Indianapolis Star reported. She was raped by a 27-year-old man, who has since been arrested and charged with rape, per police.

 

The Washington Examiner reached out to a spokesperson for Rokita for comment.

 

Initially, fact-check organizations, including the Washington Post, struggled to verify key details of the story about the Ohio rape victim, leading to scrutiny of Bernard, who had been a source for the initial report. Since then, police announced charges against the alleged rapist, and reports indicated that Bernard reported that she performed the abortion.

 

Rokita recently announced plans to investigate whether Bernard violated state law by failing to report that she had performed the abortion on the victim. Her employer, Indiana University Health, conducted a review that concluded she did not flout state privacy laws. But Rokita has subsequently saidhis investigation would "remain open" despite reports that she had complied with state law.

As much as the media and Democratic leaders have tried to hide the issue, not only are most voters paying attention to first son Hunter Biden’s money scandals, but they believe President Joe Biden cashed in and that they won’t face any charges.

 

In a series of new questions about Hunter Biden’s dealings with Chinese firms, 62% said that the president “personally profited from deals with Chinese-government connected companies.”

 

And, according to the latest Rasmussen Reports survey, 56% see no chance of federal charges for the questionable deals.

 

“Most voters don’t believe the president’s denials,” said Rasmussen, noting that 69% said they believe that the president was aware of at least some of his son’s foreign dealings dating back to when Joe Biden was vice president under former President Barack Obama.

 

“Last month, it was reported that voicemails retrieved from Hunter Biden’s abandoned laptop computer showed him discussing his Chinese deals with his father in 2018. Sixty-two percent (62%) of voters believe Joe Biden personally profited from deals with Chinese-government connected companies, including 44% who think it’s very likely. Thirty percent (30%) don’t believe it is likely that the president profited from his son’s Chinese deals,” read the poll analysis.

 

And while the president's son has acknowledged that he is being investigated, most do not believe he will face charges.

 

What is especially interesting about the survey of likely voters is how many know about the scandals despite a near blackout from the legacy media.

 

Rasmussen found that66% are paying close attention to the Hunter Biden story, including a majority of Democrats.

Army personnel could be more than 25,000 short at end of fiscal year

Army Vice Chief of Staff Gen. Joseph Martin told the House Armed Services Committee on Tuesday that the service branch's size at the end of the fiscal year will be more than 20,000 troops below their target.

 

Martin confirmed that the Army told a House military personnel panel that it believes it will have between 445,000 and 452,000 troops by the end of September. If that comes to fruition, it would be a significant shortfall of between 21,000 and 28,000 soldiers because the target is 473,000.

 

He said they believe they will “land at [466,000]” for the year. The service’s target goal for the year was originally 485,000 but cut it by 12,000 in April when it was clear it would fall short.

 

All service branches are currently going through a tough recruiting patch in part due to the coronavirus pandemic because they were no longer going to high schools or public events to recruit young adults. Another reason recruitment is low is that a smaller percentage of the country is eligible to serve. He said thatonly 23% is available to serve, which is down from 29%,though the source of that figure is unclear.

 

“The why of what we think's going on right now is we've got unprecedented challenges with both a post-COVID-19 environment and labor market, but also private competition with private companies that have changed their incentives over time,” he told members on the subcommittee.

 

Rep. Jackie Speier (D-CA) was the lawmaker who asked about the Army’s end-of-year strength posture, and after Martin's comments, remarked that they “might need to have a subsequent hearing on this because it’s pretty serious.”

 

The Army has made a series of rule changes to attempt to attract more recruits, including relaxing its tattoo policy, offering higher bonuses, and reducing the length of contracts. Earlier this month, they also reversed a new policy announced in June that allowed the high school diploma or GED requirement to be waived on some applicants hoping to enlist.

Secret Service has no new texts to deliver to Jan. 6 committee: Report

On Tuesday, the National Archives and Records Administration requested the Secret Service investigate whether text messages from the period in question were "improperly deleted." The National Archives gave the agency 30 days to report back its findings and discuss actions it undertook to "salvage, retrieve, or reconstruct the records."

 

"The United States Secret Service respects and supports the important role of the National Archives and Records Administration in ensuring preservation of government records. They will have our full cooperation in this review," Anthony Guglielmi, chief of communications for the Secret Service, tweeted.

 

The agency did not maliciously purge text message material but lost the material due to a "device-replacement program," Guglielmi previously stressed. The replacement program began about a month before the Department of Homeland Security’s Office of Inspector General sought those records, according to Guglielmi. The OIG made shockwaves last week when it informed the Jan. 6 committee that Secret Service text messages from Jan. 5-6, 2021, had been erased.

 

"DHS OIG requested electronic communications for the first time on Feb. 26, 2021, after the migration was well underway. The Secret Service notified DHS OIG of the loss of certain phones’ data, but confirmed to OIG that none of the texts it was seeking had been lost in the migration," Guglielmi told the Washington Examiner last Thursday.

 

Guglielmi contended that some data had been lost but suggested “none of the texts” the OIG was after had been missing, the Washington Post reported. This prompted the Jan. 6 committee to subpoena the Secret Service for text messages from during the period in question.

 

The Washington Examiner reached out to representatives for the Secret Service and Jan. 6 committee for comment.

 

Secret Service text messages could shed light on what transpired behind the scenes on or before the day of the Capitol riot. Last month, former White House aide Cassidy Hutchinson testified at a public Jan. 6 committee hearing that former President Donald Trump attempted to commandeer a Secret Service vehicle and lunged at an agent. Those claims have been disputed by Trump and reportedly by her source, Robert Engel, the special agent in charge at the time.

 

The Jan. 6 committee is slated to hold another public hearing Thursday focusing on Trump's actions while the Capitol riot unfolded.

Garland's deputy vows DOJ investigation into Capitol riot won't be obstructed

A top Justice Department official pledged the agency's efforts to investigate the Capitol riot will not be hamstrung.

 

Deputy Attorney General Lisa Monaco made the assertion as questions are being raised about whether the Justice Department will go easy on former President Donald Trump, as he is widely expected to enter the 2024 fray, and sources told Rolling Stone that Trump informed confidants that it can be difficult for prosecutors to "get to you" as president.

 

“We’re going to continue to do our job, to follow the facts wherever they go, no matter where they lead, no matter to what level,” Monaco said on Tuesday, per the Hill. “We’re going to continue to investigate what was fundamentally an attack on our democracy,” she continued.

 

Monaco made her remarks during a cybersecurity conference in New York one day after MSNBC host Rachel Maddow raised the alarm in revealing a Justice Department memo, signed by Attorney General Merrick Garland, reaffirming a Trump-era order placing extra requirements on investigations into candidates in an election year.

 

Still, top DOJ officials took a pledge to investigate cases and follow the facts wherever they may go, Monaco stressed. “The mandate the team has remains, which is to follow the facts wherever they go, regardless of what level, regardless of whether the subject of those investigations were present on Jan. 6,” Monaco continued.

 

Traditionally, the Justice Department seeks to refrain from implicating major presidential hopefuls during the 60 days before an election, however, the 60-day rule is not a written policy.

 

So far, the DOJ has prosecuted over 850 related to the storming of the Capitol on Jan. 6, 2021. Prosecutors have also issued subpoenas and reportedly expressed interest in individuals who promoted the use of an alternate slate of electors that could be deployed to swing the election to Trump in the event that his legal challenges prevailed.

 

Allies of Trump are also being investigated by the House Jan. 6 committee and facing legal scrutiny from the district attorney in Fulton County, Georgia. The Jan. 6 committee is slated to give its second prime-time hearing of the summer Thursday with a focus on Trump's activities behind the scenes when the Capitol riot unfolded.

 

Trump told New York Magazine that he has "already made that decision" on whether he will throw his hat in the ring for 2024, the remaining question left for him is when he will make the announcement.

Facing intense public scrutiny for his ideological efforts, Manhattan DA Alvin Bragg has dropped charges against the 61-year-old Latino bodega owner who defended himself against a violent attack by the black boyfriend of an angry customer.

 

The entire episode, including the ridiculous charges against Jose Alba, was fraught with racist undertones from the district attorney’s office.

 

NEW YORK – After intense backlash from local bodega workers and city tabloids, Manhattan district attorney Alvin Bragg on Tuesday dropped all charges against bodega clerk Jose Alba, who was allegedly acting in self-defense when he fatally stabbed a man who was attacking him.

 

The liberal DA’s decision comes after weeks of criticism of Bragg’s decision to send the 61-year-old to Riker’s Island and charge him with second-degree murder in the death of 35-year-old Austin Simon. Bragg first requested Alba’s bail be set at $500,000 before it was lowered to $50,000 in response to criticism from the community. He was later released on a $5,000 bail bond.

 

Video obtained by the New York Post seems to show Simon advancing on Alba at the bodega where Alba works and violently shoving him against a wall after his girlfriend’s credit card was rejected while trying to buy a bag of chips. Alba could be heard in the video trying to diffuse the situation as Simon walked behind the counter, saying, “Papa, I don’t want a problem, papa.”

 

While Alba initially tried to walk away from Simon after being shoved, video shows, a struggle between the two men ensued and Alba stabbed Simon repeatedly. The video seems to show Simon’s girlfriend pulling a knife from her purse and attempting to grab Alba’s arm as he stabbed her boyfriend. She then stabbed Alba.

 

Bragg’s office said Tuesday that “a homicide case against Alba could not be proven at trial beyond a reasonable doubt” after further investigation. (read more)

A mass shooter named Douglas Sapirman opened fire at the Greenwood Park Mall in Greenwood, Indiana, shooting three people before he was stopped by a 22-year-old who reacted in seconds after the shooting started.

 

22-year-old Elisjsha Dicken (pictured left) told his girlfriend to get under a table at the mall food court, then engaged the gunman using his pistol. Dicken fired ten shots, killing the gunman who was armed with a long rifle as he attempted to retreat. Police are hailing young Mr. Dicken as a hero who likely saved the lives of many.

His actions were nothing short of heroic. He engaged the gunman from quite a distance with a handgun. Was very proficient in that, was tactically sound and as he moved to close in on the suspect, he was also motioning for people to exit behind him,” Ison said about Dicken’s actions. “Many people would have died last night if not for a responsible armed citizen that took action very quickly within the first two minutes of this shooting.”

 

Dicken has not yet spoken with the media about the shooting. However, his lawyer Guy A. Relford released a statement on Monday that said Dicken is waiting to speak about the shooting to respect the lives lost and the police’s investigation.

3 killed, shooter and 'good Samaritan' identified in Greenwood Park Mall mass shooting

GREENWOOD, Ind. — Police are investigating a shooting at Greenwood Park Mall that happened around 6 p.m. Sunday.

 

Four people are dead and police tell 13News the shooter is among those killed.

 

Those killed are 56-year-old Pedro Pineda, his wife 37-year-old Rosa Mirian Rivera de Pineda and 30-year-old Victor Gomez. All died off multiple gunshot wounds, according to autopsy reports released July 19

 

The shooter was identified as 20-year-old Jonathan Douglas Sapirman of Greenwood.

 

Police said Sapirman had two rifles, a handgun and several magazines of ammunition, but he only used one of the rifles.

 

Police said Sapirman entered the mall at 4:54 p.m. on July 17. He immediately entered the bathroom at the food court and stayed there for an hour and two minutes. His cell phone was found submerged in a toilet in the bathroom.

 

As Sapirman left the bathroom, he began shooting, causing chaos at the mall.

 

Police said Sapirman fired 24 rounds during the shooting. People inside the mall at the time of the shooting told 13News reporter Logan Gay that they heard 20 gunshots in the food court. An IMPD spokesman said it appears shots were only fired in the food court area.

 

Sapirman first shot and killed Gomez. Then he fired into the food court hitting and killing the Pinedas. He fired more shots into the food court area and wounded a 22-year-old woman in the leg and a bullet fragment hit a 12-year-old girl in the back.

 

"This has shaken us to our core. This isn't something we've seen in Greenwood before. It is absolutely horrendous," Greenwood Police Chief Jim Ison said. He went on to say that they have trained for active shooter situations like this and he was proud of the response from law enforcement.

 

Armed bystander hailed as hero

 

At 5:57 p.m., Elisjsha Dicken, an armed bystander, fired on Sapirman. Dicken fired 10 rounds hitting Sapirman as Sapirman tried to retreat into the bathroom but collapsed and died.

 

An autopsy found Sapirman was shot eight times and none were self-inflicted. (Wow he shot 10 and 8 hit the shooter)

Investigation into the gunman

 

Police said Sapirman left his job at a warehouse in May and police are investigating statements from the family saying he was set to be evicted from his apartment.

 

Greenwood PD said there is no information yet on a motive for the shooting. Police said they are not aware of any history of mental illness involving Sapirman. His juvenile record included a fight at school and runaway incident. He has no criminal record as an adult.

 

People who knew Sapirman said he had been shooting at a local gun range prior to the mass shooting.

 

13News confirmed a search was conducted early Monday at a residence in the Polo Run Apartments in connection to the shooter. Police said they found the oven on at a high temperature and there was a laptop in it along with a can of butane….

13 Investigates has compiled a timeline of events for the mass shooting inside Greenwood Park Mall based on reports from Greenwood police and radio traffic from Johnson County emergency services agencies.

4:54 p.m. – The shooter entered the mall and went straight to a bathroom near the food court, according to Greenwood Police.

5:56:48 p.m. – The shooter emerged from the restroom and began shooting, killing three people and injuring several others, Greenwood Police report.

5:56 p.m. – Johnson County emergency dispatchers begin receiving phone calls from mall patrons and workers. “They’re advising there’s a male shooter. He’s possibly in the food court at this time. More than a dozen people,” the dispatcher reported.

5:56 p.m. – A police officer reports seeing people running out into the mall parking lot.

5:57 p.m. – An ambulance and other emergency response vehicles were dispatched to the mall.

 

5:57:03 p.m. – An armed mall patron engages the shooter by returning gunfire. Just 15 seconds after the shooting began, police say the shooter was killed. (Police would not learn the shooter was dead for several more minutes.)

5:57 p.m. – Dispatchers report receiving additional 911 calls about the shooting, including a description of a weapon. “We’re getting several calls from Johnson County. Possible active shooter at the Greenwood Park Mall. Several subjects. Possible AK-47,” said the dispatcher.

5:58 p.m. – Dispatchers share more information, including how many victims EMS crews might find inside the mall. “So far, possibly three. We’re still, our phone lines are still all lit up. We’re still just trying to gather information. They’re not hearing shots at this time. They’re possibly by the food court. So far, we’ve got at least three,” a dispatcher told EMS crews. A supervisor responds, “OK, give me three more ambulances,” and more paramedics and emergency vehicles are dispatched.

6:01 p.m. – Still unaware if a shooter is at large, emergency medical crews establish a command post and staging area in the parking lot, outside Von Maur and Dicks Sporting Goods.

6:06 p.m. – Based on confirmation from police, EMS declares the scene a “mass casualty” situation.

6:07 p.m. – Paramedics wait for police protection to enter mall food court area. “Ok, we’re not going in until we have police escorts, so just stage here,” a supervisor says, directing EMS crews to the parking lot staging area.

6:08 p.m. – EMS crews enter the building with a police SWAT team and establish a triage location outside the corridor to the mall food court.

6:14 p.m. – EMS reports three people are being transported to area hospitals and two victims were found to be dead on arrival. Another victim, who suffered head wounds while fleeing the shooting, is located outside the mall.

6:15 p.m. – EMS reports “all the patients in our immediate vicinity have been either tagged DOA or they’re now being transported.” They also report on the condition of the shooter. “We had a pulse. Now we don’t, but they’re going to go ahead and work him and transport him.”

6:17 p.m. – EMS crews are warned about a suspicious backpack found in the same mall bathroom where the shooter prepared to commit his crime. “Police are advising a backpack in the back bathroom, possibly a bomb. We’re going to evacuate the area,” a dispatcher announces.

6:18 p.m. – Police actively search all corridors in the mall, locating remaining civilians in the building and escorting them out while police determine if the backpack in the food court restroom contains any explosives.
