Federal Court Rules that Only Humans Can Hold Patents – Not AI Systems

The U.S. Court of Appeals for the Federal Circuit ruled on Friday that inventors must be human in another blow to computer scientists who believe AI machines should be recognized as inventors on patents.

 

Bloomberg reports that computer scientist Stephen Thaler has faced another setback in his efforts to have artificial intelligence machines recognized as inventors on patents. The U.S. Court of Appeals for the Federal Circuit ruled on Friday that the term “individual” in the Patent Act refers only to humans which means that an AI doesn’t count as an inventor of a patentable invention.

 

The decision aligns with courts in the European Union, the UK, and Australia, which have also refused to accept Thaler’s argument. Only one court ruled in favor of Thaler’s argument, a South African court that said AI can be a patent inventor.

 

The Federal Circuit is generally seen as the final authority on U.S. patent matters unless the U.S. Supreme Court steps in. Thaler plans to appeal to the high court according to his attorney Ryan Abbott of Brown, Neri, Smith & Khan LLP.

 

Abbott stated that the Federal Circuit adopted a “narrow and textualist approach” to the Patent Act. “=•It ignores the purpose of the Patent Act and the outcome that AI-generated inventions are now unpatentable in the United States==,” he said. “That is an outcome with real negative social consequences.”

 

Thaler is not the only computer scientist arguing for AI rights in recent years. Breitbart News recently reportedthat Google has fired Blake Lemoine, an engineer who went public last month with his theory that Google’s AI language system is sentient and has its own “wants” and should be respected as a person. Google and several AI experts have denied Lemoine’s claims and the company confirmed that Lemoine had been fired.

 

Lemoine told BBC News that he is currently getting legal advice and could not comment further. In a statement, Google said that Lemoine’s claims about The Language Model for Dialogue Applications (LAMDA) were “wholly unfounded” and that the company worked with Lemoine for “months” to clarify this.

 

The statement said: “So, it’s regrettable that despite lengthy engagement on this topic, Blake still chose to persistently violate clear employment and data security policies that include the need to safeguard product information.”

Breitbart News senior contributor and Government Accountability Institute president Peter Schweizer said Monday night on FNC’s “Jesse Watters Primetime” that Speaker of the House Nancy Pelosi’s (D-CA) son Paul Pelosi, Jr. is consulting in a way that is “very reminiscent” of Hunter Biden’s business dealings.

 

Schweizer said, “This is a particularly cynical and galling move by the Pelosis. First of all, as you pointed out, Paul Pelosi Sr., Nancy’s husband, has been under scrutiny for insider trading issues the stock trades. He has to, of course, disclose his finances because he is the spouse of Nancy Pelosi. Your adult children do not need to disclose their financial transactions. So, it seems like they switched attention to their son’s commercial activities.”

 

He added, “To put even a tighter note on this, Jesse, look at what is happening here. Nancy Pelosi is flying to the Asian Pacific region as the entire region is nervous and scared about the looming threat posed by China. You have got the Speaker of the House coming in with a couple of other Democrats. They certainly want to have her good favor, andall of a sudden, her son is along for the trip.

 

He is not a foreign policy adviser. He has no background, looking for business deals. This is what you call leverage. This is the sort of stuff you would expect from the Mafia, where you kind of create a demand for your own services. The kind of services that Paul Pelosi Jr. is offering are very reminiscent of Hunter Biden’s, by the way. They are vague. They are consulting are offering advisory services. They don’t actually have some product they are trying to sell. It’s particularly a galling and cynical move.

 

I applaud you for covering this because the rest of the mainstream media is totally ignoring this story.”

Mitch McConnell Refuses to Answer Questions on FBI’s Mar-a-Lago Raid

Senate Minority Leader Mitch McConnell (R-KY) refused to answer questions about the FBI’s raid on Mar-a-Lago, the home of former President Donald Trump.

 

During a press event, when McConnell was asked about his reaction to the FBI’s raid at Mar-a-Lago, he quickly responded, “I’m here today to talk about the flood and the recovery from the flood.”

 

Breitbart News attempted to reach McConnell’s office for comment earlier Tuesday morning and has not heard back by the time of publication.The minority leader has not made any public announcement regarding the raid and has appeared to show no concern.

 

At this time, three Republican senators in leadership have issued public statements condemning the raid, including Senate Republican Conference chair John Barrasso(R-WY), National Republican Senatorial Committee chair Rick Scott (R-FL), and Senate Republican Conference vice chair Joni Ernst (R-IA).

 

At the time, the White House “played dumb” by insisting that President Joe Biden had no prior knowledge of the raid. “The president was not briefed, was not aware of it. No one from the White House was given a head’s up,” White House press secretary Karine Jean-Pierre claimed on Tuesday.

 

On Monday night, the former president, in a lengthy statement, was the first to confirm the FBI raid of his home in Palm Beach.

 

“These are dark times for our Nation,” as his home “is currently under siege, raided, and occupied by a large group of FBI agents,” he said in a written statement. “Nothing like this has ever happened to a President of the United States before.”

Mar-a-Lagogate: The FBI Raid of Donald Trump's Home Is This Administration's Watergate

The FBI conducted a raid of former President Donald Trump’s Mar-a-Lago property on Monday and searched for documents that are allegedly connected to an investigation.

 

“Nothing like this has ever happened to a President of the United States before. After working and cooperating with the relevant Government agencies, this unannounced raid on my home was not necessary or appropriate,” Trump said in his statement. “It is prosecutorial misconduct, the weaponization of the Justice System, and an attack by Radical Left Democrats who desperately don’t want me to run for President in 2024, especially based on recent polls, and who will likewise do anything to stop Republicans and Conservatives in the upcoming Midterm Elections.”

 

“What is the difference between this and Watergate, where operatives broke into the Democrat National Committee?” Trump asked. “Here, in reverse, Democrats broke into the home of the 45th President of the United States.”

 

The former president makes an excellent point, and the media should begin calling out this egregious action as the significant scandal that it is: Mar-a-Lagogate.

 

The current administration is exercising its power in a way that has been associated with criminal activity in the past.

 

“==We just haven’t investigated presidents after they’ve served their term=,” said Michael Tabman, former head of the FBI’s Minneapolis Field Office, according to Fox News. “But it is a huge move by the FBI in that the political sensitivities are clear. It’s obvious that they’re dealing on a very, sort of tenuous political climate when you go out and you investigate a president, especially one who says he may run for office again.”

 

There are many red flags, some of which have been pointed out by my PJ Media colleague, Matt Margolis. There’s the political bias of the judge who signed the warrant — he’s an Obama donor who has connections to Jeffrey Epstein as well, Margolis notes. Matt also reports that the so-called “classified” documents the FBI was allegedly seeking were already declassified.

 

Additionally, Trump advisors stated that the contents of the boxes in question were mementos from Trump’s presidency, according to the Washington Post.

 

This kind of aggressive prosecutorial action is unprecedented against a commander in chief who is not currently in office. It would seem that the Biden Administration is using the DOJ as its personal enforcer for political purposes.

 

Time will reveal the truth. Until then, let’s call this political hit what it is: Mar-a-Lagogate.
