Constitutional Law - Final Exam
Question 1 - Part A
Hypothetically speaking, assume that all Three Branches of our civil Government successfully conspire to commit Treason during a Presidential Election resulting in the ouster of a legally elected President?
Further, assume that the leadership of the U.S. Military thru its MiIitary Intelligence department gets wind of the treasonous plot, informs the leadership, and the leadership sets a trap and catches all Three Branches "red-handed" in the commission of the Treason with a boatload of proof of the Conspiracy to Commit Treason and proof of the actual Treason?
In the above case is the U.S. Military not bound by its sworn oath to support and defend the Constitution to take any action in order to preserve the Republic?
If not, please set out your reasoning in full.
Question 1 - Part B
Assuming the same fact pattern set out in Part A, what way, if any, does the successfully executed Conspiracy To Commit Treason affect the U.S. Military's existing Chain of Command structure?
Is the Military obligated under the U.S. Constitution to inform its existing Commander-in-Chief, the alleged loser of the Election, of the successfully executed Conspiracy, along with all the proof?
If your answer is in the affirmative, what, if any, recourse is available under the Constitution, or elsewhere, to the Military leadership AND its STILL only authentic CinC to take action against the conspirators and rectify the fraudulent Election?
