Michigan project with $1.14B in taxpayer backing must adhere to Chinese communist rules

Gotion says the taxpayer investment will yield 2,350 jobs in Big Rapids.

Gotion Inc.’s $2.3 billion “Project Elephant” electric vehicle battery materials processing plant proposed for construction in Mecosta County, Michigan is facing increasing backlash.

The latest setback for Gotion comes after this week’s revelations the company’sbylawsinclude articles requiring the company “perform its duties in accordance with theConstitution of the Communist Party of Chinaand other Party Regulations….”

 

Gotion received state and local commitments of $1.14 billion when Project Elephant was announced last fall. Gotion says the taxpayer investment will yield 2,350 jobs in Big Rapids. Company Vice President of North American Manufacturing Chuck Thelen told the Michigan Senate Appropriations Committee this week that construction of the Big Rapids facility is scheduled to begin in the second quarter of this year, and production is anticipated to begin on the second quarter of 2025.

 

The committee met earlier this week to discuss whether to approve a$175 million taxpayer fundedStrategic Outreach and Attraction Reserve appropriation.

 

The Center Square reported last month that Big RapidsTownship voted for a federal reviewof Gotion’s bid to build on 115 acres in the township, citing concerns over the company’s Chinese ownership. Rather than respond to the township’s questions, Gotion refocused its siting plans to 408 acres in Mecosta County’s Green Township.

 

The inclusion ofCCP fealty requirementswere first reported by The Midwesterner News.

 

The specific requirements listed in Chapter VI Party Committee of Gotion’s Articles of Association include, “Ensure and supervise theimplementation of the Party’sguidelines, principles and policies in the Company, and implementmajor strategic decisions of the CPC Central Committeeeand the State Council as well as relevant important work arrangements of the Party organization at the higher level.”

 

The second requirement states, “Strengthen leadership and control over the selection and appointment of personnel, regulate standards, procedures, inspections, recommendations and supervision, and adhere to the principle ofthe Party’s supervisionof cadres, the board of directors' selection of managers and the managers’ exercise of the right to employ personnel in accordance with law.”

 

A third requirement relates to employee communications as well as concerns related to shareholder, board of directors, supervisor and senior management responsibilities to uphold the law.

 

The fourth requirement states, “Assume primary responsibility for comprehensively and strictly governing the Party; lead the ideological and political work, united front work, spiritual civilization construction, enterprise culture construction, labor union, Communist Youth League and other mass work of the Company; lead the construction of Party conduct and clean government, and support the Commission for Discipline Inspection in earnestly fulfilling its supervisory responsibilities.” (Are you fucking kidding me?)

 

The fifth requirement calls for strengthening “the construction of Party organization andParty members at the grass-roots level of the Company, give full play to the role of the Party branch as a fighting fortress and the vanguard and exemplary role of Party members, unite and lead cadres and staff to actively participate in the reform and development of the Company….”

 

In response to questions about Gotion Inc.’s ownership from Sen. John Damoose, R-Harbor Springs, Thelen responded, “it is a publicly held company through two major locations in Switzerland and China so the ownership is the public.”

 

Thelen acknowledged Gotion Inc. is a wholly owned subsidiary of Gotion High-Tech, although Gotion Inc. has been headquartered in Fremont, Calif., since 2015. Majority voting rights on the company's board of directors are controlled by the founding shareholders in China.

 

Thelen said Volkswagen has acquired 26% of Gotion High-Tech since 2020. In a press statement, he said the CCP does not influence Gotion Inc.’s North American operations.

Parts of Twitter source code reportedly leaked, company suspects insider

 

Elon Musk has previously vowed to release select portions of the code the platform uses to recommend tweets, though it remains unclear whether the leaked material included that code.

Select portions of Twitter's source code appeared online as part of a major leak that the company suspects an insider orchestrated.

 

The code appeared on GitHub, an online platformthrough which software developers may collaborate, according to the New York Times. Twitter demanded the platform remove the post containing the code on Friday, which GitHub promptly did.

 

The social media company has sought a court order from the U.S. District Court for the Northern District of California to require thatGitHub identify the code's original posterand those who downloaded the material.

 

The individual who released the code fragments did so using the pseudonym"FreeSpeechEnthusiast."While the company only recently learned of the leak, the post has been live for many months.

 

Internal investigators suspect that the leaker is most likely one of the thousands of employees who either resigned or were laid off upon Musk's takeover of the firm last year.

§ 600.1 Grounds for appointing a Special Counsel.

The Attorney General, or in cases in which the Attorney General is recused, the Acting Attorney General, will appoint a Special Counsel when he or she determines that criminal investigation of a person or matter is warranted and -

(a) That investigation or prosecution of that person or matter by a United States Attorney's Office or litigating Division of the Department of Justice would present a conflict of interest for the Department or other extraordinary circumstances; and

(b) That under the circumstances, it would be in the public interest to appoint an outside Special Counsel to assume responsibility for the matter.

§ 600.2 Alternatives available to the Attorney General.

When matters are brought to the attention of the Attorney General that might warrant consideration of appointment of a Special Counsel, the Attorney General may:

(a) Appoint a Special Counsel;

(b) Direct that an initial investigation, consisting of such factual inquiry or legal research as the Attorney General deems appropriate, be conducted in order to better inform the decision; or

(c) Conclude that under the circumstances of the matter, the public interest would not be served by removing the investigation from the normal processes of the Department, and that the appropriate component of the Department should handle the matter. If the Attorney General reaches this conclusion, he or she may direct that appropriate steps be taken to mitigate any conflicts of interest, such as recusal of particular officials.

§ 600.3 Qualifications of the Special Counsel.

(a) An individual named as Special Counsel shall be a lawyer with a reputation for integrity and impartial decisionmaking, and with appropriate experience to ensure both that the investigation will be conducted ably, expeditiously and thoroughly, and that investigative and prosecutorial decisions will be supported by an informed understanding of the criminal law and Department of Justice policies. The Special Counsel shall be selected from outside the United States Government. Special Counsels shall agree that their responsibilities as Special Counsel shall take first precedence in their professional lives, and that it may be necessary to devote their full time to the investigation, depending on its complexity and the stage of the investigation.

(b) The Attorney General shall consult with the Assistant Attorney General for Administration to ensure an appropriate method of appointment, and to ensure that a Special Counsel undergoes an appropriate background investigation and a detailed review of ethics and conflicts of interest issues. A Special Counsel shall be appointed as a “confidential employee” as defined in 5 U.S.C. 7511(b)(2)(C).

 

§ 600.4 Jurisdiction.

 

(a) Original jurisdiction. The jurisdiction of a Special Counsel shall be established by the Attorney General. The Special Counsel will be provided with a specific factual statement of the matter to be investigated. The jurisdiction of a Special Counsel shall also include the authority to investigate and prosecute federal crimes committed in the course of, and with intent to interfere with, the Special Counsel's investigation, such as perjury, obstruction of justice, destruction of evidence, and intimidation of witnesses; and to conduct appeals arising out of the matter being investigated and/or prosecuted.

 

(b) Additional jurisdiction. If in the course of his or her investigation the Special Counsel concludes that additional jurisdiction beyond that specified in his or her original jurisdiction is necessary in order to fully investigate and resolve the matters assigned, or to investigate new matters that come to light in the course of his or her investigation, he or she shall consult with the Attorney General, who will determine whether to include the additional matters within the Special Counsel's jurisdiction or assign them elsewhere.

 

(c) Civil and administrative jurisdiction. If in the course of his or her investigation the Special Counsel determines that administrative remedies, civil sanctions or other governmental action outside the criminal justice system might be appropriate, he or she shall consult with the Attorney General with respect to the appropriate component to take any necessary action. A Special Counsel shall not have civil or administrative authority unless specifically granted such jurisdiction by the Attorney General….

Russia’s newest jets provide air superiority – Ukrainian official

The Su-35 has given Moscow’s forces “increasing dominance” of the skies, a Kiev government source has told ABC

 

Russia's latest generation ofSu-35 fighter jets has capabilities that Kiev’s forces can’t neutralize, a senior Ukrainian government official has told ABC News.

 

The newest Su-35s are equipped with “very effective radar and long-distance rockets,” enabling them to attack Ukrainian jets and provide air support for Russian ground troops, the unidentified official said in an article posted on Monday. Ukraine “does not have capabilities” to counter this threat, he added.

 

Kiev sees Russian air superiority as a “real risk,” the official admitted, making its push for more air defense systems from the US “priority No. 1” for Ukraine. “This is a problem,” another unidentified official said. “What we keep telling the Americans is that in the end, there is no other solution than to give us fighter jets.” He claimed that Russia has 12 times more military aircraft than Ukraine.

 

The latest comments out ofKiev contradict recent claims by Western leaders. Russia’s air power in Ukraine is limited by Kiev’s air defenses, including surface-to-air missiles, one Western official told reporters in a briefing last week. “We’re not seeing a huge change in that situation.”

 

However, the Ukrainian official noted that as Russia replaces older models of aircraft with the latest Su-35, it’s gaining a stronger advantage. He conceded that with Washington refusing so far to provide fighter jets to Ukraine, there is increasing acceptance in Kiev that the government should focus on trying to get more air defense systems and artillery from the US.

 

The governments of Slovakia and Poland pledged last week to give Soviet-era MiG-29 fighter jets to Ukraine. Kremlin spokesman Dmitry Peskov said the two NATO members appeared to be using the Ukraine crisis to dispose of “old equipment they no longer need.”
