Jeff Sessions testifies for defense in hip-hop star Pras Michel’s illegal lobbying trial

Former U.S. Attorney General Jeff Sessions on Tuesday took the stand as a defense witness in the illegal lobbying trial of hip-hop star Pras Michel, testifying that he could not recall meeting Michel and that the Fugees rapper’s request for a meeting did not appear improper.

 

Michel was charged in 2021 by federal prosecutors in Washington with participating in an illegal lobbying campaign to have a dissident Chinese businessman deported and for DOJ officials to drop an embezzlement investigation involving a Malaysian sovereign wealth fund.

 

On Tuesday, Sessions recalled two meetings where DOJ officials discussed deporting the dissident, Guo Wengui, including one requested by a Chinese vice minister for public security, Politico reported.

 

But Sessions said Guo wasn’t deported when he was attorney general and he never took the meeting requested by the Chinese official.

 

Sessions, the longtime former U.S. Senator from Alabama, also testified that he was unaware of ever meeting Michel.

 

“I don’t recall ever having met him,” Sessions said, according to Politico.

 

Still, said Sessions, Michel’s request for a meeting did not have an air of impropriety on its face.

 

“I think that’s an appropriate action, although the State Department would have an important role to play in that and others, perhaps Homeland Security, since this figure was important to China,” he said.

 

While federal prosecutors allege Michel acted as an unregistered agent on behalf of China and a Malaysian national, the Fugees rapper claimed he was acting in a humanitarian capacity.

A rare solar eclipse will cross over remote parts of Australia, Indonesia and East Timor on Thursday.

 

The lucky few in the path of the hybrid solar eclipse will either get plunged into the darkness of a total eclipse or they’ll see a “ring of fire” as the sun peeks out from behind the moon.

 

The eclipse path will swoop from the Indian Ocean to the Pacific Ocean, mostly over water. For those viewing the total eclipse, it will last a little over a minute.

 

Such celestial events happen about once every decade: The last one was in 2013 and the next one isn’t until 2031. They occur when Earth is in the “sweet spot” so the moon and the sun are almost the exact same size in the sky, said NASA solar expert Michael Kirk.

 

At some points, the moon is a little closer and blocks out the sun in a total eclipse. But when the moon is a little farther away, it lets some of the sun’s light peek out in an annular eclipse. …

Closing the Gaps and Completing the Modernization of FISA

 

In a previous post, I described the political landscape for this year’s Section 702 reauthorization debate and noted the view of most observers that Section 702 is unlikely to be reauthorized this year without significant reforms. I outlined four key areas of reform and discussed the first of these: closing the backdoor search loophole. In today’s post, I discuss the second area of needed reform: closing gaps in the law that permit the collection and use of Americans’ communications and other Fourth Amendment-protected information without statutory authorization or judicial oversight.

 

There are two primary gaps that Congress must address. First, changes in communications technology since FISA’s 1978 enactment have dramatically altered the reach of the law. In 2008, Congress addressed one of the unintended outcomes of these changes: The government was required to obtain FISA Court orders to collect purely foreign communications, simply because they were routed through or stored in the United States. However, Congress failed to fully address the flip side of the issue: massive amounts of Americans’ communications and other sensitive information are routed and stored overseas, rendering them vulnerable to collection outside any statutory framework. To complete the modernization of FISA that began with Section 702, Congress must close this critical gap in coverage.

 

Second, after 9/11, the government sought to evade FISA’s substantive and procedural constraints by relying on claims of inherent executive authority. Congress responded by reaffirming that FISA was the exclusive means by which the government could conduct “electronic surveillance.” Because of the highly technical definition of that term, however, the exclusivity provision fails to reach many types of collection covered by FISA. There is ample reason for concern that the government is exploiting these gaps to collect some of the most sensitive data Americans generate without adhering to FISA’s requirements — including by purchasing it from data brokers. Congress should fill the holes in FISA’s exclusivity provision and bar the government from buying its way around FISA and other legal restrictions on governmental access to Americans’ data. …

  1. Deputy Att’y General Lisa Monaco just repeated Att’y General Garland’s previous claim that U.S. Marshals have “full authority to arrest” people protesting at the homes of Supreme Court justices in violation of 18 USC 1507. The U.S. Marshals have been instructed otherwise.

 

  1. Three weeks after Garland told me that in early March, @KatieBrittforAL asked him about training materials given to U.S. Marshals LIMITING their authority to make such arrests under 1507. Garland said he knew nothing about them, even though they contradict what he told me.

 

  1. Those training materials falsely tell the Marshals that to make such an arrest, the protestors’ conduct must include “criminal threats and intimidation.” This is contrary to the plain text of 1507, which requires only that protesters act “with intent of influencing any judge.”

 

  1. The training materials also instruct Marshals that they should coordinate any contemplated arrest under 1507 “in advance with the appropriate U.S. Attorney’s Office,” which will effectively halt any effort to enforce this law in this context, which the law clearly covers.

 

  1. Deputy A.G. Monaco said she had not reviewed the training materials before the Marshals were given these instructions. Nor has she since asked for them to be changed or discussed them with A.G. Garland.

 

  1. Garland’s insistence (echoed today by Monaco) that Marshals have “full authority to arrest” people protesting at the homes of justices cannot be reconciled with the instructions given to Marshals, which appear deliberately designed to discourage if not preclude such arrests.

 

  1. What’s now been happening for nearly a year at the homes of Supreme Court justices is illegal. And it’s dangerous.

The Department of Justice needs to ENFORCE 1507

in these cases—not thwart enforcement!
