Judge Blocks Montana Law Banning Sex Change Surgeries For Minors

 

A district court judge has blocked a Montana law banning sex change surgeries for minors.

 

Republican Gov. Greg Gianforte signed the legislation, Senate Bill 99, into law in April. It was scheduled to go into effect on October 1.

 

The law prohibits doctors from prescribing cross-sex hormones, puberty blockers, or performing sex change surgeries on minors. Healthcare workers who violate the law could be subjected to discipline from their “licensing entity or disciplinary review board” and lose their license for a year if convicted.

 

A lawsuit challenging the ban was brought on by the American Civil Liberties Union which is representing Jessica and Ewout van Garderen and their 16-year-old son who identifies as a girl named “Scarlet,” Molly and Paul Cross and their 15-year-old daughter “Phoebe,” Jane and John Doe joining on behalf of their 15-year-old son who identifies as a girl, Dr. Juanita Hodax of Community Medical Center, and Dr. Katy Mistretta of Bozeman Creek Family Health.

 

Just four days before the new law would go into effect, District Court Judge Jason Marks issued a temporary injunction because he agreed with the plaintiffs who argued that it is “likely unconstitutional and would harm the mental and physical health of minors with gender dysphoria, rather than protect them from experimental treatments,” according to a report from the Associated Press.

 

The judge said Marks said he believes the Legislature’s stated intent in passing the law was “disingenuous” and that he thinks it is likely that the intent is to “ban an outcome deemed undesirable by the Montana Legislature, veiled as protection for minors.”

 

The AP reports, “The preliminary injunction remains in effect until a full trial can be held on the issue, but the state Department of Justice said it will appeal the injunction.”

 

Emilee Cantrell, deputy communications director for the state’s Department of Justice, told the Daily Caller News Foundation that “because of the irreversible and immediate harms that the procedures have on children, we will be filing a notice of appeal today.”

 

“This is a preliminary matter at this point,” Cantrell said. “We look forward to presenting our complete factual and legal argument to protect Montana children from harmful, life-altering medications and surgeries. Because of the irreversible and immediate harms that the procedures have on children, we will be filing a notice of appeal today.”

 

In a press release, the ACLU said that the “fight is far from over.”

 

“Today’s ruling permits our clients to breathe a sigh of relief,” said Akilah Deernose, Executive Director of the ACLU of Montana. “But this fight is far from over. We look forward to vindicating our clients’ constitutional rights and ensuring that this hateful law never takes effect.”

Dozen key revelations from newly released memos in the Hunter Biden criminal probe

 

The Committee on Wednesday voted to release 700 pages of materials related to potential influence peddling that the panel received from IRS whistleblowers Gary Shapley and Joseph Ziegler. Many of the documents appear to support critics who assert that the Biden DOJ covered for him, and his son.

 

The House Ways and Means Committee released documents Wednesday that Chairman Jason Smith, (R-Mo.), says reveals a deepening pattern of influence peddling by the Biden family and also underscores career Department of Justice officials' efforts to obstruct the investigation into Hunter Biden.

 

The Committee voted to release 700 pages of materials from the federal investigation into the Biden family that were provided by IRS whistleblowers Gary Shapley and Joseph Ziegler. In prepared remarks, Smith said that Hunter Biden and his family operated a "complex and lucrative enterprise" to "enrich themselves to the tune of at least $20 million."

 

"It is clear that then Vice President Joe Biden’s political power and influence was, quote, the brand that Hunter Biden was selling all over the world," he added.

Hunter Biden believed his Chinese energy partner was tied directly to the Communist nation's president.

 

In an interview with investigators, James Biden—the younger brother of President Biden—said that Hunter Biden "portrayed CEFC to him as Chairman Ye was a protégé of President Xi," according to the memorandum of his interview.

James Biden suggested in text messages it was normal for Joe Biden to be involved in his son's business.

 

In an affidavit to the committee, Ziegler suggested agents believed there was evidence in a series of WhatsApp encrypted text messages that Joe Biden was involved in the CEFC business deal and others before it, but the FBI's interview with James Biden was constructed to avoid asking those questions.

 

To back up the claim, Ziegler attached a summary of one text messages between James Biden and Hunter Biden from 2018. "This can work, you need a safe harbor. I can work with you father alone !! We as usual just need several months of his help for this to work. Let’s talk about it. It makes perfect sense to me. This is difficult to fully vet without talking," the uncle wrote Hunter Biden.

Sen. Bob Menendez, wife, plead not guilty to fraud charges amid mounting calls for resignation

 

Menendez has stepped down from his position as chairman of the Senate Foreign Relations Committee but has resisted calls to resign.

 

Sen. Bob Menendez and his wife, Nadine Menendez, pleaded not guilty Wednesday to federal fraud, bribery and extortion charges as the New Jersey Democrat faces calls to resign.

 

The senator was charged last week with using his official position to support Egyptian interests and benefit three New Jersey businessmen in exchange for cash and gold, which was found hidden in his house.

 

The couple pleaded not guilty in New York court to three counts each, according to CNN. Two of the charges carry 20-year maximum prison sentences.

 

Menendez has stepped down from his position as chairman of the Senate Foreign Relations Committee, but he has pledged to remain in the Senate even as more than half of all U.S. Democratic senators have demanded his resignation. Senate Majority Whip Dick Durbin, chair of the Judiciary Committee and the No. 2 Senate Democrat, on Wednesday became the highest-ranking senator to call on Menendez to step down.

 

The three businessmen accused of being involved in the scheme were also charged. Two of them – Fred Daibe and Jose Uribe – peaded not guilty on Wednesday.

 

Wael Hana, the third man, pleaded not guilty Tuesday after he was arrested earlier that day at John F. Kennedy Airport in New York, where he voluntarily flew in to from Egypt to face the charges.
