The NRA has a surprising defender in its free speech case before the Supreme Court

 

NEW YORK (AP) — In a case of politics making strange bedfellows, the National Rifle Association will be represented by frequent nemesis the American Civil Liberties Union in an appeal before the U.S. Supreme Court.

 

The New York-based civil liberties group confirmed Saturday that it would provide legal representation for the gun-rights group in its First Amendment case against New York’s Department of Financial Services even as it “vigorously” opposes nearly everything it stands for.

 

“We don’t support the NRA’s mission or its viewpoints on gun rights, and we don’t agree with their goals, strategies, or tactics,” the ACLU in a statement posted on X, formerly Twitter. “But we both know that government officials can’t punish organizations because they disapprove of their views.”

 

The NRA, which reshared the ACLU’s statement on its social media account, wrote in a follow-up post that it was “proud” to stand with the ACLU and others who recognize that “regulatory authority cannot be used to silence political speech.” The nation’s highest court is set to hear arguments early next year in a case centered on comments former New York State Department of Financial Services superintendent Maria Vullo made in the wake of the 2018 shooting at Marjory Stoneman Douglas High School.

 

After 17 people were killed at the Parkland, Florida, school, Vullo called on banks and insurance companies operating in New York to discontinue their association with gun-promoting groups.

 

In letters to companies and news releases, she urged operators to consider “reputational risks” from doing business with the NRA and other gun groups.

 

The NRA sued Vullo after multiple entities cut ties or decided not to do business with the Fairfax, Virginia-based organization. The federal appeals court in New York rejected the NRA’s claims, saying Vullo acted in good faith and within the bounds of her job.

 

Spokespersons for New York’s financial services department didn’t respond to an email seeking comment Saturday. …

New York Loses Climate Change Fraud Case Against Exxon Mobil

 

A New York state judge on Tuesday handed Exxon Mobil a victory in the civil case brought by the state’s attorney general that argued the company had engaged in fraud through its statements about how it accounted for the costs of climate change regulation.

 

After some four years of investigation and millions of pages of documents produced by the company, the judge said, attorney general Letitia James and her staff “failed to establish by a preponderance of the evidence” that Exxon violated the Martin Act, New York’s powerful legal tool against shareholder fraud, in the closely watched case.

 

In a statement, the company said “Today’s ruling affirms the position Exxon Mobil has held throughout the New York Attorney General’s baseless investigation. We provided our investors with accurate information on the risks of climate change. ”

 

In a statement, Ms. James said, “For the first time in history, Exxon Mobil was compelled to answer publicly for their internal decisions that misled investors.”

 

Acknowledging the loss, she said, “Despite this decision, we will continue to fight to ensure companies are held responsible for actions that undermine and jeopardize the financial health and safety of Americans across our country, and we will continue to fight to end climate change.”

 

Exxon’s statement also said: “Lawsuits that waste millions of dollars of taxpayer money do nothing to advance meaningful actions that reduce the risks of climate change. Exxon Mobil will continue to invest in researching breakthrough technologies to reduce emissions while meeting society’s growing demand for energy.”

 

Throughout the 12 days of hearings, there were indications that the judge, Barry Ostrager, might rule against the state. He seemed frequently impatient with the presentation by the attorney general’s staff, and was fully engaged in the testimony from the company’s former chairman, Rex Tillerson. …

Trump Reverses Course, Won't Testify in New York Trial Again

He announced the new move on social media on Dec. 10.

 

Former President Donald Trump said on Dec. 10 that he'll no longer take the witness stand in the bench trial for a civil fraud case against him in New York.

 

"As everyone knows, I have very successfully and conclusively testified in the corrupt, Biden-directed New York State Attorney General's rigged trial against me," he wrote on the Truth Social platform. "World-renowned experts, highly respected bank and insurance executives, real estate professionals, as well as others, both honest and credible, have stated, clear and unequivocally, that I, and my very successful company, did nothing wrong!

"Financial statements were conservative, liquid, and 'extraordinary.' The only fraud committed was by the highly partisan and out-of-control judge and racist AG."

 

Last year, New York Attorney General Letitia James filed a lawsuit against President Trump and other Trump Organization executives on seven claims related to fraud.

 

Since Nov. 13, the defense has been presenting its case, relying heavily on outside experts to refute the accusation of fraud, despite the fact that New York Supreme Court Justice Arthur Engoron had already issued a pretrial ruling finding President Trump liable for fraud. The trial is meant to deal with the penalties that he'll need to pay, as well as the state's attorneys proving intent and materiality.

 

President Trump was meant to testify again on Dec. 11, closing out the defense. Instead, the last expert witness in the case, New York University accounting professor Eli Bartov, will continue to testify through Dec. 12.

 

"I have already testified to everything and have nothing more to say other than that this is a complete and total election interference (Biden Campaign!) witch hunt, that will do nothing but keep businesses out of New York, I will not be testifying on Monday," the former president wrote.

 

Defense attorneys are expected to be mounting appeal efforts. An appellate court has already paused one of the penalties issued by Justice Engoron pending appeal—the dissolution of The Trump Organization—and the Trump legal team has begun an Article 78 proceeding accusing the judge of unlawful behavior.

 

President Trump had already testified in November, giving lengthy, narrative answers about his properties and dealmaking when questioned by state prosecutors.

 

Justice Engoron told defense attorneys to "control" their client and limit his answers, escalating the issue when he said he would "draw every negative inference" if they didn't do so. President Trump said he hoped that everyone watching could see how "unfair" the trial was and accused the attorney general of having no case. …
