Federal court throws wrench into Biden's war on appliances

A federal appeals court shot down the Biden administration’s efforts to repeal existing regulations on dishwashers and clothes washers on Monday.

 

The U.S. Fifth Circuit Court of Appeals issued an opinion in a legal battle between eleven red states and the federal government over the Department of Energy’s (DOE) efforts to impose energy and water efficiency standards for dishwashers and clothes washers thatasserted it “is unclear that DOE has statutory authority to regulate water use in dishwashers and clothes washers,” according to the opinion’s text. The Biden administration has attempted to push new standards for both appliances since coming into office in 2021 as part of a wider push to nudge the market toward more energy efficient appliances, which in some cases are generally less effective than their other models, the court asserted in its opinion.

 

In March 2018, the Competitive Enterprise Institute (CEI) proposed standards for dishwashers that allow the sale of models that run faster cycles, using more energy and water than standard dishwashers in the process. The Trump administration then adopted similar guidelines as policy in 2020, but the Biden DOE repealed those standards in 2021 before advancing its own standards that crack down on the faster models advantaged by the Trump administration’s rules in May 2023.

“But even if DOE has water-usage authority over the relevant appliances,the Department (b) failed to adequately consider the negative consequences of the Repeal Rule, including the substitution effects of energy-and-water-wasting rewashing, prewashing, and handwashing,” the opinion states. “In promulgating the Repeal Rule, DOE stated that its energy conservation program must promote ‘water conservation’ and regulate ‘water use’ …But it is unclear how or why DOE thinks it has any statutory authority to regulate ‘water use’ in dishwashers and washing machines.”

 

Thecourt’s opinionalso points out thatthere is “ample evidence” to support that DOE’s dishwasher standards actually accomplish the oppositeof their intent, stating that “they make Americans use more energy and more water for the simple reason that purportedly ‘energy efficient’ appliances do not work.”

 

Beyond clothes washers and dishwashers, the Biden DOE has also sought to impose energy efficiency regulations for items like water heaters, furnaces and pool pump motors. The administration has also spent hundreds of millions of dollars on helping state and municipal governments pursue building codes.

 

“In this opinion, the court has forced DOE to follow the lawand even noted thatone of the positions DOE took in this suit ‘borders on frivolous.’ This decision allows manufacturers to build better dishwashers, not be encumbered by counterproductive federal regulations,” Devin Watkins, an attorney for CEI, said of the opinion.

 

The DOE did not respond immediately to a request for comment.

Zelensky Gets Bad News From Poll

Support in Ukraine for President Volodymyr Zelensky was lower at the end of 2023 than a year earlier amid the ongoing war with Russia, according to a poll.

 

The Kyiv International Institute for Sociology (KMIS) survey found that Ukrainian society still backs the country's leadership and military, but support forZelensky fell from 84 percent at the end of 2022 to 62 percent at the end of last year.(they never have accurate polls since4-5,000,000 citizens the country and close to 250,000 left the country because they dont want to be conscripted)

 

The poll of 1,031 adults across the country, except for Crimea and other Russian-occupied territory, took place between November 29 and December 9, and had a margin of error of 3.4 percent. It also found 18 percent of Ukrainians didn't trust Zelensky, compared with only 5 percent who distrusted him in 2022.

 

Meanwhile,96 percent of respondents supported the Ukrainian armed forces and 88 percent trusted Ukrainian Commander-in-Chief General Valerii Zaluzhnyi, whose comments to The Economist in November that the war had reached a "stalemate" were rejected by Zelensky amid reports of tensions between the pair.

The KMIS said, according to a translation from Ukrainian, that "although there is also a downward trend in the case of the president, he retains the overwhelming trust of the Ukrainian public."

However, the share ofthose who trusted the parliament, the Verkhovna Rada, decreased from 35 percent to 15 percentin the same time frame, with thosenot trusting it increasing from 34 percent to 61 percent.

 

Overall trust in the Ukrainian government decreased from 52 percent to 26 percent, while mistrust increased from 19 percent to 44 percent, with the KMIS concluding that "compared with December 2022, criticism of the authorities is growing."

 

The KMIS said that this was most likely due to "unrealized expectations for this year" as well as "claims about the efficiency and transparency of activities."

 

However, the institute said: "It is important that, at the same time, criticism does not turn into demands for elections," which while due in 2024, have been ruled out by Zelensky because of the war.

 

A discussion about Ukrainian elections has been pushed by some U.S. politicians, such as Republican Senator Lindsey Graham. Ukrainian legislation bans elections during martial law imposed after Vladimir Putin's full-scale invasion and the law would need to be changed for a ballot to take place

 

But Ukrainian historian Serhii Plokhy told Newsweek in October that there is a "strong sense" in Ukrainian society the election that some want in Ukraine to justify its democratic credentials "is actually not a good idea."

 

"In conditions in which the government controls the media to a degree that it never controlled before, the elections from that point of view, would not be free and fair," Plokhysaid. "War limits your freedoms so that includes when it comes to free elections," he added.

 

KMIS said that Zelensky "maintains high legitimacy, which is definitely needed to maintain the control of state institutions in this difficult period and to conduct difficult negotiations with Western partners."(really doubtful because its all propaganda in Ukraine, all media still alive are controlled by Zelensky et al)

 

In its assessment of the Kyiv institute's findings, the Institute for the Study of War (ISW) said that Ukrainians were probably more optimistic in December 2022 than a year later because of the liberation of occupied territory in Kharkiv and Kherson oblasts during successful counteroffensive operations.

 

The findings showed how Ukraine was "experiencing tensions typical in a society fighting an existential defensive war," the Washington, D.C., think tank said on Tuesday. Newsweek contacted the Ukrainian presidential office for comment. (Those Think Tanks need an enema to clear the brains and bias.)

82-year-old Ukrainian labels his jailers ‘fascists’ (VIDEO)

The defendant, who denied any wrongdoing, was found guilty of high treason and collaborating with Russia

 

A court in the southwestern Ukrainian city of Zhitomyr on Tuesdaysentenced 82-year-old Yuri Chernishov to 15 years behind bars, finding him guilty of committing high treason. According to the prosecution, the defendant has been collecting information on Ukrainian troops, defenses and their locations, and sending the data to his alleged Russian contact.

 

The defendant was visibly shocked by the court’s verdict, which effectively meant a life sentence for him, given his advanced age. Chernishov became unruly during the hearings, condemning his jailers and branding them “fascists,” footage from the courtroom circulated by local media shows. Apart from receiving the lengthy jail term,he was also stripped of his military rank of colonel(he had served with the Soviet military back in the 1980s), and had ==his assets seized=.

According to the prosecutors, Chernishov maintained contact with an individual, believed to be a Russian national and a member of the Wagner Group private military company. The defendant was purportedly active between September 2022 and February 2023, reconnoitering Ukrainian military positions in his home city, mapping them and then sending the imagery to the contact.

 

Chernishov, however, has denied any wrongdoing. According to local media reports, he only admitted to talking to the aforementioned individual on social media, pointing out thathe was simply not able to carry out the offense he had been accusedof, given his old age and poor health. He also alleged that the case against him came as a revenge for his literary and publicist works, in which he had been consistently critical of Ukrainians and their statehood.

 

Such arguments, however, apparently left neither the prosecution nor the court convinced, given that Chernishov received the maximum possible sentence for his purported act of high treason.

 

“The defendant pleaded not guilty in court. Behaved defiantly, used his health condition to drag on the case. He did not hide his pro-Russian ideological views, confirming his contemptuous attitude towards Ukrainians,”the prosecutors said in a statement. The prosecution also claimed that Chernishov jumped bail during his trial, attempting to flee Ukraine for Belarus. The man, however, was apprehended on the border and placed in pre-trial detention.
