ROME — Secretary of State Mike Pompeo recently published a sharp letter excoriating the Vatican’s plans to renew an agreement with the Chinese government on Church operations in China. He promoted the article in a tweet, concluding, “The Vatican endangers its moral authority, should it renew the deal.”

An indignant Vatican took the article more as a calculated affront than a diplomatic gesture. The friction broke into the open on Wednesday as Mr. Pompeo arrived in Rome and met with prelates and others who are hostile to Pope Francis, while the Vatican denied him a meeting with the pontiff and rebuffed his efforts to derail the deal with China.

“Pompeo asked to meet” the pope, who turned him down because Francis had “clearly said that he does not receive political figures ahead of the elections,” Cardinal Pietro Parolin, who, as secretary of state, is the Vatican’s second-ranking official, told reporters.

But to some observers on both sides of the tensions between the Roman Catholic Church and the Trump administration, Mr. Pompeo’s visit is as much about the coming presidential election as about China policy. Mr. Pompeo dismissed that suggestion as absurd, but intended or not, his trip signals that President Trump is on the side of those conservative American Catholics who worry about the church’s direction under Francis and think he is soft on China.

Francis and Mr. Trump, who have exchanged sharp words in the past, present starkly different visions on issues ranging from the environment to immigration to the threat of populism. In appealing to the Vatican’s support for religious freedom as a reason to drop its China agreement, Mr. Pompeo seemed to seek common ground, but in a way that upset the pope’s chief allies and delighted his chief critics.

Cardinal Parolin said Mr. Pompeo’s article had caused “surprise” at the Vatican, because this visit to Rome by the secretary and the meetings with high officials at the Holy See had already been in the works and would have been a “more opportune” forum for airing grievances. He added that Mr. Pompeo’s choice to publish in First Things, a conservative Christian magazine that has called Francis a failure as Pope, also mattered.

Former President Trump’s attorney Alina Habba on Wednesday said the former president is concerned the U.S. Supreme Court justices may “shy away from being pro-Trump,” and rule against him in regard to the recent decisions in Colorado and Maine that kicked him off the states’ 2024 primary ballots.

Responding to New York Times reporter Maggie Haberman’s recent comments about Trump’s concerns, Habba during an interview on Fox News said, “That’s a concern he’s voiced to me, he’s voiced to everybody publicly, not privately. And I can tell you that his concern is a valid one.”

“You know, Republicans are conservative, they get nervous. They unfortunately … sometimes shy away from being pro-Trump because they feel that even if the law is on our side, they are swayed much like the Democratic side, right?” Habba told Fox News anchor Martha MacCallum. “So they’re trying so hard to look neutral that sometimes, they make the wrong call.”

Colorado and Maine both removed Trump from their 2024 state primary ballots last month, ruling he is ineligible to run for president under the 14th Amendment’s insurrection clause.

Trump on Wednesday appealed Colorado’s ruling to the U.S. Supreme Court, one day after he appealed Maine’s decision — which came from Maine’s Secretary of State Shenna Bellows — in the state’s superior court, though the dispute could ultimately also reach the U.S. Supreme Court, which currently has a 6-3 conservative majority.

Three of the justices on the nation’s highest bench were appointed by Trump, a point of concern Haberman addressed last week.

“They believe, generally speaking, he and his advisers, that they will have success at the Supreme Court, but he has also voiced some concern that a court that has — he appointed three of the justices at the Supreme Court and gave the conservatives a supermajority — he is concerned that they are going to look as if they’re trying not to rule in his favor and might rule against him,” Haberman said during a CNN appearance last week.

“It’s a very clean cut,” she said. “There’s no … politics that should be involved in this. It’s just simply American, and if the justices read the law, as I do, as most Americans and attorneys do, even [Alan Dershowitz] — who’s a known liberal — it’s just a simple decision, and it should have nothing to do with if you’re Republican or Democrat.”

Habba was making an apparent reference to attorney Alan Dershowitz’s comments against rulings from Colorado and Maine. Dershowitz last month called Colorado’s decision “an attempt to totally manipulate an amendment that was never designed to disqualify people in future election,” Forbes reported.

A number of legal experts have thrown out varying predictions for how the nation’s highest court could rule if it decides to hear the case. Former Attorney General Bill Barr called Colorado’s case “legally wrong and untenable,” while former federal Judge Michael Luttig said the Centennial State’s ruling is not “anti-democratic,” but rather the conduct that prompted the disqualification was anti-democratic.

Former White House lawyer Ty Cobb predicted the U.S. Supreme Court could rule “9-0” in favor of Trump if he appeals the Colorado Supreme Court decision, saying last month he believes the “law is clear.”

Supreme Court to decide whether insurrection provision keeps Trump off ballot

The Supreme Court will hear oral arguments on Thursday in what is shaping up to be the biggest election case since its ruling nearly 25 years ago in Bush v. Gore. At issue is whether former President Donald Trump, who is once again the front runner for the Republican nomination for president, can be excluded from the ballot because of his role in the Jan. 6, 2021, attacks on the U.S. Capitol.

Although the question comes to the court in a case from Colorado, the impact of the court’s ruling could be much more far-reaching. Maine’s secretary of state ruled in December that Trump should be taken off the primary ballot there, and challenges to Trump’s eligibility are currently pending in 11 other states. Trump warns that the efforts to keep him off the ballot “threaten to disenfranchise tens of millions of Americans” and “promise to unleash chaos and bedlam if other state courts and state officials follow Colorado’s lead.” But the voters challenging Trump’s eligibility counter that “we already saw the ‘bedlam’ Trump unleashed when he was on the ballot and lost.”

History behind the case

The dispute hinges on the interpretation of a relatively obscure provision of the Constitution: Section 3 of the 14th Amendment, which (as relevant in this case) provides that no one “shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any State,” if that person had previously sworn, “as a member of Congress, or as an officer of the United States” to support the U.S. Constitution but then “engaged in insurrection or rebellion” against the federal government.

Enacted in the wake of the Civil War, Section 3 was intended to disqualify individuals who had served in the federal (or state) government before the Civil War and had sworn to uphold the Constitution but then supported the Confederacy. The bar on service can only be overcome by a two-thirds vote of both the House of Representatives and the Senate.

Although Section 3 lay dormant for much of its history, there was renewed interest in it after the Jan. 6 attacks on the Capitol. Efforts to rely on Section 3 to disqualify officials for their role in the attacks have been met with varying degrees of success. In 2022, Georgia officials rebuffed a challenge to U.S. Rep. Marjorie Taylor Greene’s eligibility. A state administrative law judge agreed that Greene’s “heated rhetoric may well have contributed to the environment that ultimately led to” the attack on the Capitol, but he concluded that she had not engaged in an insurrection.

Former President Donald Trump on Sunday said “there’ll probably be some changes” when asked how Republican National Committee Chair Ronna McDaniel is doing — an apparent shift from his previous praise for the chairwoman.

After Fox News’ “Sunday Morning Futures” host Maria Bartiromo asked, “How’s Ronna McDaniel doing?” Trump predicted that “some changes” will be made, though he did not elaborate.

“I think she did great when she ran Michigan for me. I think she did OK, initially in the RNC,” he said. “I would say right now there’ll probably be some changes made.”

Trump’s remarks contrast with his past praise of McDaniel. During a speech to the Republican Jewish Coalition in October, Trump said McDaniel did a “fantastic job” leading the RNC.

The Trump campaign and the RNC did not immediately respond to NBC News’ request for comment.

Prior to NBC News’ projection last month that Trump had won the New Hampshire Republican primary, McDaniel signaled an intention to rally around Trump if he continues to dominate early caucuses and primaries.

“If President Trump comes out strong tonight, that’s a clear message being sent by our primary voters,” McDaniel said in a statement to NBC News before the New Hampshire results came in. “Republicans know that if we’re not united as a party behind our nominee we won’t be able to beat Biden.”

After Trump decisively won the New Hampshire Republican primary last month, McDaniel reiterated her desire to unite around Trump on the assumption that he emerges as the Republican presidential nominee.

“Every Republican has to agree that Joe Biden is a threat to our country, and if we do not unite and if we don’t coalesce to beat him, then we’re not going to be successful in 10 months, where the Senate’s at stake, the House is at stake, and the White House is at stake,” McDaniel told Fox News, referring to Republican presidential candidate Nikki Haley.
