Execution of Robert Roberson blocked by Texas judge with less than two hours to go

A Texas inmate who has been on death row for over two decades has had his execution - scheduled for tonight - blocked by a Texas judge. Robert Roberson, 57, was set to die by lethal injection following his conviction for killing his toddler daughter Nikki at his Palestine, East Texas home in 2002.

 

On Thursday afternoon, just two hours before he was to be put to death, Travis County Judge Jessica Mangrum blocked Roberson's execution so that he could testify before the Texas legislature. The legislature issued a subpoena for Roberson's testimony yesterday and Mangrum has approved a temporary restraining order.

 

On Wednesday, he was called to testify in front of the Texas House committee tasked with evaluating the legality of his murder conviction. The discrepancy is the hearing is scheduled for October 21 - days later than his execution date - yet the Department of Criminal Justice has not confirmed if his execution will be delayed or not.

 

The subpoena states that the accused killer must 'provide all relevant testimony and information concerning the committee’s inquiry,' according to CNN. The motion to allow Roberson to testify was backed by seven representatives. Rep. Brian Harrison filed the motion and Rep. Jeff Leach seconded it.

 

The state attorney general's office is going to keep fighting for Roberson to be executed and will now go through the Texas Court of Criminal Appeals, the Texas Observer reported. Leach said to CNN: 'It’s a historic, unprecedented step. We’ll see what happens next.' Roberson's attorneys said he would be the first American to be executed for charges linked to shaken baby syndrome.

 

These extended efforts came just after the Texas Board of Pardons and Paroles unanimously denied to overturn his conviction. The lead detective in the case Brian Wharton, numerous scientists and a bipartisan coalition of 86 state lawmakers have all came forward in support of his final bid for salvation.

 

Roberson was diagnosed with autism in 2018 while he was in prison. His lawyers claimed his diagnosis was not taken into account and contributed to his arrest and conviction. Prosecutors originally argued that Nikki's death was linked to shaken baby syndrome. She had intracranial hemorrhaging, brain swelling and bleeding behind her retinas. But his attorneys submitted evidence that the doctors may have misdiagnosed the young girl's cause of death, as they questioned whether shaken baby syndrome even exists. Roberson has maintained his innocence in his daughter's death. In August, his attorneys requested that the district court in Anderson County reopen his case.

 

In that filing, lawyers claimed new medical and scientific evidence shows Nikki died of severe viral and bacterial pneumonia that progressed to sepsis and then septic shock. They alleged she was chronically ill and suffered a high fever in the days before her death. When those symptoms continued for five days straight, Roberson and his mother took Nikki to a local emergency room, where a doctor prescribed Phenergan - a drug that now carries a Food and Drug Administration warning against being prescribed to children of Nikki's age and in her condition.

Megan Marshack, the journalist and aide to former vice president Nelson Rockefeller, has died in California at the age of 70. After decades of silence, Marshack used a self-penned obituary to sensationally reveal new details about her links with the former New York governor.

 

While she neither confirms or denies an affair, Marshack, who was at the centre of a storm of speculation about Rockefeller's sudden death in 1979, dropped a stunning clue about their relationship. She ends the obituary with a quote from an 'A Chorus Line' song: '… won't forget, can't regret what I did for love.'

 

Marshack died on October 2 of liver and kidney failure, according to the self-penned obituary posted by a funeral home in Sacramento, California. Her brother said she died at a live-in medical facility in Sacramento.

 

The aide, who had a long and varied career in journalism, suddenly gained national attention after the four-time Republican governor collapsed and died of a heart attack on the night of Jan. 26, 1979. Shifting explanations regarding the details of that night fanned conjecture about the death of the 70-year-old member of the wealthy Rockefeller family and the nature of his relationship with his 25-year-old researcher.

 

It was originally announced that Rockefeller died in his offices at Rockefeller Center. But a family spokesperson later said Rockefeller had been working on an art book at his private offices elsewhere in Manhattan when he was stricken. There also were discrepancies with his time of death and who was with him. Marshack was not initially identified as being with him when he died.

Marshack kept quiet about what happened and became a 'mystery woman' hounded by reporters.

Some of CNN's biggest on-air personalities are 'living in fear' as they brace for inevitable layoffs and massive salary cuts at the hands of the CEO.

 

Mark Thompson, who was hired late last summer as the network's new chief executive, is poised to overhaul the network - denying raises, trimming positions and moving some operations from New York to Atlanta, The Ankler reported. And as ratings continue to tank, some of the network's most popular - and expensive - anchors and correspondents may have their entire positions axed. 'Flat is the new up,' a CNN agent told the outlet with a laugh.

The network's dozens of national correspondents - who make anywhere between the mid-to-high six figures - are at the highest risk of having their salaries or jobs cut. Last month, CNN drew a total of 853,000 total viewers. The number is a third less than the network's competitors, including Fox News and MSNBC, which both drew well over a million.

 

Despite the ratings drop, Thompson has taken to prioritizing the network's digital strategy over all else since taking his position in the New York City office last October. Now, those who are employed as the talent on CNN's primetime programming segments are nervous about their contracts and job security.

'Mark has made it known he doesn't like the conventional style of TV packages we are doing,' another staff member told The Ankler.
