a marine who is trained is never self directed. if the appearance of self direction, he is under general orders, always, and accountable to the chain of command. a marine would never utilize their "training" without being under the orders of the chain of command.

so, if a trained, term-served marine is on a train and utilizes his military training, he does not know how. in the marines he is an element and the commander is the war fighter. now, having kick-ass dudes is a commander's dream, he is, none-the-less, the fighter with HIS elements, as a marine with his standard issue rifle, shovel, canteen, tattoos, etc.

 

everyone on the train was supposed to have acted out of fear. now, a marine never acts out of fear, but out of obedience to his chain of command, with full effort and esprit de corps, not fear.

 

the fact the marine didn't know when to let go of the choke hold demonstrates that the devil dog needs his handler, since he didn't know what a leader of his command element would do, he didn't do it.

the question is not about whether he was warranted to take the role of good samaritan. the question is, can the marine, a living, breathing weapon, take responsibility for being improperly decommissioned upon ets? who is responsible for the death of a man due to military weaponry not under direct control of lawful orders on domestic soil?

see, that's training in the dojo where one learns, at least in my experience, how to be sensitive to the training partners condition, especially if they're conscious or not.

 

but, a marine doesn't train for a second fight (sparring), a marine kills upon request by his command element.

but…. he isn't a marine, anymore.

 

but…. he acted like a marine under general orders to protect the general public, which he was not. one cannot conflate his identity as a civilian vs. as a marine.

 

a civilian is NEVER authorized with the power of a marine AND marines aren't allowed to function on u.s. soil expect for insurrection and whatever special cases.

 

but, yeah, he was waiting for instruction and the dude expired.

 

moreover, now death by schizophrenia, marijuana, and exertion could be precedent and that is just insane.

 

 

but, as a marine they also have a reserve component, so, was he still under obligation?

 

if so, maybe he could still be considered under usmc jurisdiction and they could send a legal council his way.
