Supreme Court Ruled Taxes Unconstitutional
In 1894, a Democratic-led Congress passed the Wilson-Gorman Tariff Act, which included an income tax provision. This income tax was a 2% tax on income over $4,000, affecting fewer than 10% of households at the time. However, this tax was challenged in the Supreme Court case Pollock v. Farmers’ Loan and Trust Company (1895).
In a 5-4 decision on April 8, 1895, the Supreme Court ruled that the income tax imposed by the Wilson-Gorman Tariff Act was unconstitutional because it was an unapportioned direct tax. The Court held that taxes on the rents or income of real estate, on personal property, or on the income of personal property (such as interest and dividends) were direct taxes within the meaning of the Constitution and therefore had to be apportioned among the states according to representation in the House of Representatives.
This decision effectively struck down the income tax law of 1894, as it could not be apportioned in the manner required by the Constitution. The ruling was highly unpopular and led to increased support for a constitutional amendment that would allow Congress to levy income taxes without apportionment. This eventually resulted in the ratification of the Sixteenth Amendment in 1913, which granted Congress the power to levy income taxes without apportionment among the states.
