The principle of reciprocity and Brazilian law

The principle is mentioned in several provisions of the national legal system, particularly in matters related to the Foreigner Statute (Law 6,815 of 1980) and nationality. Law 6,815 provides in its art. 10 that “the visa requirement, provided for in the previous article, may be waived for tourists who are nationals of a country that provides Brazilians with the same treatment.” And the sole paragraph adds that “the reciprocity provided for in this article shall, in all cases, be established by means of an international agreement, which shall observe the tourist’s stay period established in this Law.”
Also within the Statute there is an interesting provision on the extradition cooperation measure: “Art. 76. Extradition may be granted when the requesting government bases itself on a treaty, or when it promises reciprocity to Brazil.” And art. 130 states that the “Executive Branch is authorized to enter into international agreements by which, observing the principle of reciprocity of treatment for Brazilians (…).”
The Federal Constitution also refers to reciprocity, although it is not a principle expressly enshrined for international relations in its art. 4. The Magna Carta provides in § 1 of art. 12 that “Portuguese citizens with permanent residence in the country, if there is reciprocity in favor of Brazilians, will be granted the rights inherent to Brazilians, except in the cases provided for in this Constitution.” There are also other provisions:
Art. 52. Until the conditions of art. 192 are established, the following are prohibited: I - the installation, in the country, of new branches of financial institutions domiciled abroad; II - the increase in the percentage of participation, in the capital of financial institutions headquartered in the country, of individuals or legal entities resident or domiciled abroad. Sole paragraph. The prohibition referred to in this article does not apply to authorizations resulting from international agreements, reciprocity, or in the interest of the Brazilian Government. (…) Art. 178. The law shall provide for the organization of air, water and land transportation, and, as regards the organization of international transportation, it must observe the agreements signed by the Union, in compliance with the principle of reciprocity.
The principle of reciprocity has broad applicability within Public International Law and International Relations, however it has restrictions, especially when faced with humanitarian institutions, such as asylum and refuge, where their concessions aim to protect persecuted people. The granting of refuge to a Peruvian cannot be made conditional on the condition that Peru, in the future, grants refuge to a Brazilian."
