''There was one air traffic controller working two different tower positions at the time of the collision Wednesday night, an air traffic control source tells CNN. ''

The source describes the set-up, which had one person handling both local and helicopter traffic, as not uncommon.

The New York Times, which first reported the detail, says an internal, preliminary Federal Aviation Administration internal report says staffing was “not normal for the time of day and volume of traffic.”

The Reagan National control tower is 85 percent staffed, the source said, with 24 of 28 positions filled.

The National Transportation Safety Board is just beginning its investigation and will look at a wide range of potential causes of the collision. It is too early to tell whether the tower staffing at the time played a role in the incident.

Senate Budget Panel Advances Vought for Confirmation

The Senate Budget Committee on Thursday advanced Russell Vought's nomination to be President Donald Trump's budget chief.

The panel voted 11-0 to move Vought's nomination to be Office of Management and Budget director to the Senate floor for confirmation, Politico reported.

Only Republicans voted. Democrats boycotted the panel's meeting.

Little more than an hour before the noon meeting, Democrats on the committee posted on X that they would boycott the vote.

"Budget Committee Democrats are protesting the committee vote on Russell Vought's nomination to OMB to send a clear message: Vought is dangerously unfit for office," ranking member Sen. Jeff Merkley, D-Ore., posted alongside video of Democrats criticizing Vought.

On Wednesday, Democrats pressed Vought on what they said were Trump's "illegal" executive orders pausing certain funding under the Inflation Reduction Act and the Infrastructure Investment and Jobs Act.

The committee's Democrats had called for a delay in the proceedings to confirm Vought.

"The Senate Budget Committee will proceed with Mr. Vought's nomination as scheduled," the spokesperson for the committee's Republican chair, Sen. Lindsey Graham, R-S.C., said in a statement Tuesday.

OMB acting Director Matthew J. Vaeth said that the funding pause was meant to give time to determine if the programs fall in line with Trump's executive orders on foreign aid and climate change as well as the reversal of "woke gender ideology" and diversity, equity and inclusion initiatives.

On Wednesday, a White House spokesperson said the federal funding freeze remains in effect despite media reports it had been rescinded.

Vought also drew anger from Democrats for saying the 2020 presidential election was rigged.

Oxygen and photosynthesis – the basics

Since the late 1700s, we’ve been taught that light creates oxygen through photosynthesis, a crucial natural process that keeps life on Earth thriving.

Polonchuk, who owns a defense company specializing in electronic warfare equipment, made his remarks in an interview with Dignitas Fund, a nonprofit focused on raising funds for Kiev’s military. The interview was published on theNGO’s YouTube channel on Wednesday.

To safeguard drone production from Russian long-range attacks, Polonchuk emphasized the need to scatter manufacturing locations across the country.

“Production should be distributed across the country, hidden in basements–and thus scaled up.Assemble FPV drones of approved designs during labor lessons in schools. The whole country assembles what works, what is approved,” he stated.

According to Polonchuk,this decentralized approachwould protect drone manufacturing from detection and destruction. He warned that large-scale production sites are vulnerable because “if you build a workshop where 60 drones are simultaneously produced, it will quickly be hit.”

The principle is mentioned in several provisions of the national legal system, particularly in matters related to the Foreigner Statute (Law 6,815 of 1980) and nationality. Law 6,815 provides in its art. 10 that “the visa requirement, provided for in the previous article, may be waived for tourists who are nationals of a country that provides Brazilians with the same treatment.” And the sole paragraph adds that “the reciprocity provided for in this article shall, in all cases, be established by means of an international agreement, which shall observe the tourist’s stay period established in this Law.”

Also within the Statute there is an interesting provision on the extradition cooperation measure: “Art. 76. Extradition may be granted when the requesting government bases itself on a treaty, or when it promises reciprocity to Brazil.” And art. 130 states that the “Executive Branch is authorized to enter into international agreements by which, observing the principle of reciprocity of treatment for Brazilians (…).”

The Federal Constitution also refers to reciprocity, although it is not a principle expressly enshrined for international relations in its art. 4. The Magna Carta provides in § 1 of art. 12 that “Portuguese citizens with permanent residence in the country, if there is reciprocity in favor of Brazilians, will be granted the rights inherent to Brazilians, except in the cases provided for in this Constitution.” There are also other provisions:

Art. 52. Until the conditions of art. 192 are established, the following are prohibited: I - the installation, in the country, of new branches of financial institutions domiciled abroad; II - the increase in the percentage of participation, in the capital of financial institutions headquartered in the country, of individuals or legal entities resident or domiciled abroad. Sole paragraph. The prohibition referred to in this article does not apply to authorizations resulting from international agreements, reciprocity, or in the interest of the Brazilian Government. (…) Art. 178. The law shall provide for the organization of air, water and land transportation, and, as regards the organization of international transportation, it must observe the agreements signed by the Union, in compliance with the principle of reciprocity.

The principle of reciprocity has broad applicability within Public International Law and International Relations, however it has restrictions, especially when faced with humanitarian institutions, such as asylum and refuge, where their concessions aim to protect persecuted people. The granting of refuge to a Peruvian cannot be made conditional on the condition that Peru, in the future, grants refuge to a Brazilian."

A decades-old U.S. government ban on federally licensed firearms dealers selling handguns to adults under the age of 21 is unconstitutional, a U.S. appeals court held on Thursday, citing recent U.S. Supreme Court rulings expanding gun rights.

The ruling by the New Orleans-based 5th U.S. Circuit Court of Appeals marked the first time a federal appeals court has held that the prohibition violated the right to keep and bear arms enshrined in the U.S. Constitution's Second Amendment.

The appeals court had previously upheld that same ban in 2012. But that was before the 6-3 conservative majority U.S. Supreme Court handed down a landmark ruling in 2022 that established a new test for assessing modern firearms laws.

In New York State Rifle & Pistol Association v. Bruen, the Supreme Court held that modern gun restrictions were required to be "consistent with this nation's historical tradition of firearm regulation."

The federal ban on sales to people under 21 was first adopted by Congress in 1968 as part of the Omnibus Crime Control and Safe Streets Act.

A group of individuals between the ages of 18 and 20 along with the gun rights groups the Firearms Policy Coalition and the Second Amendment Foundation challenged the ban in 2020 and was appealing a lower-court judge's decision upholding the statutes.

U.S. Circuit Judge Edith Jones, writing for Thursday's three-judge panel, said that decision was wrong, as the statutes were "unconstitutional in light of our Nation's historic tradition of firearm regulation."

The U.S. Department of Justice during Democratic former President Joe Biden's tenure had defended the ban. But Jones said it put forth "scant" evidence to show that the gun rights of adults ages 18 to 20 were similarly restricted during the nation's founding era in the 1700s.

"Ultimately, the text of the Second Amendment includes eighteen-to-twenty-year-old individuals among “the people” whose right to keep and bear arms is protected," wrote Jones, who like the other panel members was appointed by a Republican president.

Brandon Combs, the Firearms Policy Coalition's president, in a statement called the ruling a victory against "an immoral and unconstitutional age-based gun ban."

The Justice Department did not respond to a request for comment.

Civil rights activists gathered outside the headquarters of Target Corp. on Thursday to call for a national boycott of the retailing giant over its decision to phase out its diversity, equity and inclusion initiatives.

Nekima Levy Armstrong, a veteran civil rights lawyer in Minneapolis and founder of the Racial Justice Network, joined other local activists and their supporters at a news conference to urge people to begin the boycott on Saturday, the first day of Black History Month. Many of the participants were regular Target shoppers until now, she said.

Levy Armstrong said they were “stunned” that Target, which increased its commitment to building a more diverse workforce in the aftermath of the police killing of George Floyd, a Black man, in Minneapolis in 2020, backed away from its support of racial equity.

“We thought that they would hold the line. We thought that they would continue to stand for the values that we all hold dear,” she said. "But instead they acted cowardly, and they made the decision to bow down to the Trump administration. Well, we are here today saying we will not bow down. We will not step back, and we will not turn around.”

Jaylani Hussein, executive director of the Minnesota chapter of the Council on Islamic-American Relations, said that as a company based in the city where Floyd's murder sparked a national reckoning with racial injustice, Target must be called out.

“We here in Minneapolis today, the good people of the state, are saying to our friends all over the country, ‘If you were moved to do something good after the murder of George Floyd, it is time for you to stand up and boycott Target,’” Hussein said.

Levy Armstrong and Hussein said they plan to partner with other national organizations to get the word out about the boycott and to take other steps they were not yet ready to share publicly.

Ever since calls for a boycott began circulating on social media, the founders of several Black-owned businesses that sell their products in Target stores or through the company's online platforms have expressed concern that a broad boycott might hurt them. They included the owners of hair care brands The Doux and Camille Rose, and the cosmetics brand Lip Bar.

The Minneapolis organizers said Black consumers and their white allies can continue to support those companies while cutting Target out.

“We are asking people to go on their websites and buy directly from those Black companies, because Target will not see a single one of our Black dollars,” Levy Armstrong said.

Mainstream outlets have given it sparse coverage, for reasons that will become clear shortly. Right-wing sources paid attention initially, but few ran follow-ups or took a close look at the court filings. So: What exactly is going on? How did all of this happen?

I am not a professional. I am a law student with a part-time job on @TheBARPod, a podcast about internet nonsense, and a side hobby of sticking my nose where it doesn't belong. I wanted, and want, to do a thorough report on this when I get the time. But the story is big enough, and spreading fast enough, that I want to make sure that people have access to accurate info as quickly as possible.

First, though: court filings are public records, but they are often expensive and difficult to obtain. Tools like RECAP help, but I was lucky to have people around me willing to pay the $80 in PACER fees for a few of the documents. This story is much larger than me and I do not want people to have to rely on me for it.

Historically, the pipeline into air traffic control has followed a few paths: military veterans, graduates of the "Air Traffic-Collegiate Training Initiative" (AT-CTI) program, and the general public. Whichever route they came from, each candidate would be required to take and pass the eight-hour AT-SAT cognitive test to begin serious training. This test was validated as being effective as recently as 2013.

The FAA has faced pressure to diversify the air traffic control for generations, something that seems to have influenced even the scoring structure of the AT-SAT cognitive test used for pre-employment screening of air traffic control candidates. Leading up to 2014, that pressure intensified, with the National Black Coalition of Federal Aviation Employees (NBCFAE) leading the push.

To start with, in 2000, a three-member task force, including NBCFAE member Mamie Mallory, wrote "A Business Case and Strategic Plan to Address Under-Representation of Minorities, Women, and People with Targeted Disabilities," recommending, per the lawsuit, a workplace cultural audit, diversity "hiring targets" for each year, and "allowing RNO- [Race and National Origin] and gender-conscious hiring." They were advised by Dr. Herbert Wong, who helped the NBCFAE analyze FAA diversity data in 2009. Wong authored a report concluding that the FAA was "the least diverse agency within the executive branch of the federal government." Mallory and Wong were consulted as part of the 2014 test replacement process.

From there, the NBCFAE sent letters in July and October 2009 to the FAA administrator and the Secretary for the Department of Transportation claiming disparate treatment, adopted a strategic plan "advocating for affirmative employment, obtaining an 'independent valuation of hiring and/or screening tools,' and pursuing litigation," a "Talking Points" document pushing the FAA to address diversity, and the creation of a group called "Team 7."

In 2012, Team 7 members met with the secretary of the Department of Transportation, the FAA administrator, and senior FAA leaders to discuss diversity, after which the FAA commissioned a "Barrier Analysis" with a number of recommendations. Central to this:the cognitive test posed a barrier for black candidates, so they recommended using a biographical test first to "maximiz[e] diversity," eliminating the vast majority of candidates prior to any cognitive test.

SUBJECT: Immediate Assessment of Aviation Safety

On January 29, 2025, a commercial aircraft and a military helicopter horrifically collided near Ronald Reagan Washington National Airport. American families today woke up without their loved ones after what should have been a routine trip, and the entire Nation mourns the loss of the victims.

This shocking event follows problematic and likely illegal decisions during the Obama and Biden Administrations that minimized merit and competence in the Federal Aviation Administration (FAA). The Obama Administration implemented a biographical questionnaire at the FAA to shift the hiring focus away from objective aptitude. During my first term, my Administration raised standards to achieve the highest standards of safety and excellence. But the Biden Administration egregiously rejected merit-based hiring, requiring all executive departments and agencies to implement dangerous “diversity equity and inclusion” tactics, and specifically recruiting individuals with “severe intellectual” disabilities in the FAA.

On my second day in office, I ordered an immediate return to merit-based recruitment, hiring, and promotion, elevating safety and ability as the paramount standard. Yesterday’s devastating accident tragically underscores the need to elevate safety and competence as the priority of the FAA.

Consistent with the Presidential Memorandum of January 21, 2025 (Keeping Americans Safe in Aviation), I am further ordering the Secretary of Transportation (Secretary) and the Administrator of the Federal Aviation Administration (Administrator) to review all hiring decisions and changes to safety protocols made during the prior 4 years, and to take such corrective action as necessary to achieve uncompromised aviation safety, including the replacement of any individuals who do not meet qualification standards. This review shall include a systematic assessment of any deterioration in hiring standards and aviation safety standards and protocols during the Biden Administration.

Consistent with the Presidential Memorandum of January 21, 2025, the Secretary and the Administrator shall take all actions necessary to reverse concerning safety and personnel trends during the prior 4 years, instill an unwavering commitment to aviation safety, and ensure that all Americans fly with peace of mind

In 2012 and 2013, the NBCFAE continued pushing this process, with members meeting with the DOT, FAA, Congressional Black Caucus, and others to push diversity among ATCs. By July 2013, the FAA created a "Barrier Analysis Implemention Team" (BAIT, and I swear I am not making this acronym up).

Around this time, the FAA decided to pause the hiring of CTI graduates pending the implementation of the biographical assessment. Neither the schools that ran the CTI programs nor their students were informed of this when the decision was initially made. A number of students, including the class representative, passed the AT-SAT (in the case of the class representative, with a perfect score), not knowing they would never get to use it.

In 2014, the FAA rolled out the new biographical questionnaire in line with the Barrier Analysis recommendation, designed so that 90% or more of applicants would "fail." The questionnaire was not monitored, and people could take it at home. Questions asked prospective air traffic controllers how many sports they played in high school, how long they'd been unemployed recently, whether they were more eager or considerate, and seventy-some other questions. Graduates of the CTI program, like everyone else, had to "pass" this or they would be disqualified from further consideration. This came alongside other changes de-prioritizing CTI graduates.

CTI schools were blindsided and outraged by this change. A report on FAA hiring issues found that 70% of CTI administrators agreed that the changes in the process had led to a negative effect on the air traffic control infrastructure. One respondent stated their "numbers [had] been devastated," and the majority agreed that it would severely impact the health of their own programs. The largest program dropped from more than 600 students to less than 300.

Concurrent to all of this, NBCFAE members were hard at work. In particular, one Shelton Snow, an FAA employee and then-president of the NBCFAE's Washington Suburban chapter, provided NBCFAE members with "buzz words" in January 2014 that would automatically push their resumes to the tops of HR files. A 2013 NBCFAE meeting advised members to "please include [on resumes] if you are a NBCFAE Member. […] Can you see the strategy", emphasizing they were "only concerned" with the employment of "African-Americans, women … and other minorities."

Three wildfires have erupted near North Carolina towns heavily impacted by Hurricane Helene last year.

Slovakian authorities will expel the individual, according to a police statement cited by media

A Ukrainian national has been arrested in Slovakia in connection with a coup threat, local media reported on Thursday, citing a police statement. The man, who has not been named, will be expelled from Slovakia and returned to Ukraine.

The move comes after Slovak Prime Minister RobertFico, who has refused to follow NATO and EU policyon the Ukraine conflict and survived an assassination attempt by a pro-Kiev activist last year, linked recent anti-government protests in his country to interference by Ukrainians.

Tulsi Gabbard, President Donald Trump's pick to be director of national intelligence, faced sharp criticism from Democrats on Thursday during a fiery confirmation hearing focused on her past comments sympathetic to Russia, her meeting with Syria's now-deposed leader and her past support for government leaker Edward Snowden.

Gabbard's opening statement went all-in on critics opposed to her nomination because she asks tough questions and does not always follow Washington dogma.

"The fact is what truly unsettles my political opponents is that I refuse to be their puppet," she said.

Gabbard started her hearing by telling lawmakers that big changes are needed to address years of failures of America's intelligence service. She said too often intelligence has been false or politicized, leading to wars, foreign policy failures and the misuse of espionage. And she said those lapses have continued as the U.S. faces renewed threats from Russia and China.

"The bottom line is this must end. President Trump's reelection is a clear mandate from the American people to break this cycle of failure and the weaponization and politicization of the intelligence community," Gabbard told the Senate Intelligence Committee.

Gabbard promised to be objective and noted her military service, saying she would bring the same sense of duty and responsibility to the Office of the Director of National Intelligence, which oversees and coordinates the work of 18 intelligence agencies.

Gabbard, a former Democrat congresswoman from Hawaii, is a lieutenant colonel in the National Guard who deployed twice to the Middle East and ran for president in 2020. She has no formal intelligence experience, however, and has never run a government agency or department.

It is Gabbard's comments, however, that have posed the biggest challenge to her confirmation. Gabbard has repeatedly echoed Russian propaganda used to justify the Kremlin's invasion of Ukraine and criticized Ukrainian President Volodymyr Zelenskyy as a corrupt autocrat.

She has been accused of spreading Russian disinformation by Republican lawmakers and has even won praise in Russian state-controlled media. Sen. Jerry Moran, R-Kan., asked Gabbard on Thursday whether Russia would "get a pass" from her.

"Senator I'm offended by the question," Gabbard responded. "Because my sole focus, commitment and responsibility is about our own nation, our own security and the interests of the American people."

A 2017 visit with Syrian President Bashar Assad is another point of contention. Assad was recently deposed as his country's leader following a brutal civil war in which he was accused of using chemical weapons. Following her visit, Gabbard faced criticism that she was legitimizing a dictator and then more questions when she said she was skeptical that Assad had used chemical weapons.

After the 2014 biographical questionnaire was released, Snow took it a step further. As Fox Business reported (related in Rojas v. FAA), he sent voice-mail messages to NBCFAE applicants, advising them on the specific answers they needed to enter into the Biographical Assessment to avoid failing, stating that he was "about 99 point 99 percent sure that it is exactly how you need to answer each question."

"Edward Snowden broke the law," she said.

Sen. Michael Bennet, D-Colo., repeatedly pressed Gabbard on whether she believed Snowden is a traitor. "Yes or no, is Edward Snowden a traitor to the United States of America?"

Gabbard responded directly.

"As someone who has served in uniform in combat, I understand how critical our national security is," she said before Bennet cut her off, saying "Apparently, you don't."

As a lawmaker, Gabbard sponsored legislation that would have repealed a key surveillance program known as Section 702, which allows authorities to collect the communications of suspected terrorists overseas.

Gabbard argued then that the program could be violating the rights of Americans whose communications are swept up inadvertently, but national security officials say the program has saved lives.

She now says she supports the program, noting new safeguards designed to protect Americans' privacy.Gabbard defended her change of opinion.

While lawmakers from both parties have raised concerns about Gabbard's nomination, Republicans have increasingly come to support her. Given thin Republican margins in the Senate, she will need almost all GOP senators to vote yes in order to win confirmation.

Sen. Tom Cotton, chairman of the Senate Intelligence Committee, supports Gabbard's nomination and said at the start of Thursday's hearing that he hopes she can rein in an office that he said has grown too large and bureaucratic.

Cotton, an Arkansas Republican, noted the Office of the Director of National Intelligence is now larger, in terms of staffing, than any of the agencies it was created to oversee.

"Look at where conventional thinking has got us. Maybe Washington could use a little more unconventional thinking," Cotton said. "Ms. Gabbard, I submit that, if confirmed, the measure of your success will largely depend on whether you can return the ODNI to its original size, scope, and mission."
