Listen to/watch this exchange between DCA ATC and PAT25. ATC was not in the wrong. PAT25 repeatedly requests visual separation. The burden is then on PAT25 to maintain visual separation. The ATC double checks with PAT25 after receiving a conflict alert.

 

The only apparent anomalies are PAT25 reporting 200 -300 -> 400 feet (collision) altitude and the failure of PAT25 to maintain visual separation. Planefags please comment.

Agreed. The board saw that when we lost 'Oh Shit!'Anon in San Diego. RIP. In both cases the pilots bore primary responsibility. ATC did their duty. In DC, perhaps the ATC deferred to a MIL pilot who claimed to have visual separation.
