The Department for Work and Pensions has clarified how new bank account checks will be used - and when. The Data Protection and Information Bill, currently moving through the House of Lords, would give the Department for Work & Pensions ( DWP ) unprecedented powers to monitor the financial activity of benefit.

Cabinet under secretary, Georgina Gould, told MPs: Clause 17 introduces direct deduction orders as a method to recover public funds lost to fraud and error from a liable person’s bank account. Direct deduction orders are a vital mechanism to recover funds from a liable person who can afford to repay their debt but refuses to do so."

Ms Gould said: "The introduction of direct deduction orders is essential to bolster the Government’s ability to recover public funds, ensuring that taxpayer money lost to fraud and error is reclaimed and redirected towards essential public services and the common good."

She went on, adding: "To safeguard the use of these powers, direct deduction orders will be used after an investigation by the Public Sector Fraud Authority into suspected fraud against a public authority. The decision to make a direct deduction order will be made by trained and authorised officers in the PSFA who will work to the standards of the Government counter-fraud profession.

"The investigation must determine, to the civil standard of proof, that money is owed to the public sector as a result of fraud or error. As I have said, we will seek voluntary engagement and repayment, and only after those efforts have been unsuccessful will direct deduction orders be used."

Gould said: "Direct deduction orders can be either regular, requiring regular deductions, or lump sum, requiring a specific amount to be deducted. Both types of orders can be issued for the same account, to ensure operational flexibility while considering and protecting vulnerability. Copies of direct deduction orders must be sent to the liable person, the joint account holders, if applicable, and the bank where the account is held.

She said: "To safeguard the use of such powers, the first notice must invite the liable person and any joint account holders to make representations about the terms of the proposed order and, in the case of a joint account, about the liable person’s beneficial interest in the amount in the account.

"Consideration must be given to any representations made and, in the case of a joint account, an assessment of the liable person’s beneficial interest must be made. It is also intended that direct deduction orders will be subject to the independent oversight created in the Bill, which we will come to in chapter 6."

"Direct deduction orders, as outlined in the clauses, are key to seeking the efficient recovery of public moneys, while ensuring that recovery is fair and proportionate with robust safeguards to protect those in vulnerable situations. They also ensure the fair and appropriate protection of the rights of the individuals involved, allowing for informed decision making and protecting non-liable parties in joint accounts from unwarranted deductions. Having outlined the key provisions in the clauses, I commend them to the Committee," she said.

How to upload the documents needed for your Universal Credit claim review

We are reviewing your Universal Credit claim to make sure your payments are correct.

As part of the review, we are creating to-dos for you to complete. These to-dos must be completed by 17 March 2025 or your Universal Credit payments may be affected.

These to-dos are called:

Claim Review: provide bank statements.

Claim Review: upload document.

Each to-do includes instructions and a due date.

If you do not complete these to-dos, then either:

  • your payment could be stopped and then your claim might be closed

  • part of your payment could be removed

We may also ask for more information and documents. You will receive a separate message about this.

Claim Review: provide bank statements

As part of the Universal Credit review, we need you to upload bank or building society statements for all your current and savings accounts. This includes joint account statements.

You must complete this to-do by 17 March 2025. If you do not, it may affect the amount of money you receive.

Your statements must:

cover the past 4 months

show both incoming and outgoing transactions

show the start and end balances

You can save or download statements from your online banking account or mobile banking app.

The statements you upload should be in PDF format.

Claim Review: upload document

You need to upload a copy of your photo ID for your claim review. You must do this even if you have provided it before.

You must complete this to-do by 17 March 2025, or your Universal Credit payment may be affected.

Send photos of one of the following:

  • Passport

  • Driving licence

  • ID card

  • Biometric residence permit (BRP)

With all types of ID documents, make sure that:

  • all text is in focus and readable

  • the photos are in colour

  • the photos are of the original document

  • the document in the photo is fully open and flat

  • the outside of all 4 edges of the document can be seen in the photo

If you upload a passport, you need to send 2 photos:

  1. A close-up of your passport opened at the photo page. The photo must show both pages.

  2. A photo of you holding up the photo page of your passport next to your face.

If you upload a driving licence, ID card or biometric residence permit (BRP), you need to send 3 photos:

  1. A photo of you holding up the front of the document next to your face.

  2. A close-up photo of the front of the document.

  3. A close-up photo of the back of the document.

We need to see a licence 'check code' if you choose to send photos of your driving licence. Create your check code here (https://www.gov.uk/view-driving-licence) and send it to us in a journal message.
