Totally false. Every person on US soil has certain constitutional protections, such as the right to due process, otherwise government can just claim you're here illegally and deny you your day in court as a way to deny constitutional protections.
Remember that early on it was talked about military tribunals to avoid "friendly" courts, and if the courts are overloaded does military have to take over?
It seems to me some would be desperate to deny these people due process to ensure the courts don't become overloaded.
