Federal Appeals Court Rules 7-4 IEEPA Tariffs Unlawful, Decision Qualifiers and Narrow Application – Tariffs Remain Pending SCOTUS Review

There are trillions at stake. Thecurrent 7-4 decisionfrom the U.S. Court of Appeals for the Federal Circuit surrounds a May decision by the U.S. Court of International Trade. The original caseconcluded that President Trump exceeded his authorityunder the 1977 law he invoked to impose both the fentanyl trafficking tariffs and his worldwide tariffs, the International Emergency Economic Powers Act (IEEPA). “We are not addressingwhether the President’s actions should have been taken as a matter of policy. Nor are we deciding whether IEEPA authorizes any tariffs at all. Rather,the only issue we resolveon appeal iswhetherthe Trafficking Tariffs and Reciprocal Tariffs imposed by the ChallengedExecutive Orders are authorized by IEEPA. We conclude they are not==.”

It is obviousthe Democrat appointed majority are tenuous in their position.No one doubts the presidential powerto declare a national emergency. To wit, the ruling highlightsa very nervous courtwith much of the language straddling the fencetrying notgive the impressionthey are interfering in Article II presidential powersto make foreign policy decisions.

Unelected judges restricting the power of the Executive Branch, and by extension restricting a President elected by the majority of the nations’ citizens to address a national emergency, is not a construct supported by the Supreme Court. The six (seven) activist judges on the federal appeals court panel seemingly know this; however, the power of the political -and I would guess financial- pressure compels them.

The court deferred their rulingwhich will not take effect until Oct. 14, giving the Trump administration time to appeal the decision to the Supreme Court. President Trump responded via Truth Social.

Even if the Supreme Court sided with the federal circuit decision, a tenuous guessing game at best,there are other tools and techniques already in place for President Trump to retain the tariffs.

The question at the heart of this argumentis whether International Emergency Economic Powers Act, is the best justification for the tariff approach toward national security, where ‘economic security is defined as national security.’

Think about it. President Trump could instruct the USTR (Jamieson Greer) to dissolve all existing U.S. trade agreements within 90-days, due to the national debt emergency. A legally authorized zero-trade position.

Notice that no foreign nation is challenging these tariffs as applied. The legal challenges are all coming from inside the U.S.A, as multinational corporations fight to retain the status quo.==

Mexico Is Doing What Canada Is Ignoring – Preparing for 2026 USMCA Renegotiation

There are going to be two major stories in 2026 that we will have full context to understand.Yes, the 2026 midterm politics are going to lead the headlines,but two other issues will have considerable impact.

The first, is the FISA (702) reauthorization, and there is a lot that will surface in the next several months likely toupend the best laid plans of the administrative UniParty[Tulsi Factor].

The second, is the USMCA reauthorization – the end of the trilateral trade agreement, and the structural shift into two separate free trade agreements.

As to the latter issue, while Mexico and Canada are currently in a state of economic flux,only Mexico is preparingto deal with the seismic shift that is about to unfold.Canada is going to be caught completely off guard.

While Canadian Prime Minister MarkCarney is trotting around Europetrying to establish his relevance amid the pro-Ukraine coalition, Mexican President ClaudiaSheinbaum is spending time focused on her domestic economy.

Mexico is preparing to drop significant tariffs on Chinese imports, a proactive move to position Mexico in advance of the upcoming bilateral discussion.

Sheinbaum knowsthat right now for every deportation ICE executes,her economy is hit as remittances recede.

Simultaneously,for every mile of border wall that is completed, the financial dependency model increases. President Trump’s leverage in the upcoming bilateral trade negotiation against Mexico increases each day, week and month.

Claudia Sheinbaum is smartly focusedon trying to get ahead of the issues,while Mark Carney ignores his vulnerabilityand is about to make Canada naked to the economic weaknesses created by Justin Trudeau.

CHINA POST –Mexico is preparing to raise tariffs on Chinese importsof automobiles, textiles and plastics, Bloomberg News reported on Thursday, under a proposal expected to be part of the 2026 budget to be submitted to the nation’s Congress next month.

If confirmed, the increase would mark one of Mexico’s sharpest trade shifts in recent years.

Officials in Washington have urged the move aspart of US President Donald Trump’s push to build a “Fortress North America” and reduce dependence on Chinese supply chains.

Trump has been along-time critic of what he calls trade “loopholes” in the US-Mexico-Canada Agreementallowing Chinese goods to enter the US. During his election campaign last year, he railed against Chinese carmakers building plants in Mexico to export cars to the US.

Mexico’s imports from China exceeded US$51 billion last year, accounting for nearly one-fifth of the country’s total purchases abroad.

The rapid growth has turned Mexico into China’s top overseas market for vehicles, but has also left local manufacturers complaining of unfair competition from subsidized goods. The planned tariffs could also be extended to other Asian nations,although China remains the main focus. (read more)

Taken in context, Mexican President ClaudiaSheinbaum is prepping to be in alignment with the goals and objectives of President Trump. MeanwhileCanada is completely ignoring the issue of Chinese trade, and the loopholes that anger President Trump within the USMCA exploitation.
