That's the key issue wrt 1st amendment and actions against a government, IMO.
You can't knowingly lie in an attempt to undermine an administration. A government does have some prior restraint rights, in a walking a knife edge kind of way.
Looks to me, though, rather than fight an iffy 1st amendment route they will go for a RICO case.
